HomeMy WebLinkAbout2005-07-18 Ordinance 4877, , ORDINANCE NO. 4877 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE BUDGET FOR THE FISCAL YEAR 2005-06 TO PROVIDE AN ADDITIONAL APPROPRIATION OF $15,219 FROM THE INFRASTRUCTURE RESERVE INTO CAPITAL IMPROVEMENT PROGRAM (CIP) PROJECT NUMBER OS-00003, OPEN SPACE PARKING IMPROVEMENTS The Council of the City of Palo Alto does ordain as follows: SECTION 1. The City Council of the City of Palo Alto finds and determines as follows: A. Pursuant to the provisions of Section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 20, 2005 did adopt a budget for fiscal year 2005-06; and B. CIP project Number OS-00003, Open Space Parking Improvements had a remaining unspent appropriation of One Hundred Seventeen Thousand Four Hundred Eighty Dollars ($117,480) in fiscal year 2003-04; and C. This unspent. appropriation was returned to the Infrastructure Reserve pursuant to Budget Amendment Ordinance 4834 approved on May 18,2004 (CMR: 273:04): and D. There is a present need to authorize a contract change order in the City's contract with Duran & Venables for the Harbor Point and Byxbee Park parking lot· improvements to provide for certain repair work; and E. An additional appropriation of Fifteen Thousand Two Hundred Nineteen Dollars ($15,219) is needed to provide funds for the contract change order: and F. The additional appropriation of funds is for one-time expenditures and future year General Fund ongoing costs will be included in the operating budget: and G. City Council authorization is needed to amend the 2005-06 budget as hereinafter set forth. SECTION 2. The sum of Fifteen Thousand Two Hundred Nineteen Dollars ($15,219) is hereby' appropriated to CIP OS-00003, Open Space Parking Improvements. SECTION 3. The Infrastructure Reserve is hereby decreased by Fifteen Thousand Two Hundred Nineteen Dollars ($15,219) with a remaining balance of Twenty Three Million Three Hundred Forty Two Thousand Six Hundred Sixteen Dollars ($23,342,616) as. shown in Exhibit A. SECTION 4. As specified in Section 2.28.080(a) of the Palo Alto Municipal Code, a two-thirds vote of the City Council is required to adopt this ordinance. SECTION 5. As provided in Section 2.04.330 of the Palo Alto Municipal Code, this ordinance will take effect upon its adoption. SECTION 6. The Council finds that the Open Space Parking Improvements proj ect will replace existing infrastructure facilities in the s·ame location as the facilities replaced and is exempt from review under the California Environmental Quality Act pursuant to Title 14 California Code of Regulations Section 15302.
