RESOLUTION OF COUNCIL OF THE CITY OF PALO ALTO
AMENDING SCHEDULES E-1, E-2, E-3 AND E-4 OF THE CITY OF
PALO ALTO UTILITIES RATES AND CHARGES PERTAINING TO
DOMESTIC, COMMERCIAL, CUSTOMER-OWNED GENERATION
AND STREET AND HIGHWAY LIGHTING RATES
The Council of the City of Palo Alto does RESOLVE as follows:
SBCTION 1. Pursuant to Section 12.20.010 of the Palo Alto
Municipal Code, Schedules E-1 (Domestic Electric Service), E-2
(Commercial Electric Service), E-3 (Customer-Owned Generation) and
E-4 (Street and Highway Lighting) of the Palo Alto Utilities Rates
and Charges hereby are amended to read as shown on Sheets E-1-1,
E-2-1, B-2-2, E-2-3, E~2-4, E-3-1, E-3-2, E-4-1, E-4-2, E-4-3, and
E-4-4, respectively, attached hereto and incorporated herein.
SEc•rtON 2. This Council finds that the revenue from the
authoi'lzed adjustments of said electric rates by the City Manager
shall be used only for the purposes set forth in the Palo Alto City
Charter, Article VII, Section 2, entitled •public Utilities
Revenue•. The adoption of this Resolution is, therefore, specifi-
cally exempted under Public Resources Code Section 21080(b)(8) from
the requireaents of CEQA.

Solar Energy Discount:
Upon approval by the City1 a 10 percent discount wH 1 be applied to a
customer's electric bill if such customer has installed a solar energy
systen and met the following criteria: (1) The solar energy 5ystem is in
conformance with the City's performance and aesthetic standards; (2) The
solar energy ~ystem is designed to provide for 50 percent or more of the
residential domestic water heating or space heating requirements; and (3)
Appropriate C1ty permits are acqvired.
*A •single-family domestic dwelling" is designated as any house. cottage. flat,
or apartment unit having a kitchen, bath, and sleeping facf11t1es.

Whenever the monthly use of ener91 has exceeded 89000 kilowatt-hours for

The maximum demand in any month will be the max1!11t.1'1 average power in kilowatts taken during any 15-minute interval in the month provided that in
case the load 1s intermittent or subject to vfolent fluctuations, the City
may use a 5-~inute interval. A thermal-type demand meter which does not
reset after a definite time interval may be used at the City's option.
The billing demand to be used in computing charges under this schedule will
be the mean of the actual maximum demand 1n kilowatts for the current month
and the highest such demand occurring fn the year ending with the current
month •

Where delivery hereunder is made at the sa.ne volta9e as that of the line
from which the service is supplied, a discount of 4 percent for 11 kilovoits
or higher available line voltages and 3 percent for available line voltages
of from 2 kilovolts to 10 kilovolts will be allowed provided the City is not
required to supply service at a particular line voltage where it has. or will
instal 1, ample facil it1es for supplying at another voltage equally or better
suited to the customer's electrical requirements. The City retains the right
to change its line voltage at any time after providing reasonable advance
notice to any customer receiving a discount hereunder and affected by such
change. The customer then has the option to change his system so as to
receive service at the new line voltage or to accept service (without voltage
discount) through transforwers to be supplied by the City subject to a
maximum KYA size limitation.

Upon approval by the City, a 10 percent discount will be applied to a
customer•s electric bill if such customer has installed a solar energy
system and met the following criteria: (1) The solar energy system is in
conformance with the City's performance and aesthetic standards; (2} The
solar ener9y system is designed to provide for SO percent or more of the
residential domestic water heating or space heatir.g requirements; and
(3) Appropriate City permits are acquired.
Power F8.Ctor:
At the City's option, VAR-hour metering, used for power factor calcu-1 ation, will be installed on the service of any new customer whose
demand is expected to exceed 200 kilowatts and upon the service of any existing custOMer whose demand has exceeded 200 kilowatts for three
consecutive months. The City may exercise ~he option of removing the VAR-hour metering frOIR the s~rvice of a castomer whose demand has been
below 200 kf lo~atts for four consecutive lll)nths.
When such power-factor 11etering is installed on a customerts service,
the total charge for any month's electric service as computed on
Schedule E-2 shall be decreased or increased, respectively, by 0.2
percent for each one pe~cent that the average power factor of the
customer'~ load during the 110nth was greater or less than 90 percent,
such average power factor to be computed (to the nearest \llhole percent)
frOlll the ratio of lagging k11ovoltadlphere hours to kilowatt hours
consumed during the 111>nth. This adjustment shall be applied to a
customer's bill prior to the application of the primary-voltage discount
clause. Any electric service charge increase attributable to cust011er 1s
failure to achieve 90I of the average power factor is referred to herein as the •power factor penalty.•
Before 1nstall~ng VAR-hour metering on an existing customer's service, the utility will measure the customer•s power factor and notify the
customer of the result of the measurement.
Th~ custOlfter shall then be allowed 60 days to enter in a mutually agreed
upon factor correction program. The program shall be based on the
City',:.. dollar est11nate of the fnnual potential power factor penalty.
The customer shall agree to install power-factor corrective devices on

his system eQuhalent to the annual dcllar value of the Cit.Y's estimate of
the power-factor penalty. This corrective program shall continue in effect
at the initial power-factor average up to a maximum of five (5) years, until
the customer's power-factor reaches 90 percent for six (6) consecutive
months. If the customer fails to achieve a 90 percent po~er ~actor for six
(6) consecutive months during such five (5)-year period, the power factor
penalty shall then become effective on the customer billing. During the
time this agreement is in effect, the City shall not impose any other
power-factor ~enalty on the customer.
If the above agreement is not implemented. VAR-hour metering shall be
installed and the customer shal 1 be bil'ted in accordance with the above
provisions, including th~ power-factor penalty.

