RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
PROVIDING AUTHORITY TO THE CITY MANAGER TO EFFECT
CERTAIN CH~NGES IN GAS UTILITY RATES {SCHEDULES G-1
AND G-50) Ai-iENDING RESOLUTION NO. 5863
WHEREAS, the California Public Utilities Conunission periodically
hears and grants gas rate increases to Pacific Gas & Electric Company
(PG&E); and
WHEREAS, said PG~E rate increases are based upon fluctuations in
costs to PG&E from certain gas producing companies, tax law changes,
exchange cate changes, increased operating expenses, rate of return
adjustments, and similar items reflecting the financial condition of
PG&E; and
WHEREAS, it is desirable for the City of Palo Alto to adjust its
gas rates promp~ly upon commencement of an increase from PG&E in order
to avoid loss of revenue.
NOW, THEREFO,~E, the Council of the City of Palo Alto does RESOLVE
as follows:
SECTION 1. Effective January 1, 1982, the City Manager is hereby
authorized to adjust the gas rates of the City of Palo Alto contained
in Schedule G-1 and G-50 of the City of Palo Alto Utilities Rates and
Charges to ref le ct wholesale gas rate increases and to track PG&E' s
retail rate schedules G-1, G-2, and G-50: the action of the City
Manager shall be nondiscretionary. This resolution expires December
31 , 1 98 2.
The ?alo Alto Gas Rate Schedules G-1 and G-50 shall substantially
conform with those rates contained on PG&E General Service Rate G-1,
G-2, and G-50 applicable to the East Bay, Peninsula-San Jose and Sacra-
mento geographical area. The effective date of said adjustments to
Schedules G-1 and G-50 shall be the same date on which the rate in-
creases from Pacific Gas & Electric Company become effective.
SECTION 2. The City Manager shall report any change in gas rates
authorized by this resolution to the City Council as soon as practi-
cable. If the City Council approves such changes, it shall do so by
resolution.
SECTION 3. The Council of the City of Palo Alto finds that the
revenue derived from the authorized adjustment of said gas rates by the
City Manager shall be used only for the purposes set out in the Palo
Alto City Charterr Article VII, Section 2, entitled "Public Utilities
Revenue.• Therefore, the adoption of this resolution and the future
adjustments of said gas rates by the City Manager as authorized herein
are specifically exempted from the requirements of CEQA under Public
Resources Code Section 21080(b)(8).
