HomeMy WebLinkAboutRESO 6189••• 9 ORIGINAL RESOLUTION NO. 6189 RESOLUTION OF THE COUNCIL OF THE CIT'i OF PALO ALTO APPROVING ASSOCIATION OP BAY AREA GOVERNMENTS' HOUSING NEEDS DETERMINATIONS WHEREAS, Califi:>rnia Government Code Section 65584 requires the Association of Bay Area Governments ( •ABAG•) to determine regional housing needs and applicable city shares of such needs1 and WHEREAS, Government Code Section 65583 requires that local shares of such needs are to be included in the Housing Element of communities' General Plans due to the State by July 1, 19841 and WHEREAS, ABAG released housing need detE:rminations for Palo Alto on August 1, 1983; and WHEREAS, Section 65584 further provides that within 90-days, local governments may accept or revise their share of the regional housing needs based upon available data and accepted planning methods; and WHEREAS, the ABAG housing need determinations have been evaluated in the light of the requirements set forth in Section 65584, and the City recommends no modification1 NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Council hereby accepts the ABAG housing need determinations as set forth in Exhibit •A• attached hereto. SECTION 2. The Council of the City of P·a10 Alto finds that this is not a proJ&et under the California Environmental Quality Act, and therefore, no environmertal impact assessment is necessary. SECTION 3. This resolution is effective immediately. Rem. 78 (20S) 59 {151) 82 (211) 172 (441) County 15.730 12.212 . 16,957 35,857 I I ORIGINAL RESOLUTION NO. 6190 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ADOPTING AMENDMENTS TO THE PALO ALTO COMPREHENSIVE PLAN TO CLARIFY CONDITIONS UNDER WHICH EXISTING RENTAL HOUSING MAY BE REPLACED BY NEW RESIDENTIAL CONDOMiNIUMS WHEREAS, the Planning Commission has conducted a review and on September 28, 1983, held a properly-noticed public hearing to consider amendments to the Palo Alto Comprehensive Plan; and WHEREAS, the Planning Com1Rission has recommended the adoption of certain amendments to the Palo Alto Comprehensive Plan to clarify con- ditions under which existing rental housing may be replaced by fl9W residential condominiums. NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Council finds that changed conditions and the public in tere&t, hea 1th, safety, and welfare require amendment to the Palo Alto Comprehensive Plan as set forth in Sections 2 and 3 hereof. SECTION 2. The City council hereby adds a new Program 13A under Policy 8 of the Housing Element of the Palo Alto Comprehensive Plan to read as follows: "Program l3A For any residential de'7elopment in multiple- family zones which causes the loss of a rental housing unit, subdivision approval (including condominium maps) may be granted only if any one of the following circwaatances is met. A. The project will result in a significant net gain to the city housing supply (defined as l 00\ more uni ts than those previously existing on the site) and comply with the city BMR program C broadened to include, in this case, projects with less than 10 units)r or ·a. The number of rental uni ts to be provided by -tbe project is at least equal to the number of existli:.~ rental units (defined as all units past one in any project); or- e. Not less than 20\ of the units provided are belo~ aarket rate {BMR) units (miniaw1 one BMR, no in-lieu fee)1 or
