ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING SECTION 18.08.040 OF THE PALO ALTO
MUNICIPAL CODE (THE ZONING MAP) TO CHANGE THE
CLASSIFICATION OF PROPERTY AT 2425 EMBARCADERO
WAY, FROM PC PLANNED COMMUNITY 3020 TO PC
PLANNED COMMUNITY 4725
The Council of the City of Palo Alto does ORDAIN as
follows:
SECTION 1. Section 18.08.040 of the Palo Alto Municipal
Code, (the Zoning Map), is hereby amended by changing the zoning of
certain property at 2425 Embarcadero Way from PC Planned Community
3020 to PC Planned Community 4725. The subject property,
consisting of approximately 1.02 acres, is shown on the map labeled
Exhibit "All attached to this ordinance and made a part of it.
SECTION 2. The City Council hereby finds that:
(a)' The City Council adopted Ordinance No. 3020
establishing PC-3020 on October 3, 1977. The principal use
authorized was a two-story public warehouse, with a live-in
attendant, and associated parking. Telecommunications facilities
were not a permitted use.
(b) The Planning Commission, after a duly noticed public
hearing held November 7, 2001 has recommended that Section
18.08.046 (the Zoning Map) of the Palo Alto Municipal Code be
amended to permit telecommunications facilities on the subject
property.
(c) The proposed amendment is in the public interest and
will promote the public health, safety and welfare, as hereinafter
set forth.
(d) Modification of the existing PC Planned Community 3020
District to permit building-mounted telecommunications facilities
on the site is consistent with the Palo Alto Comprehensive Plan and
is compatible with existing and potential use on adjoining sites
and in the general vicinity. In particular:
(i) Establishment of building-mounted telecom-
munication facilities in developments such as the California Self
Storage is supported by the following Comprehensive Plan Policies:
a. Business and Economics Policy B-13: Support
the development of technologically-advanced communications

infrastructure and other improvements that will facilitate the
growth of emerging telecommunications industries.
b. Bus ss and Economics Policy B-14: Work with
electronic information network providers to maximize potential
benefits for Palo Alto businesses, schools, residences, and other
potential users.

are a conditionally permitted use in City zoning districts.

(e) The s is so situated, and the use or uses proposed
for the site are of such characteristics that the application of
general districts or combining districts will not provide
sufficient flexibility to allow the proposed development. The
majority of building-mounted telecommunication facilities must be
placed at a height significantly above surrounding development
order to function properly. The site which is surrounded by light
industrial uses and the City recycling facilities. There is no
nearby resident development, with the exception of the on-s
caretaker facility. The two-story, thirty-four foot California
Storage building, with the addition of a parapet which will
the antennas, will provide sufficient clearance for transmission
and reception without being significantly taller than surrounding
buildings.
(f) Development of the site under the provisions of the PC
planned community district will result in public benef s not
otherwise attainable by application of the regulations of general
districts or combining districts. The subj ect site is already
developed in accordance with the existing PC Zoning Dist
standards and the proposed inclusion of telecommunications
facilit as a permitted use will not materially alter the
physical or aesthetic appearance of the site. Moreover, the
provision of on-s t ecommunications facilities will result in
a bene to the publ through improved and more wide ranging
wireless communication services without having an adverse on
neighboring propert
(g) use or uses permitted, and the site development
regulations applicable within the district are consistent with the
Palo Alto comprehensive plan, and are compatible with existing and
potential uses on adjoining sites or within the general vicinity.
Comprehensive Plan Policies B-13 and B-14 promote the establishment
of technologically advanced telecommunications infrastructure that
will bene the City's residents, schools, and bus ses.
Permitting building-mounted telecommunication facilities at the
subject s is consistent with these Comprehensive Plan Pol

SECTION 3. The Council has reviewed and considered the
proposed Negative Declaration, including the initial study,
prepared for this project, on file with the Department of Planning
and Community Environment, together with the comments received
during the public review period. The City Council finds, on the
basis of the whole record, that there is no substantial evidence
that the project will have a significant effect on the environment.
The City Council further finds that the negative declaration
reflects the independent judgment of the City. The Negative
Declaration is hereby adopted.
SECTION 4. The diagrams prepared by A. J. Turner on
August 22, 1977, and the diagrams prepared by Baek Young Ahn,
Architect dated June 27, 2001, copies of which are on file with the
Planning Department of the City of Palo Alto, are incorporated
herein by this reference and hereby are approved pursuant to
Section 18.68.070 of the Palo Alto Municipal Code subject to the
following conditions:

(a) Public warehouse with live-in attendant.
(b) The public interest, convenience and general
welfare require that the present zoning
classification of L-M-D is appropriate except
that the recommended P-C (Planned Community
District) zoning classification makes better use
of the subj ect property. Therefore, in the
event that this P-C Development Plan is not
constructed within the time prescribed by this
ordinance, the P-C (Planned Community District)
zoning shall lapse and the zoning of the subject
property shall automatically revert to L-M-D as
previously zoned or equivalent zoning as applied
to surrounding property by the forthcoming new
zoning ordinance.
(c) No outdoor storage, including the storage of
vehicles of any kind, is permitted. Parking
spaces and loading zones are to be used
exclusively for people who lease space to stop
for a brief period to load and unload.
(d) Interior storage shall be limited to dead storage
only, and no building, manufacturing, garages
sales or activities other than the loading and

unloading of dead storage shall be permitted.
Furthermore, no hazardous materials shall be
stored.
(e) Adequate loading zones near the entrances to the
second stories of both Building A and Building
B shall be maintained.
(f) One or more telecommunication facilities, the
design of which has been approved by the
Director of Planning and Community Environment
after design review.

SECTION 5. This ordinance shall be effective on the
