( ,. • • ORIGINAL RESOLOTlON NO. 6082 RESOLUTION OF THE COUNCIL OF T3E CITY OF PALO ALTO PROVIDING AUTHORITY 'IO TBE CITY MANAGER TO EFFECT CERTAIN CHANGES IN GAS D'l'ILITY RATES (SCHEDULES G-1 AND G-50) AMENDING RESOLUTION NO. 5982 WHEREAS, the California Public Utilities Commission periodi- cally hears and grants gas rate increases to Pacific Gas & El~c­ tric Company (PG&E)1 and WREREAS, said PG'E rate increases are based upon fluctuations in costs to PG&E from certain qas producing companies, tax law changes, exchanqe rate changes, increased operating expenses, rate of return adjustments, and similar items reflecting thP financial condition of PG&E: and WHEREAS, it is desirable for the City of Palo Alto to adjust its gas ~ates promptly upon commencement of an increase from PG&E in order to avoid loss of revenue. NOW, TBBREPORE, the Council of the City of Palo Alto does RE- SOLVE as follows: SECTION l. Effective January 1, 1983, the City Manager is hereby authorized to adjust the gas rates of the City of Palo Alto contained in Schedule G-1 and ~~so of the City of Palo Alto Utili- ties Rates and Charges to reflect wholesale gas rate increases and t~ track PG•B's retail rate schedules G-1, G-2, and G-501 the ac- tion of the City Manager shall be nondiscretionary. This resolu- tion expires December 31, 1983. The Palo Alto Gas Rate Schedules G-1 and G-50 shall substan- tially conform with those rates contained on PG&E General Service Ra'te Schedule& G-1, G-2 and G-50 applicable to the Peninsula-San Jose geographical area. The effective date of said adjustments to Schedules G-1 and G-50 shall be the sa11e date on which the rate increases from Pacific Gas & Electric Coapany become effective. SECTION 2. The City Manager shall report any change in gas rates authorized by tl" ia resolution to the City council as soon as practicable. If the City Council approves such changes, it shall do so by resolution. ;. ' ~ •• SECTION 3. The Council ot the City ot Palo Alto finds that the revenue derived from the authorized adjustment of said gas rates by th~ City Manager shall be used only for the purposes set out in the Palo Alto City Charter, Article VII, Seetion 2, en- titled •Public Utilities Revenu~·. Therefore., the adoption of this resolution and the fut'1re adjustments of said gas rates by the City Manager as authorized herein are specific~lly exempted fr01P. the requirements of CEQA under Public Resources Code Section ll080(b)(8).
