County of Santa Clara, Ca11forn1a. does RESOLVE that SECTION 1. On May 16. 1983, th1s COunc11 adopted Resolution No. 6118, a Resolution of of Intention to Acqu1re and Construct Improvements, 1n wh1ch said acqu1sittons and tmprovements were referred to the C1ty Eng1neer for the purpose of mak1ng and f1 Hng a report tn wr1t1ng under and pursuant to the Muntc1pa1 Improvement Act of 1913 as supplemented by the Palo Alto Municipal Code <hereinafter the "Act">; and SECTION 2. Sa,d report has been ma.de and filed and duly conddered by this Council: SECTION 3. Said report as a whole and each part thereof. to w1t: <a> the plans and spec1flcat1ons for the proposed 1mprovements; Cb) the maps and descr1ptions of the h.nds and easements to be acquired, if any; <c> the eng1neer•s esthtate of the itemized and total costs and expenses of satd acqu1sit1ons and improvements. and of the Incidental expenses tn connect1on therew1th; <d> the dtagram show1ng the assessment d,strtct and the boundaries and d1mens1ons of the respect1ve subd1v1s1ons of land w1th1n sa1d dtstrt ct; and <e> thS? assessment of the tota 1 amount of the costs and expenses of the proposed acquis1t1ons an1 improvements upon the several subdivh1ons of la.nd tn said district 1n proport1on to the estimated benefits to be received by said subdivhtons. respecttvely, from satd acQu1s1t1ons and improvements, and of the vApenses 1nc1denta1 thereto; are suff1c1ent and are prel1m1nar11y approved. SECTION 4. Sa1d report shall stand as the Engineer's Report for the purpose of all subsequent proceedings here1n. SECTION 5, Monday. the 15th day of August. 1983. at the hour of 7: 30 0 1 clock. p.m •• 1n the regular meetfng place of this Council, Palo Alto Civtc Center. 250 Hasn11ton Avenue, Palo Alto, cal1forn1a, be, and the same are hereby appointed and fixed as the time and place when and where this Council w111 cons1der and finally determine whether the pub1'c interest, coven1ence and necess1ty require sa1d acqu1s1t1ons and improvements, and when and where 1t w111 consider and finally act upon said Engineer's Report. SECTION 6. The Ct ty Cl erk. sha 11 cause not1 ce of sat d head ng to be given by pub11cat1on once a week for two weeks ln the Peninsula Ttmes Trlbune, a newspaper published and ,,rculated in the Clty of Palo Alto. and by conspicuous post1ng along all the open streets w1th1n sa1d assessment district at not more than three hundred feet apart, and not less than three 1. n a 11 • The ftrst pub11cat1on of sa1d nottce shall be made .:md sa,d posting shall be completed at least ten days before the date heretn set for sa1d hearing. Sa1d not1ces shall be headed "Not1ce of Improvement" <1n letters of not less than 2 . . one 1nch 1n he1ght on the posted notice> and shall. tn leg1ble characters, state and contatn: the fact and date of the passage of sa1d Resolut1on of Intent,on, the f11tng of satd report, the date, hour and place set for and the purpose of the hearing on said resolution and report and of protests; the total est1mated cost, and a brief description of the proposed acqu1sittons and improvements; that any person interested may f11e a protest 1n writing as providet.I 1n the Act; and reference to sa1d resolution and report for further parttculars. ?ECTION 7. Said Clerk. shall also cause notice of sa.1d hearing to be mailed, postage prepa1d. at least ten days before the date herein sc?t for sa1d hearing. to all persons owning reai property to b~ assessed whose names and addresses appear on the last equal tzed assessment rol 1 for general taxes or a.re known to sa.1d Clerk. Said notices shall contain. 1n addttto.i to the matters provided above for the not1ce to be publtshed and posted, the amount, as shovn by said report, to be assessed a.ga,nst the particular parcel covered by each such not1ce, respectively. Sa1d not,ces shal 1 be mailed to such owners at their addresses as same appear on said assessment roll, or as known to said Clerk. or to both tf not the same. SECTION 8. The proposed boundartes of sa td assessment district are hereby described as sh~n on a map thereof f11ed in the office of said Clerk, ~htch indicates by a boundary l1ne the extent of the territory included 1n the proposed assessment d1str1ct and wh1ch shall govern for all details as to the extent of such d1str1ct, reference to such map being hereby made for parttculars. Sa1d map contatns the name of satd C1ty and a d1st1nctive designat1on 1n words or by nuRtbtr of the d1str1ct shown thereon. 3 ' . SECTION 9. Sa1d Clerk shall endorse certificates on the original and at least one copy of safd map evfdenc1ng the aforesafd filing and the date and adoptton of th1s resolut1on, and w1th1n 10 days after adoption of this resolution, and 1n no event later than 10 days prior to sa1d hearing. shall f11e a copy thereof with the C~unty Recorder of the County of Santa Clara. in which County all of such proposed assessment d1str1ct ts located. The County Recorder shall endorse on sa1d copy of satd map the t1me and date of f111ng and shall fasten the same securely in a book of maps of assessment d1str1cts wh1ch he shall Keep in hts off1ce. and fndex such map by the name of said C1ty and by the d1st1nct1ve designation of the district as shovn on such map.
