RESOLUTION OP THE COUNCIL O~ THE CITY OF PALO ALTO
CONSENTING TO THE RESCISSION OF A DECLARATION OF
EASEMENT AT 4250 El CAMINO REAL
WHEREAS, a declaration establ ishinq a com.<non ingress and egress
and an easoem~nt for parking on property commonly known as 4250 El
Camino Real lQthe Declaration•) was recorded in the Santa Clara County
Records at Book 8946 Page 84: and
WHEREAS, the Declaration was recorded at the request of the City
of Palo Alto to ensure <X>mpliance with the parking regulations in the
Palo Alto ·' micipal Code; and
WHEREAS, the Declaration specifically requires that its provisions
may be rescinded by the owners of more than one-half of the total area
commonly known as 4250 El Camino Real and 4240 El Camino Real ("the
Property•) so long as the City of Palo Alto consents to such a rescis-
sion by resolution of the City Council; and
WHEREAS, the Property has been sold to a new owner and a final
subdivision map has been approved by the City of Palo Alto and re-
corded; and
WHEREAS, the new owner of the Property wishes to reE:cind the
Oeclaration in order to construct the project approved in the final
subdivision map and seeks the consent of the City rouncfl to that
rescission1
NOW, TREREFORB, the Council of the City of Palo Alto RESOLVES as
follows:
SECTION i. The Council of the Cit.y of Palo Alto consents to the
rescissio.-. of the Declaration attached hereto as Exhibit •A• and incor-
porated herein by reference and authorizes this resolution to be
recorded with the Off ice of ~he County Recorder of Santa Clara County
toqether with the Declaration of Rescission executed by the new owner
of the PropEcty, att~ched hereto as Exhibit •a• and incorporated herein
by ref-erenc~.
SECTION 2. The Council finds that this resolution is exempt from
the California Environmental Quality Act under the general rule
contained in Section 15060 of the St?.te EIR Guidelines.

DECLARATION OF ESTABLISHMENT OF
RCSTRICTIONS ANO COVENANTS
AFFE~TING CERT/,IN REAL PROPERTY IN
THE IITY OF PALO ALTO AS REQUIRED
FOR or·F'STREET PARKING BY
THE PALO ALTO ZONING ORDINANCE
The undersigned FIRST NATIONWIDE SAVINGS, A FEDERAT,
SAVINGS AND LOAN ASSOCIATION formerly Citizens Savings and
Loan Association, is the owner of the real property in the
Clty of Palo Alto, County of Santa Clara, State of California,
more particularly described as follows:
Parcel A -Beginning at the ~ost southerly corner
of that cextain Parcel One shown upon that certain
Record of Survey recorded August 14, 1957, in Book 82
of Maps at Page 38, Santa Clara County Records: thence
along the westerly line of said Parcel One North
33° 02t 53" West, 107.77 feet; thence South 56°56'30"
West, 23.71 feet; thence North 33°05'17~ West, 126.77
feet; thence North 55° 09' 30" East 358.68 feet to a
point on the sothwesterly line of El Camino Real distant
60 feet from the centerline of said street; thence along
said southwesterly line South 32° 34' 56" east, 79.35
feet; thence South 55° 09' 30" West, 212.28 feet; thence
South 34° 50' 30" Ea~t, 155.88 feet; thence 55° 09' 30"
West, 126.83 feet to the point of Beginning.
Parcel B -Beginning at a point on the southwesterly
line of El Camino Real, said point being the southerly
terminus of that certain course described as Scuth
32° 34' 56H East, 79.35 feet, in description of Parcel
A above; thence along the extension southerly of said
course, South 32° 34' 56 11 East, 36.00 feet; thence
South 55° 09' 30 11 West, 210.86 feet; thence 'North
34° 50' 30 11 West, 35.97 feet: thence North 55° 09' 30"
East, 212.28 feet to the point of He9innin9.
ThQ above-described real property is all the property
affected by a Declaration Of Establishment Of Restrictions And
Covenants Affecting certain Real Property ln The City Of
Palo Alto As Required For Offstreet Parking By The Palo'Alto
Zoning Ordinance, dated June 2, 1970 and recorded on June 8,
1970 in Liber 8946 at Page 84 of Official Records of Santa Clara
C'r,unty, California (herei naft.er referred to as the "Reo!>t rietion*).

By the terms of paragraph 3 of the Restriction, it can
be rescinded by owners of more than one-half of the total
area, by decl\ration in writing signer1 and acknowledged by
said owners, together with the consent of the City of
Palo Alto evidenced by a certified copy of a resolution of

the City Council of said City of Palo Alto giving cons~nt to
such rescission which shsll be attached to said declaration
and duly recorded therewith in the Office of the County
Recorder of Santa Clara County, State of California.
FIRST NATIONWIDE SAVINGS, A FEDERAL SAVINGS .~ND LOAN
ASSOCIATIO~ hereby rescinds the Restriction, subject to
obtaining the resolution of cor.sent from the City Councii
of Palo Alto, a certified copy of which is to be attached
to this declaration and recorded herewith.
