A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALO ALTO OVERRULING PROTESTS
01\ME STREET UNDERGROUND UTILITIES
ASSESSMENT DISTRICT NO. 25
The C1ty council of the C1ty of Palo Alto. County of Santa Clara.
California, does RESOLVE that:
SECTION 1. That on May 16. 1983 this Counc11 adopted Resolution No.
6118, A Resolution of Intent1on to Make Acquhtt\ons and Improvements;
SECTION 2. That not1 ce of the t1me and place of hear1 ng protests t n
relat1on to sa1d pro90sed acqu1s1t1ons and 1mprovements was duly g1ven and all
wr1 tten protests and other written c01111tUntcat1ons were publ 1cly read at sa1d
hearing and all persons des!r1ng to be heard were fully heard;
SECTION 3. That protests aga1nst said acquisitions and 1mprovements,
and/or matters related thereto, were not signed and duly f11ed by the o .. ners
of a majortty or more of the area of the lands w1th1n the assessment d1str,ct.
or of the area of the lands wHhtn the assessment dhtr1ct assessed for the
costs and e~penses of said acquistt1on~ and 1mprovements.
SECTION 4. That sa1d protests. and each of them. are overruled .

ADOPTING ENGINEER'S REPORT. CONFIRMING THE ASSESSMENT
AND ORDERING THE HORK AND ACQUISITIONS, DIRECTING
RECORDING AND FILING OF ASSESSMENT. ASSESSMENT
DIAGRAM AND NOTICE OF ASSESSMENT, APPOINiING
COLLECTION OFFICER. AND PROVIDING FOR NOTICE
TO PAY ASSESSMENTS

SECTION l. That on Hay 16, 1983, this Council adopted Resolution No.
6118. A Resolution of Intent1on to Make Acqut sit,ons. and Improvements. and
therein directed the C1ty Eng1neer to make and f11e a report 1n wr1tlng 1n
accordance ~1th and pursuant to sa1d Resolut1on of Intention;
SECTION 2. That sa1d report was duly mada and f11ed. and duly
considered by this Council and found to be. suff1c1ent 1n every part1cular,
whereupon 1 t was deter1111 ned that sa 1 d report shou1 d stand as the Eng1 neer' s
Report for all subsequent proceed1ngs under and pursuant to the aforesaid
resolution, and August 15, 1983, at the hour of 7:30 o'clock p.11 •• tn the
regular meet1 ng place of thfs Council, Palo At to C1vtc Center, 250 Hamfl ton
Avenue. Palo Alto, California were appointed as the time and place for hearing
protests ln relatton to said proposed acqu1sH1ons and 1mprove11ents, nottces
of wh1ch hearing were duly and regularly posted, mailed and published; and
SECTION 3. That sa1d hearing was duly and regularly held, and al 1
persons interested des1r1ng to be heard were glven an opportunity to be heard,
and all matters and th1ngs pertaining to said acqu1s1t1c·n~ and 1raprovements
were fully heard and considered by th1s Counc11, and all p~~t::ts, beth
wrttten and oral. were duly heard, cons1dered and overruled. and th1s Council
thereby acqutred jur1sdictlon to order satd acqu1sitions and improvements and
the conf1rmat1on of sa1d dtagram and assessment to pay the costs and &xpenses
thereof;
SECTION 4. Tha.t the owners of one-half of the area to be assessed for the cost of the project d1d not, at or pr1or to the ttme f1xed for said
