RESOLUTION OF THE CITY OF PALO ALTO
SUPPORTING SENATE BILL 1234 WHICH
WOULD PROHIBIT THE AERIAL SPRAYING
OF MALATHION
ORIGINAL
WHEREAS, this Council has considered the effects of the
aerial spraying of the chetnical malathion and has received
much testimony from representatives of the United States
Department of Agriculture, the California Department of Food
and Agriculture, the agricultural community, the scientific
community, and the general citizenry; and
WHEREAS, this Council concluded that it did not want
the aerial spraying of malathion ove. the City of Palo Alto
because, among other things, the effect of the chemical upon
human beings was uncertain but possibly adverse;
NOW, THEREFORE, the Council of the City of Palo Alto
does RESOLVE as follows:
SECTION 1. The Council of the City of Palo Alto sup-
ports Senate Bill 1234 which will prohibit the aerial spraying
of malathion and encourages its enactment.
SECTION 2. The City Clerk is directed to mail a copy
of this resolution to all local legislators, including both
State and Federal representatives, and to all jurisdictions
within Santa Clara County.

An act to add Article 5 (commencing with Section 14099)
to Chapter 3 of Division 7 of the Food and Agricultural Code,
rielating to pesticides, and declaring the urgency thereof, to
take effect immediately.

( 1) Existing law regulates and resbicts the use of specifie4
materials for pest eradication purposes. ~ ·

A require the state to reimburse local agencies and school w districts for certain costs mandated by the state. Other
provisions require the Department of Finance to review

reimbursement,
However, this bill would provide that no appropriation is
made and no reimbursement is required by this act for a
specified reason.
• This bill would take effect immediately as an urgency
statute.

The people of the State of California do enact as follows:
SECTION 1. Article 5 ( commencini Nith Section
14099) is added to Chapter 3 of Division 7 of the Food and
Agricultural Code, to read:
5 Article 5. Malathion
6 14099. As used in this article, .. malathion" includes
1 any preparation of malathion.
8 14099J. The aerial app.iication of malathion by any
9 private party or go\.•ernmental agency of the United
10 States and this state and its subdivisions, officers; agents,
11 or employees, or any public agency, is unlawful.
12 SEC. 2: No appropriation is made and no
13 reimbursement is required by this act pursuant to Section
14 6 of Article XIIl B of the California Constitution or
15 Section 2231 or 2t34 of the Revenue and Taxation Code
16 because the only costs which may be incurred by a local
17 agency or school district will be incurrfd. because this act ..
18 creates a new cri.'"ne or infraction, changes the definition W
19 of a crime or infraction, changes the penalty for a crime
20 or infraction, or eliminates a crime or infraction.
21 SEC. 3. This act is an urgency statute necessary for
• the immediate preservation of the public peace, health. e
23 or safety within the meaning of Article IV of the
M Constitution and shall go into immediate effect. The facts
25 constituting such necessity are:
26 The aerial spraying of malathion constitutes an
Z1 immediate and extremely grave health hazard to the
28 people of California. It is therefore necessary that this bill
29 take immediate effect.
