HomeMy WebLinkAboutRESO 5892• ORIGINAL RESOLUTION NO. 5892 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AUTHORIZING AN APPLICATION FOR GRANT FUNDS FROM THE STATE COASTAL CONSERVANCY FOR PURPOSES OF BIKE PATHS IN THE BAYLANDS AREA WHEREAS, this Council has considered and approved bike path routes in the Baylands area and now wishes to authorize City staff to apply for a grant from the State Coastal Conservancy for construction of bike paths in the Baylands~ NOW, THEREFORE, the Council of the City of Palo Al to does ORDAIN as follows: SECTION 1. The City council authorizes City staff to apply for grant funds from the State Coastal Conservancy for purposes of construction of bike paths in the Baylands area. SECTION 2. City Manager or his designee is designated as the official representative of the City of Palo Alto and is authorized to complete such docwnents as are necessary for an application to the State Coastalal Conservancy. SECTION 3. The City Council has considered and approved those assurances set forth set in Exhibit "A• attached hereto and incorporated herein by reference. SECTION 4. The Council of the City of Palo Alto finds that this is not a project and, therefore, no environmental impact assessment is necessary. LIST OF ASSURANCES The .ipplicant hereby assures and certifies that it will comply with Conservancy regulations, policies, guidelines and requirements as they relate to the acceptance and use of Conservancy funds for this project. Also, the applicant gives assurances and certifies with respect to the qrant that: 1. It possesses legal authority to apply for the grant, and to finance and construct the proposed facilities; that, where appro- priate, a resolution, motion or similar action has been duly adopted or passed as an official act of the applicant's governing body, authorizing the filing of the application, including all understandings and assurances contained therein, and directing and authorizing tl1e person identified as the official representa- tive of the applicant to act in connection with the application and to provide such additional information as may be required. 2 ~ It will have sufficient funds available to meet its own share of the cost for projects. Sufficient funds will be available when the project is completed to assure the effect.i ve operation and maintenance of the facility for the purposes constructed. 3. It will give the Conservancy, through any authorized representa- tive, access to and the right to examine all records, books, papers, or doclli~ents related to the grant. 4. It will cause work on the project to be commenced within a reasonable time after receipt of notification from the Conser- vancy that funds have been approved and that the project will be prosecuted to completion with reasonable diligence. 5. It will not dispose of or encumber its title or other interests in the site and facilities except as permitted by the Conser- vancy. 6. It will, where appropriate, comply with the requirements of the State's Braithwaite Act (Chapter 1574, Statutes of 1971 and related statutes), which provides for fair and equitable treat- ment of displaced persons. 7. It will where appropriate, comply with the requirements of the California Environmental Quality Act4 8. It will comply with all requirements imposed by the Conservancy concerning special provisions of law, and program requirements. EXHIBIT "A" ORIGINAL RESOLUTION NO. 5903 ------ RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AUTHORIZING THE ERECTION OF A BARRIER AND TEMPORARY CLOSING OF THE ALEXIS DRIVE CUL-DE-SAC (MULLEN PROPERTY) WHEREAS, there are presently no houses located on the Alexis Drive cul-de-sac; and WHEREAS, motorcycles and four-wheel drive vehicles are now using the cul-de··sac for access on to City of Palo Alto owne<l land as well as private lands creating fire hazards, erosion and litter problems; and WHEREAS, the landowners in this area who will be affected by the erection of a barrier are in agreement with the proposed bar- rier; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. A barrier consisting of two locked fourteen ( 14) foot gates shall be erected by the City Manager or his designee as shown on Exhibit "A" attached hereto and incorporated herein by reference. The barrier shall be removed when the Alexis Drive cul-de-sac is inhabited by residents living in single family structures. SECTION 2. The Council finds that the adoption of this reso- lution-WI11 have no significant adverse environmental impact.
