RESOLUTION OF TSE COUNCIL OF THE CITY Of PALO ALTO
OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT
BETWEEN TBE BOARD OF ADMINISTRATION OP THE PUBLIC
EMPLOYEES' RETIREMENT SYSTEM AND THE CITY OF PALO
ALTO
WHEREAS, the Public Employees' Retirement Law permits the partici-
pation of public agencies and their employees in the Public Employees'
Retirement System by the execution of a contract, and sets forth the
procedure by which said public agencies may elect to subject themselves
and their employees to amendments to said Law; and
WHEREAS, one of the steps in the procedure to amend this contract
is the adoption by the legislative body of the public agency of a
resolution giving notice of its intention to approve an amendment to
said contract, which resolution shall contain a summary of the change
proposed in said contract: and
WHEREAS, the following is a statement of the proposed change:

NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVB
as follows:
SRCTION 1. The City Council of the City of Palo Alto hereby gives
notice of its "intention to approve an amendment to the contract between
the City of Palo Alto and the Board of Administration of the Public
Employees' Retirement System.
SECTION 2. The proposed amendment to the contract is set forth in
Exhibit 1A1 attached hereto and by this reference made a part hereof.
SECTION 3. The Council finds that this is not a project under the
California Environmental Quality Act and, therefore, no environmental
impact assessaent is necessary.

The Board of Administration, Public .Employees' 1ietire~ent System, herein-
after referred to as Board, and the governing body of a~ove public agency,
hereinafter referred to as Publie Agency, having ente.red into a contract ~ffec
tive January 1, 1942, ·and witnessed Karch 9, 1942, and ae ame-o.d-ed effective
January 1, 1948, April 1, 1949, Januarr 1, 1952, July 1, 19-54, February 1,
1956, November 1 • 1964, Septem..ber 23, 1968, December ~ 4, 1970, February 1 ,
1974, July 8, 1974, January 5, 1975, April 1, 1975, September 11, 1977, July 1,
19~9, February 21, 1981, July 11, 1981, December 12, 1981, and June 12, 1982,
which provides for participation of Public Agency in said System, Board and
Public Agenc1 hereby a~rree as· follows:
A. Paragraphs 1 through 10 are hereby stricken from said contract as executed
effective June 12~ 1982, and hereby replaced by the following paragraphs
numbered 1 through 11 inclusive:
1. All words and terms used herein which arP. defined in the Public Employ-
ees' Retirem9nt Lav shall have the meaning as defined therein unless
otherwise specificall1 provided. "Norm~l retirement age" shall mean
age 60 for local miscellaneous and age 50 for local safety members.
2. Public Agency shall participate in the Public Employees' Retirement
System from and after January 1, 1942 making its employees as herein-
after provided, members of said System subject to all provisions of
the Public Eaployees' Retirement Lav except such as apply onl1 on
election of a contra.ctin,g agency a.nd are not provided for herein and
to all amenaments to said Lav here9fter ~nacted except such as by
exp:3ss provisions thereof apply only on the election of contracting
agencies.
3. Employaes of Public Agency in the following classes shall become mem-
bers of said Retirement Systam except such in each such class as are
excluded by law or this ag~eement:
e. Local Firemen (herein referred to as local safety members);

!. :n addition to the ¢lasses of employees e~cluded f~om memb~rship by
said Retirement Lav, the following classes of employees shall not
become members of said Retirement System:
a. PERSONS COMPENSATED ON AN HOURLY BASIS HIRED ON OR AFTE?.

5. The fraction of final compensation to be provided for each year of
credited prior and current ·service as a local miscellaneous memhP.r
shall be determined in acco~dance with Section 21251 .13 of said
Retirement Law (2% at age 60 Pull).
S. The fraction of final compensation to be pr?vided for each year of
credited prior and current service as a local safety me~ber shall be
detel"llined in accordance with Section 21252.01 of said Retirement Law
(X at a~ 50 Pull).
7. The following additional provisions of the Public Employees• Retire-
ment Lav Yhich appl7 onl1 upon election of a contracting agency shall
apply to the Public Agency and its employees:
a. Sections 21380-21387 (1959 Survivors Progra.11) excluding Section
21382.2 (Increased 1959 Survivors benefits).
b. Section 21222.1 (Special 5% increase -1970).
c. Section 21222.2 (Special 5% increase -1971).
d. Sewtion 21222.6 (Special 15%' increase for local miscellaneous
members as defined pursu~nt to Government Code Section. 21222.6) •

e. Section 21222.AS (Special 3%-15( increase to pre-1-1-74 retirees).
f. Section 20024.2 (One-year final compensation).
g. Section 21222.4 (Special 15% increase for local safety members).
S. Public Agency, in accordance vith Section 20740, Government Code, ceas-
ed to be an "employer" for purposes of Chapter 6 of the Public Eapioy-
ees' Retirement Lav effective on September 1', 1977. Accumulated con-
tributions of Public Agency as of the aforementioned date shall be
fixed and determined as provided in Section 20/59, Govel'?lllent Code, and
accumulated contributions as of the aforementioned date and contribu-
tions thereafter aade shall be held by the Board ae provided in Section 20~S9, Government Code •

9. Pub:ic Agency shall contribut~ to s~id Retirement System as follows:
a. ~i~h respect to misc~ll~neous members, th@ agency shall coutrl-
bute the following perc!C!ntages of mcuthly salaries e.:arr.td as mi.:i-
cellaneous memb~rs of said Retirement System:
( 1) . 0.183 percent until June 30, 2000 on account of the
liability for prior service benefits.
(2) 14.433 percent until June 3(, 2000 on ·account of the
liability for current ser~ice beriefita.
b. With respect to local safety members, the ~sency shall contribute
the folloving percenta£es of monthly salaries earned as local
safety members of said Retirement Syatem:
(1) 0.034 percent until June 30, 2000 on account of the
liability for prior service benefits.
(2_) 29.878 percent until June 30, 2000 on account of the
liabilit1 for current se~vice benefits.
c. A reasonable a.mount, as fixed by the Board, payable in one instal-
laent within 60 da,s of date of contract to cover the costs of ad-
ministering said System as it affects the employees of Public Ag-
ency, not including the costs of special valuations or of the per-
iodic investigation and valuations required by law.
d. A reasonable amount as fixed.by the Board, payable in one instal-
lment as the occasions arise, to cover the costs Qf apecial valua-
tions on account or eaployses of Public Agency, and' costs of the
periodic investigation and valuations required by law.
10. Contributions requi~ed of Public A&enc7 and its eaployees shall be sub-
ject to adjust~ent by Board on account of ameridaents to the Publi~ Em-
ployees' Retirement Law, and on account of the e%perience under the Re-
tirement S;rstea as determined by the periodic investigation and valua-
tion required bY said Retireme~t Law.
11. Contributions required of Public Agency and its employees shall be
paid by Public Agency to the Retirement System within thirt1 days af-
ter tbe end of the period to which said contrihutiorU! refer or as may
be prescribed by Board regulatic~. If mor~ or less than the correct
aa~unt of contributions is p~id for any period, proper adjustaent
&ball be made in connection with subsequent remittances, or adjust-

Board. Payments by Public Agency to Board may be made in tht: form of
warrants. bsnk checks, b~nk drafts, certifi~d checke, money o~d~rs or
cash;
B. This amendment shall be attacr.ed to said cont~~ct and shall be effective on
the day of , 19_.
