HomeMy WebLinkAboutRESO 5875, • ORIGINAL RESOLUTION NO.. 5875 RESOLUTION OP THE COUNCIL OF THE C!!Y OF PALO ALTO RBQUBSTING THAT THE NORTH COUNTY COMMUNITY LEGAL SBRVICES OPPICB MOT BE TERMINATED AND BE CONTINUED AT CURRENT LEVEL WHEREAS, the Community Legal Services Boar.d for Santa Clara County is considering the future of the Community Legal Services off ice whi.ch is now serving the northern portion of Santa Clara County and that office ia located at 405 Sherman Avenue, Palo Alto, CaliforniaJ and WHEREAS, there is a definite need for an office located in the northern portion of Santa Clara County because of the large number of people served by that office. There are 3,338 households with income below $4,000 in Palo Alto, Mountain View, and Los Altos alone which are serviced by this office and which constitute approximately 13.9\ of the total households in Santa Cl~ra County with that income. The statis- tics are set forth in more detail in the graph attached as Exhibit •A• to this resolution. In addition to these households, the off ice serves the patients at the Veteran's Administration, of which there are 3,000 to 4,000 patients, many of whom need legal services and most of whom are totally unable to travel to San Jose in the event of the closure of this off ice. (See Exhibit •a• attached hereto) There has been an off ice in the north county since the inception of Community Legal Ser- vices in the county and the office has been located in Palo Alto since 1972. The office is conveniently located within one block ot the northern county courthouse where the Superior Court and the four local Municipal Courts are located as well as other county off ices. The off ice is provided free space and some staff assistants by the local bar association .. HBEREAS, if the Community Legal Services off ice serving northern Santa Clara County is closed, the Council finds that the low income population in this area will be left without legal representation be- cause the difficulties and costs, which by definition these people can- not affort to incur, of traveling to San Jose would be prohibitive and result in the loss of legal representation to the low income people in this portion of the county.. · NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows= SECTION 1, That the Conunanity Legal Services Board not terminate the northern county off ice or in any way curtail the service now being provided by that off ice; and SECTION 2. That the City Clerk is directed to seno a copy of this resolution to the Director and Chairman of the Board of CoD11Runity Legal Services. INTRODUCED AND PASSED= February 9. 1981 AYES: Bechtel. On behalf of the l,000 to 1,100 inpatients and 2,000 to 3,000 active outpatients of this medical center, I wish to voice a strong objection to the proposed action. I am certain that if the North County Office were closed few of our patients would receive legal assistance with their problems. due primarily to the difficulty of arranging transportation to San Jose. Presently, with an office in Palo Alto, only a bus trip is involved to obtain quality legal assistance. and, when a patient is unable to leave t~ie medical center, an attorney from the North County Office comes to the medical center. It is unlikely that our patients could go to San Jose, due to the longer bus ride and the necessity for transfers as well as their health r•rObl ems. The Veterans Administration has no 1ega1 staff at this medical center for au r patients 1 persona 1 1 eg al prob! ems and, therefore, must depend on coumunity resources. Our patier;ts do have nwny frequent legal needs. The closing of the North County Legal Aid Office would be, indeed, a great hardship to our pati~nts, anc would largely preclude them from getting lega1 representation.
