ADOPTING AN ~JIENT TO THE CI'l'Y OF PALO ALTO
FLEXIBLE BEMBFITS PLAN
WHEREAS, the City of Palo Alto (the "City") maintains
the City of Palo Alto Flexible Benefits Plan (the "Plan") which
is intended to qualify as a Cafeteria Plan under section 125
of the Internal Revenue Code of 1986, as amended;
WHEREAS, the City Council wishes to adopt a certain amend-
ment to said Plan in order to comply with the Technical and
Miscellaneous Revenue Act of 1988; and
WHEREAS, the City is permitted to amend the Plan pursuant
to Section 6wl of the Plan.
NOW, THEREFORE, the Council of the City of Palo Alto does
resolve as follows:
Section 1. That the Council hereby adopts the following
amendment to the Plan to be effective January 1, 1989. The
first sentence of Section 6.2 of the Plan shall be amended
to read as follows:
•Although this Plan was established with the
intention of being maintained for an indefinite period
of time, the City reserves the power to discontinue
or terminate the Plan at any time."
Section 2. The Council finds that this is not a project
under the California Environmental Quality Act and, therefore,
no environmental impact asssessment is necessary.
