HomeMy WebLinkAboutRESO 6764, ORIGINAL RESOLUTION NO. 6764 RBSOLUTIOW OP TBB COUllCIL OF TBB CT.ft OF PALO ALTO AUTBOJUZIBG TBB FILiliG OP A CLAIM WITS THE MBTBOPOLITAM TRAHSPORTATIOB COMMISSIOB FOR ALLOCATIOB OF TRAIISPORTATIOll DEVELOPMDIT ACT !'Um>S FOR FISCAL YBAll 1989-90 WHEREAS, the Transportation Development Act (•TDA"), as amended (Public Utilities Code section 99200 et seq.), provides for the disbursement of funds from the Local Transportation Fund of the County of Santa Clara for use by eligible claimants for the purpose of providing community tranait services: and WHEREAS, pursuant to the provisions of the TDA, as amended, and pursuant to the applicable rules and regulations thereunder (21 Cal.Admin. Code § 6&00 et seq.), a prospective claimant wish- ing to receive an allocation from the Local Transportation Fund shall file its claim with the Metropolitan Transportation commis- sion: and WHEREAS, the City of Palo Alto is an eligible claimant for TOA funds, pursuant to Public Utilities Code section 99275 as expressed in the City of Palo Alto's opinion of counsel, dated March 17, 1989: and WHEREAS, TOA funds from the Local Transportation Fund of Santa Clara County will be required in fiscal year 1989-90 to pro- vide subsidized taxi and accessible van services for elderly and handicapped persons who are unable to use public transit and can- not drive automobiles: NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION·1: The City Council hereby approves and authorizes the City Manager to execute and file an appropriate claim, toge- ther with all necessary supporting docU11ents, with the Metropoli- tan Transportation co-ission for an allocation of TDA funds in fiscal yaar 1989-90 to continue the existing paratransit program. known as Project Mobility. SECTION 2: The City Clerk is hereby directed to transait a copy of this resolution to the Metropolitan Transportation Commis- sion in conjunction with the filing of the claim, and the Metro- politan Transportation Coaaission is requested to concur in these findings and grant the allocations of funds as specified herein. SECTION 3; The Council finds that the adoption of this res- olution does not constitute a project as defined by the california Environaental Quality Act or Title II of the Palo Alto Municipal Code. 1.
