ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING THE BUDGET FOR THE FISCAL YEAR 2002-03 TO ACCEPT
AND EXPEND GRANT FUNDS IN THE TOTAL AMOUNT OF $596,066
FOR THE CONSTRUCTION OF TRAILS, BAY TRAIL PATH AND FOOT
BRIDGE (CIP 10001, OPEN SPACE TRAILS); CONSTRUCTION OF
BAYLANDS PARKING LOTS (CIP 10003, BAYLANDS PARKING LOT
IMPROVEMENTS: AND DESIGN AND FABRICATION OF INTERPRETIVE
EXHIBITS (OPEN SPACE OPERATING BUDGET)
WHEREAS, pursuant to the provisions of Section 12 of Article
III of the Charter of the City of Palo Alto, the Council on June 17,
2002 did adopt a budget for fiscal year 2002-03: and
WHEREAS, Council approved the creation of CIP project 10001,
Open Space Trails for the restoration of park trails and adjoining
habitat, trail heads, picnic areas, fences, and park amenities: and
WHEREAS, the State of California Department of Parks and
Recreation has awarded the City four grants, which will provide for
additional expenditures in CIP project 10001: and
WHEREAS, Council approved the creation of CIP project 10003,
Baylands Parking Lot Improvements for replacement of parking lots
and roads, installation of bio-swales, and improvements to
circulation in the Baylands Nature Preservei and
WHEREAS, the State of California awarded a grant from the
Roberti-Z-Berg-Harris Urban Open Space and Recreation Block Grant
program, which will provide for additional expenditures in CIP
10003, Baylands Parking Lots Improvements: and
WHEREAS, the State of California Department of Parks and
Recreation has awarded the City a grant to provide for educational
exhibits and displays at the Baylands Nature center; and
WHEREAS, City Council authorization is needed to accept and
expend the grant receipts: and
WHEREAS, the additional appropriation of funds requested has
no impact on the Budget Stabilization Reserve and no future year
General Fund ongoing costs are anticipated as a result of this
ordinance; and
WHEREAS, City Council authorization is needed to amend the
2002-03 budget as hereinafter set forth.
NOW, THEREFORE, the Council of the City of Palo Alto does
ORDAIN as follows:
SECTION 1. Grant revenue in CIP Project Number 10001 is
increased by Three Hundred Forty-Two Thousand Dollars ($342,000) for
receipt of the State of California Grant Funds.
SECTION 2. Grant revenue in CIP Proj ect Number 10003 is
increased by One Hundred Seventy-Nine Thousand Sixty-Six Dollars
($179,066) for receipt of the State of California Grant Funds.
SECTION 3. Grant revenue in the Open Space and Sciences
Services Functional Area of the Community Services Department is
increased by Seventy Five Thousand Dollars ($75,000) for receipt of
grant funds from California Department of Parks and Recreation for
Nature Center exhibits.
SECTION 4. The sum of Three Hundred Forty-Two Thousand
Dollars ($342,000) is hereby appropriated to CIP 10001.
SECTION 5. The sum of One Hundred Seventy-Nine Thousand
Sixty-Six Dollars ($179, 066) is hereby appropriated to CIP 10003.
SECTION 6. The sum of Seventy-Five Thousand Dollars
is hereby appropriated to non-salary expense in the Open
Sciences Services Functional area in the Community
Department.

SECTION 7. These transactions will have no impact on the
Budget Stabilization Reserve.
SECTION S. As specified in Section 2.2S.0S0(a) of the Palo
Alto Municipal· Code, a two-thirds vote of the City Council is
required to adopt this ordinance.
SECTION 9. The Council approved a mitigated Negative
Declaration for the Arastradero Preserve Trail Master Plan, which
includes this project, on May 14, 2001. Staff has included all
required mitigations in the project.
Findings for a Categorical Exemption pursuant to Section 15301
of the CEQA Guidelines -Improvement to existing facilitYI were
filed with the State of California and County of Santa Clara on
6/17/02, 5/16/02, and 11/1/01 for the improvements to the Bay Trail
in East Palo Alto, to the Byxbee Park Hills and Sailing Station
Parking Lots at the Baylands Nature Preserve, and to Lucy Evans
BaylandsNature Interpretive Center, respectively.
SECTION 10. As provided in Section 2.04.350 of the Palo Alto
Municipal Code, this ordinance shall become effective upon adoption.
