RESOLUTION 6059
RESOLUTION OF THE COUNCIL OF THE CITY Of PALO ALTO
EXPRESSING ITS DESIRE TO RETAIN CURRENT METHODS OF TRAFFIC CONTROL,
INCLUDING BARRIERS. ON THE STREETS OF THE CITY OF PALO ALTO
WHEREAS, the California Supreme Court, in the case of ~umford vs. the City of
~erkeley, determined that the City of Berkeley had no authority to re9ulate traffic
with the type of barriers used in that City; and
WHEREAS. the Council reaffirms its support for the traffic barriers which are
presently in the City of ?alo Alto; and
WHEREAS, the C.ity Council has e·-_µressed its support of legislation which provides
for the right of City Councils to establish barriers in their cities; and
WHEREAS, the City Council has expressed its support of the State Department of
Transportation Regulations which would establish guidelines for local jurisdictions to
follow when using traffic divert~rs and barriers.
NOW, THEREFORE, BE IT RESOLVED, that the Council of the City of Palo Alto
reaffirms its policies for controlling traffic within the limits of the City of Palo
Alto, including the use of barriers, and hereby instructs City staff to encourage and
support legislation and regulations which preserve the Council 1s ri9ht to estab1is1
traffic barriers and di verters.
