RESOLUTION OF THE COUNCIL OF THE
CITY OF PALO ALTO AUTHORIZING THE
ACCEPTANCE OF FUNDS FROM THE
UNITED STATES DEPARTMENT OF JUSTICE
FOR WETLANDS MITIGATION
ORIGINAL
WHEREAS, the City Council of the City of Palo Alto has adopted a
Baylands Master Plan calling for the preser~ation and enhancement of
the wetlands in Palo Alto; and
WHEREAS, the City Council is in the proceas of establishing a
wetlands mitigation bank; and
WHEREAS, the United States Justice Department has arrang~d for
the sum of $65,000 to be paid to the City of Palo Alto, pursuant to a
Con3ent Decree in the matter of Charleston Properties v. United
States;
NOW, THEREFORE, BE IT RESOLVED by the City Council of Palo Alto
accepts the sum of $65,000 fer the purpose of wetlands acquisition,
creation, restoration and/or enhancement upon the following condi-
tions:
1. The funds are to be placed in an interest-bearing account
specifically earmarked for •wetlands acquisition, creation,
restoration, and/or enhaocementw;
2. The funds must be used in part in the next year and a half,
i.e., by August 1, 1990, or the funds and accrued interest
will revert to the United States7 and
3. If all of the funds and accrued interest are not used for
the specified purpose within three years --by February 1,
1992, whatever portion remains, including accrued interest,
will revert to the United States.

izsd to execute all documents necessary to carry out the purposes of
this Resolution.
