WHEREAS, it •~ t~e intentinn of the Council of the City of Palo Alto to
vacate the sanitary sewer ea')E'rnent recor·ded tn Book 0865 O.R. at Page 370 and
Hook f 161 0.2. at Pa9e 622 in the City of Palo Alto, County of Santa Clara,
State of California as described in Exhibit "A" attt:ched hereto and as shown on
a ma~ marked Exhibit 11 B'' attached hereto and by reference made a part hereof;
and
WHEREAS, said easement has been relocated and, therefore, is no longer
requtred by C1ty •Jse; and
WHEREAS, on October 13, 1981 the Council of the City of Palo Alto passed a
resolution setting forth the time and place for a public hearing for all persons
interested in the proposed vacation; and
WHEREAS, from all the evidence submitted to the Council of the City of Palo
Alto at said hearing it is found that said ease~ents as described herein are
unnecessary for present or prospective public utility purposes.
NOW, THEREFORE, the Counc11 of the City of Palo Alto does RESOLVE as
follows:
SECTION 1. The Council of the City of Pa1o Alto does hereby order that
said easement as described herein be and hereby is vacated; and makes the
following findings in support of this order: a) Relocation of the existing
sanitary sewer was nee es sary to a 11 ow deve 1 opinent over the easement and
facilitate maintenance of the sewer lines; bt A satisfactory replacement
easement was found, accepted by and granted to the City, and is presently in
use; c) The easement to be vacated has been rendered inoperable because the
replacement easement now satisfies all sanitary sewer needs for the property; d)
The City has no present or future need for the herein described sanitary sewer
easement.
SECTION 2. The Council finds that thi~ is not a project under the
California Environmental Quality Act and, therefore, no environmental impact
assessment is necessary.
SECTION 3. The City Clerk shall cause a certified copy of its resolution
to be recorded in the office of the County Recorder of Santa Clara County.
