HomeMy WebLinkAboutRESO 5904' ' • ORIGINAL RESOLUTION NO. ~.5..9..0!_- RESOLUTION OF THE COUNCIL OF T~Y OF PALO ALTO ADOPTING PROCEDURES FOR IMPLEMENTATION OF THE CALIFORNIA ENVIRONMENTAL QU~LITY ACT OF 1970 WHEREAS, Section 21082 of the Public Resources Code of the Ltate of California requires, among other things, that all public agencies shall adopt by ordinance, r~solution, rule, or regulation, objec- tives, criteria, and procedures for the evaluation of projects and the preparation of environmental impact reports and negative declara- tions pursuant to Division 13 (Environmental Quality) of the Public Resources Code: and WHEREAS, Section 21082 further provides that the objectives, criteria, and procedures shall be consistent with the provisions of s&id Division 1J and with the guidelines adopted by the Secretary of the Resources Agency pursuant to Section 2~083 of the Public Re- sources Code1 NOW, THEREFORE, the Council ot the City Of Palo Alto hereby RESOLVES as follows: SECTION 1. The Council hereby adopts the document attached hereto, entitled "PROCEDURES FOR IMPLEMENTATION OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT OF 197on, as amended May 10, 1980, as its objectives, criteria, and procedures for the evaluation of the pro- )ects and the preparation of environmental documents. SECTION 2. The Council finds that this is not a project and, therefore, no environmental impact assessment is necessary. (2) Article XIIl B of the California . ~tution and Sections 2231 and 2234 of the Revenue and Taxation Code A require the state to reimburse local agencies an school w disbicts for certain costs mandated by the state. Other provisions require the Department of Finance to review statutes disclaiming these costs and provide, iJJ. certain C8!leS, for making claims to the State Board of Control for reimbursement. However, this bill would provide that no appropriation is made and no reimbursement is required by this act for a specified reason. • This bill would take effect immediately as an urgency statute. Malathion 14099. As used in this article, "malathion'' includes any preparation of malathion. 14099.l. The aerial application of malathion by any private party or governmental agency of the United States and this state and its subdivisions, officers, agents, or employees, or any public agency, is unlawful. SEC. 2; No appropriation is made and no reimbursement is required by this act pursuant t"l Section 6 of Article XIII B of the California Constitution or Section 2231 or W4 of the Revenue and Taxation Code because the only costs which may be incurred by a local agency or school district will be incurrtd because this act A creates a new cria'D.e or infraction, changes the definition W of a crime or infraction, changes the penalty for a crime or infraction, or eliminates a crime or infraction. SEC. 3. This act is an urgency statute necessary for A the immediate preservation of the public peace, health, .., or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting such necessity are: 1be aerial spraying of malathion constitutes an immediate and ememely grave health hazard to the people of California.
