HomeMy WebLinkAboutRESO 6146• OR!GINAL RESOLUTION NO. 6146 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ESTABLISHING DISCLOSURE AND OTHER CONDUCT REQUIREMENTS ON CITY OFFICIALS AND EMPLOYEES DURING THE CABLE TELEVISION PROCESS WHEREAS, the City is now engaged in the process leading to the development of a cable television system in the City; and WHEREAS, the City Council believes that this process must be conducted in an open and public manner whi~h will be fair to all participants and which will maintain public confidence and trust, and that the conduct ot City officials and employees dur- ing the process must conform to the highest ethical standards; and WHEREAS, the City Council intends to ensure the vigorous enforcement of all existing code of conduct requirements as they may apply to this process, including those set forth in Chapter 2. 09 of the Administrative Code and Resolutions 57 37 and 6101 (Conflict of Interest Code for Designated Positions) of the Council; and WHEREAS, in furtherance of its objective to ensure that the process is fair to all participants and is conducted in a manner which maintains public confidence and trust, the City Council recently adopted Ordinance No. 3380 governing the activities of lobbyists on behalf of persons financially interested in cable television in the City1 and WHEREAS, the City Council believes it is in the public interest to establish additional disclosure and other conduct requirements on City officials and employees during the cable television process; NOW THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Cable Coordinator and any City public official or designated employee governed by the Political Reform Act and required to disclose categories 3, 4, 5 or 6 (specified investments or sources of income) under City of Palo Alto Reso- lution 6101 or who has or hereafter acquires any ownership or other financial interest in any person financially interested in cable television in the City shall promptly disclose said fact in a written statement filed with the City Clerk and shall thereafter be disqualified from making er participating in the making of any decision, and from taking any official action with respect to any decision, in the course of the City's cable tele- vision process which will foreseeably have a material financial effect on any financial interest of that official or employee. Where appropriate, words used in this resolution shall have the same meaning as words defined by Govenment Code Sections 81000 et seq. SECTION 2. The City Manager and the Cable Coordinator, representing the policy of the City Council, are hereby de~:g­ nated as the individuals to whom all contacts by lobbyists and other persons acting on behalf of persons financially interested in cable television in the City should be directed during the cable television process. SECTION 3. All City officials and employees other than those designated in the foregoing Section 2 should seek to avoid substantive discussions regarding the cable televi-sion process with, and the receipt of materials fromt any lobbyist or other person financially interested in cable television in the City, except in connection with an open, public forum conducted during the cable television process. Minutes shall be kept at all such forums. SECTION 4. All City officials and employees, including the individuafS designated in the foregoing Section 2, shall prepare a written memorandum summarizing the general substantive nature of each discussion with any lobbyist or other person acting on behalf of any person financially interested in cable television in the City, except those which occur at open, public forums. A copy of each such memorandum, together with any materials received by any City official or employee, shall be submitted to the City Clerk. SECTION 5. The City Clerk shall maintain a file contaning copies of: 1. All reports submitted by lobbyists pursuant to Ordinance No. 3380; 2. all disclosure statements submitted pursuant to f oregoin9 Section l; 3. the minutes of all open, public forums~ 4. all contact memoranda submitted pursuant foregoing Section 4; and the to 5. all materials received during the cable television process from any lobbyist or other person accing on behalf of an~ person financially interested in cable television in the City. the Said file shall be available for public inspection during nor~al business hours. SECTION 6. The Appointing Authority shall have the right to enforce this Resolution through disciplinary or other ac- tions. -2- • ' • SECTION 7.
