CHARGES <* SOLAR LOANS The Council of the City of Palo Alto does R!SOLV! as follows: SECTION 1. Utility Rule and Regulation No. 10 is hereby amended to add a Subparagraph 3 to subparagraph (b), as follows: ft(3) Subparagraph& (1) and (2) to the contrary notwith- standing, customer& whose utility bills include payments of principal or interest on loans from the City which are secured by mortgages or deeds of trust on real p.:o,~ perty shall be charged a late payment charge when any current utility bill includes an unpaid installment on such loan from a prior bill, provided that twenty (20) days have elapsed since the date of the last billing. For closing bills. the elapsed time will be thi~ty (30) days. The late charge on such loan payment shall be six p~rcent (6t) of the installment due or Five Dollars t$'5), whichever is greater. No charge will be imposed more than once for the late payment of the same install- ment; provided, however, that the imposition of the late charge on any late payment will not eliminate or super- sede late charges imposed on prior late payments. No late charge will be imposed on any installment which is paid or tendered in full on or before its due date, or within ten (10) days after notice is given that the late charge will be imposed even though an earlier install- ment or installments, or any late charge thereon, may not have b2en paid in full when due. For purposes of determining whether late charges may be imposed, any payment ten·ered by the customer shall be applied by the City to the most ~ec@nt installruent due. Nothing · • this Rule and Regu:i.ation shall be construed to al· .e..: in any way the duty of the customer to pay any installment on a loan from City when due or t:o alt·er the riqhts of the City to enforce the payment of such installments. Nothing in this subparagraph shall alter the payment or collection of late charges assessed in accordance with subpara9raphs (1) and (2) of this Rule and Regulation for utility bills or portions t.~ereof which do not include payments-on loans secured by real property.w SECTIOM 2. ~e City Council further finds that ad~ption this resolution will not have any significant environmental of effect.
