HomeMy WebLinkAboutRESO 6751ORIGINAL RESOLUTION NO. 6751 RESOLUTION OF THE COUN~IL OF THE CITY OF PALO ALTO AUTHORIZING THE FILING OF A CLAIM WITH THE METROPOLITAN TRANSPORTATION COM.M.ISSICN FOR ALLOCATION OF TRANSPORTATION DEVELOPMENT ACT FUNDS FOR FISCAL YEAR 1989-90 WHEREAS, the Transportation Development Act (•ToA•), as amended (Public Utilities Code section 99200 et seq.), provides for the disbursement of funds from the Local Transportation Fund of the County of Santa Clara for use by eligible claimants for the purpose of providing pedestrian and bicycle facilities; and WHEREAS, pursuant to the provisions of the TDA, as amended, and pursuant to the applicable rules and regulations thereunder (21 Cal.Admin. Code section 6600 et seq.), a prospective claimant wishing to receive an allocation f~om the Local Transportation Fund shal 1 file its claim with the He tropoli tan Transportation Commission; and WHEREAS, the City of Palo Alto is an eligible claimant for TDA funds pursuant to Public Util i.ties Code section 99234, as expressed in the City of Palo Alto's opinion of counsel, dated January 4, 1989; and WHEREAS, TDA funds from the Local Transportation Fund of Santa Clara County will be required in fiscal year 1989-90 for the purpose of improving pedestrian and bicycle facilities in Palo Altor and WHEREAS, this claim is in accordance with the policy in the Palo Alto Comprehensive Plan to promote bicycle use; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Council hereby approves and authorizes the City Manager to execute and file an appropriate claim, together with all necessary supporting documents, with the Metropolitan Transportation Commission for an allocation of One Hundred Eighty- Nine Thousand Dollars ($189,000) in TOA funds .in fiscal year 1989-90 for the purpose of providing the following pedestrian and bicycle projects in ~alo Alto: Bicycle Course at Stanford Middle School Bryant Street Traffic Barriers Bicycle Parking Facilities Bryant/Embarcadero Traffic Signal Airport Levee Improvements Park/Castilleja Traffic Barrier $ 4,000 45,000 10,000 75,000 25,000 30,000 SECTION 2. The City Clerk is hereby directed to transmit a copy of this resolution to the Metropolitan Transportation Commis- sion in conjunction with the filing of the claim, and the Metro- politan Transportation Commission is requested to concur in these findings and grant the allocations of funds as specified herein. l. SECTION 3. This request for funds is not considered a pro- ject under the California Environmental Quality Act, and there- fore, no environmental assessment is needed. '. ··=======-===~=a=~'======== _ CIT~ ATTOBllBT CITY OF PALO AL.TO TO: FROM: RE: January 4, 1989 Metropolitan Transportation Commission City of Palo Alto Eligibility for Transportation Developeent Act Funds This communication will serve as the requisite opinion of Counsel in connection with the application of the City of Palo Alto for an allocation of Transportation Development Act ('l.'DA) funds. 1. Tbe City of Palo Alto is authorized to provide and assist public transportation by acquisition, construction and operation of existing or additional transit facilities, including facilities provided for exclusive use by pedestrians and bicycles. 'l'his assistance may be provided directly or by contractual arrangeaents with other parties. 2. The City of Palo Al to is an eligible claimant for TDA funds pursuant to Public Utilities COde section 99234. 3. I have reviewed the pertinent State and local laws, and I am of the opinion that there is no legal iapediaent to the City of Palo Alto aaking application for TDA funds.