The following rates shall apply to customer-owned generatfng facilities.
Firm power shall be defined as power that can be exectly interchangeable
with the utility's current resources. Non-firm power shall be defined as
that power which is availab1e to the utility on a randan basis and no
schedule or control shall be available for such power.
Such determination shall be made by the utility after reviewing the
character of such power generated with respect to reliability, scheduling,
availability, terms and conditions, scheduled outages, systen emergenci~s
and other factors which the utility shall deem relevant.
RATES:
The following rates shall apply to the power produced by a qualifying
facility on a monthly billing basis.

to account for the effect of losses and for administrative costs assoc1ated
with the facility.
2. Generation credit. as calculated under the rate above. will be applied to
the customer's monthly charge for electric service from the utility. The
utility shall provide pa,ment to the customer fn the event generation
credits are in excess of the monthly charge.
3. All conditions relating to the terms of interconnection aNI sales shall be
covered by a service contract.

4. The utility reserves the right to establish a customer charge in order to
recover costs of certain facil it 1es required to serve load for which the
utility is standing by. Such charges shall be specifi~ in the service
contract with the customer.
5. A qualifying facility is def;ned as set forth in the Federal Energy
Regulatory C0111nission's Order Nllllher 69, of Title 18s Code of Federal
Regulations, Part 292~ Subpart 8 entitled •Sm3ll Power Production and
Cogeneration Facilities, Qualifying Status8 • This subpart implements
Section 201 of the Public Utilities Regulatory Policies Act (PURPA).

voltage. Unless otherwise agreed, multiple current will be delivered at
120/240 volts1 three-wire, single-phase. In certain localities the Utility
may supply servite from 120/208 volt star-connected polyphase lines in place
of 240-volt service. Single phase service from 480-volt sources will be
available 1n certain areas ut the option of the Utility· Wien this type of
service is practical fr(JRI the Utility's engineering standpoint. All
currents and voltages stated herein are nominal, reasonable variations being
permitted. New lights w111 normally be supplied as multiple systens. .
Point of Deliver{: Delivery wfll be made to the customer's syste111 at a
point or it poin s mutually agreed upon. 1ne City will furnish the service
connection to one point for each group of lamps, provided tiff! c~st0111er has
arranged hfs systen for the least practicable nunber of points of delivery.
A 11 underground connect1 ons wi 11 be made by the custMer or at the
custOll!er's expense.
Sw1tchinT: Switching will be perfonfted by the City of Palo Alto (on the city's s ae of points of delivery) and no charge w111 be made for switching

posts, provided these are all of good standard construction; otherwise, the
City may decline to grant Class C rates. Class C rates applied to any
agency other than the City of Palo Alto also fnclude painting of posts with
one coat of good ordinary paint as required to maintain good appearance but
do not include replacement of posts broken by traffic accidents or
otherwise.
Multilamp Electroliers: The above charges are made on per-lamp basis. For
posts supporting one or more lamps, where the lamps are less than nine feet
apart, the above charges for Class C will be reduced by 6 percent
computed to the nearest whole cent, for all lamps other than the first one.
9peratin9 Schedules Other Than All-Night and Midnight: Rates for regular
operating schedules other than all-night and m1dn1ght will be the midnight
rates plus or minus one-P.leventh of the difference between the m;dnight and
the all-night rate, computed to the nearest whole cent, for each half hour
per n1ght l'llOre or less than midnight service. This adjustment will apply
only to latnps on regular operating schedules which do not exceed 41 500 hours
per year.
Street Light Lamps, Standard and Nonstandard Ratings: The rates for
inca'1<1escent lanps under Class A are applicilile for service to regular
street lMPS only and mst be increased by 6 percent, computed to the
nearest whole cent, for service to ~rcup ... replacement street lamps. The
rates under Class C are applicable to both regular ~nd group-replacement
street l 11111>s.
Continuous ~ration: The rate for conttnuous 24-hour operation under Class A service W1 be tWice the all-night rate. ·
System Owned In-Part bt City: Where, at customer's request, the CHy
installs. owns. arid ma ntains any portion of the 11ght1ng fixtures, supports. and/or interconnecting circuits, an extra 111>nthly charge of one
and one-fourth percent of the City's estimate of additional investment shall
be made.
Rates For lfllPS Not on Schedule: In the event a customer installs a lamp
Wtl1cn is not~reserttly represented on this schedule, the utflfty w111
prepare an inter111t rate reflecting the utility's estimated costs associated
with the spec1f1c 1._, size. This interim rate will serve as the effective
rate fer billing purposes until the new lamp rating is added to Schedule
E-4.
