HomeMy WebLinkAboutRESO 6096ORIGINAL RESOLUTION NO. 6096 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING UTILITY RATE SCHBDULES G-1 AND G-50 AS A RESULT OF TRACKING PG&E GAS RATE CHANGES WHEREAS, the City Council has previously adopted Resolution No. 6082, which authorizes the City Manager to implement nondis- cretionary adjustments to Palo Alto gas rates to reflect wholesale gas rate increases and to track Pacific Gas and Electric {PG&E} reta:l rate schedules G-1, G-2, and G-501 and WHEREAS, on January 7, 1963, PG&E filed Advice No. 1214-G with the California Public Utilities Commission (PUC) requesting a decrease in its ;etail rate schedules1 and WHEREAS, the PUC has approved this rate decrease for PG&E's retai 1 customers and authorized .t>G&E to enact a rate change in accordance with its Advice No. 1214-G to become effective Febru- ary 6, 1983: and WHEREAS, on February 6, 1983, the City Manager adjusted· Palo Al to' s retail rates to match this rate change, and in accor- dance with Resolution No. 6082 is required to notify this Council of his ministerial action: NOW, THEREFORE, the Council of the City of Palo Al to does RESOLVE as follows: SECTION 1. This Council finds that the action taken by the City Manager is in accordance with the provisions of Resolution No. 6082: that the Palo Alto Gas Rate Schedules G-1 and G-50 shall substantially conform with those rates contained in PG&E General Service Rate Schedules G-1, G-2, and G~SO: that the effec- tive date is February 6, 1983; and that in all respects such non- discretionary adjustments are approved. SECTION 2. This Council finds that the reve~ue derived from the authorized adjustments of said gas rates by the City Manager shall be used only for the purposes set forth in the Palo -'l to City Charter, Article VII, Section 2, entitled •Public Utilities Revenue.w The adoption of this resolution is, therefore, specifi- cially exempted under Publi~ Resourc~s Code Section 21080(b)(8) from the requirements of CEQA. SECTION 3. Pursuant to Section 12.20.010 of the Palo Alto Municipal Code,-Schedules G-1 and G-50 of the Palo Alto Utilities Rates and Charges are amended to read as shown on "Sheets No. 116e and 19• attached hereto and incorporated h-erein. RATES: Comnodity Charge: For all gas deliveries. per therm Minimum Charge: Per Meter Per Month 56.429¢ This charge is for the first 5000 thenns per meter per month. SPECIAL CONDITIONS: l. Service under this schedule is subject to discontinuance in whole or in pa.rt in case of actual or anticipated shortage of rtatural gas resulting from an insufficient supply, inadequate transmission or deliv2ry capacity of facilities, or shortage requirements. However. the City will attempt to minimize disruption by providing adequate n~tice prior to curta;l- mer.t. The City Will not be liable for damages occasioned by interruption or discontinuande of service supplied under this schedule. 2. No customer shall be entitled to service hereunder unless adequate stand-by equipment and fuel are provided and are ready at all t1ines for il'llltediate operatfon in the event that the supply of gas hereunder sh~11 be discontinued in whole or in part.
