CALLING FOR SEALED PROPOSALS ANO FIXING LIQUIDATED DAMAGES FOR FAILURE TO COMPLETE THE NORK HITH!N TIME SPECJFIED ORME STREET UNDERGROUND UTILITIES ASSESSMENT DISTRICT NO. 25 ORIGINAL The C1ty Counctl of the City of Palo Alto. County of Santa Clara, Ca11forn1a, does RESOLVE that SECTION 1. On May 16. 1983 thts Council adopted Resolution No. 6118, A Resolution of Intention to AcqL11re and Construct Improvements, and plans and spec1ftcat1ons suitable for calling for b1ds for construction of sa1d improvements ~ave been sublll1tted for approval by this Council; SECTION 2. Sa1d plans and specifications for the constructton of said t mprovements. on f 11 e t n the off Ice of the Ct ty Cl erk of th ts C1ty, are hereby approved. SECTION 3. Sa\d Clerk is hereby d1rected to pub11sh once a wee~ for two weeks 1n the Pen1nsula T1mes Tr1bune, a newspaper publtshed and c1rcu1ated tn the C1ty of Palo Alto. a nottce 1nv1t1ng sealed proposals or b1ds for the cons true tt on of sat d 111prove11ents. and ref err 1 ng to the p 1 ans and spectftcattons on fne tn the offtce of sa1d Clerk, the ftrst pub11ca.t1on of whtch notice shall be at least fourteen <14> days prior to the t1me ftxed for opening bids. SECTION 4. All proposals or btds shall be accompanied by cash, a cash1er's or cert1f1ed check payable to the order of the Ctty of Palo Alto a110Unttn9 to ten parcent OO"L> of the bid. or by a bond in sa1d amount and payable to the City of Palo Alto signed by the btdder and a corporate :..Jrety or by the btdder and two sureties who shall just1fy before any offtcer competent to adm,n1ster an oath, 1n double sa1d amount and over and above all statutory exempt1ons. The amount so posted shall be forfe1ted to th1s C1ty tn case the b1 dder depos 1t1 ng the same does not, w1 th1 n fl fteen C 15) days after written notice that the contract has been awarded to Mm, enter 1 nto the contract to construct sa1d 1mproveinents. SECTION 5. Pursuant to Sect ton 1773 of the Labor Code of the State of Californta, the City of Palo Alto has obtained from the D1rector of the Department of Industrh 1 Relations the genera 1 preva111 ng rate of per d1em wages and the general prevailing rate for holidays and overtime work for each craft, class1ftcat1on, or type of workman required to execute the contract. A copy of said prevail 1 nq rate of per d t e111 wages 1s on f 11 e 1 n the prt nc 1pa1 off1ce of the C1ty of Palo Alto, to wh1ch reference ts hereby made for further particulars. Sa1d preva11tng rate of per dtem wages will be made ava11ab1e to any Interested party upon request, and a copy thereof shall be posted a.t the job s1te. SECTION 6. That 1n the event the contractor. contract1ng owners 1ncluded, does not complete the work. w1th1n the t1me l1111t spectf1ed 1n the proposed contract or w1th1n such further t1me as thts Council shall have authorized, the contractor or contracting owners. as the case may be, shall pay to this C1ty 11qu1dated damages 1n the amount of One Hundred Dollars <$100.00> per calendar dl..~· for each and every day's delay fo ftnhh1ng the work beyond the completion date specifted in said contract. Addittonal provhtons wtth regard to said time of canplet1on and 11qu1dated damages are set forth tn the spectftcat1ons, whtch prov1s1ons are hereby referred to and tncorporated herein by reference. 2 SECTION 7. Said sealed proposals or bids shall be de11vered to the D1rector of Purchasing Services of th's C1ty on or before 3:00 0 1 clock. p.m. on September 14 • 1983, satd time being not less than ten <10> days from the time of the f1rst pub11cat1on of satd notice.
