HomeMy WebLinkAbout2005-06-06 Ordinance 4873ORDINANCE NO.4873 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE BUDGET FOR THE FISCAL YEAR 2004-05 TO PROVIDE AN ADDITIONAL APPROPRIATION OF $46,800 FROM THE INFRASTRUCTURE RESERVE INTO CAPITAL IMPROVEMENT PROGRAM (CIP) PROJECT NUMBER PF-01005, LUCIE STERN COMMUNITY CENTER IMPROVEMENTS The Council of the City of Palo Alto does ordain as follows: SECTION 1. The City Council of the City of Palo Alto finds and determines as follows: A. Pursuant to the provisions of Section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 28, 2004 did adopt a budget for fiscal year 2004-05; and B. CIP Project Number PF-01005, Lucie Stern Community Center Improvements had a remaining unspent appropriation of Two Hundred Sixty Six Thousand Eight Hundred Ninety One Dollars ($266,891) in fiscal year 2003-04; and C. This appropriation was returned to the Infrastructure Reserve at the end of 2003-04 fiscal year because the project was not ready for construction at that time; and D. In January 18,2005,' City Council approved Budget Amendment Ordinance #4860 granting an appropriation of Three Hundred Thirty Five Thousand Dollars ($335,000) to PF-01005 since design was complete and the project was ready to bid for construction; and E. In January 18, 2005, City Council awarded a construction contract to the lowest responsible bidder; and F. Between the Council award date and contract conformance, the lowest responsible bidder withdrew from the project sighting over-scheduling of work; and G. Staff has reached agreement with the second lowest bid contractor to honor their bid price of Three Hundred Forty Four Thousand Eight Hundred Dollars ($344,800)i and H. In order to award the construction contract an additional appropriation of Forty Six Thousand Eight Hundred Dollars ($46,800) is needed to provide funds for the construction of the projecti and I. The additional appropriation of funds is for one-time expendi.tures and future year General Fund ongoing costs will be included in the operating budgeti and J. City Council authorization is needed to amend the 2004-05 budget as hereinafter set forth. SECTION 2. The sum of Forty Six Thousand Eight Hundred Dollars ($46,SOO) is hereby appropriated to CIP Project Number PF- 01005, Lucie Stern Community Center Improvements. SECTION 3. The Infrastructure Reserve is hereby decreased by Forty Six Thousand Eight Hundred Dollars ($46,SOO) with a remaining balance of Thirty Million Four Hundred Seventy One Thousand Seven Hundred Forty Eight Dollars ($30,471,74S) as shown in Exhibit A. SECTION 4. As specified in Section 2.2S.0S0(a) of the Palo Alto Municipal Code, a two-thirds vote of the City Council is required to adopt this ordinance. SECTION 5. As provided in Section 2.04.330 of the Palo Alto Municipal Code, this ordinance will take effect upon its adoption. SECTION 6. The Council finds that the project to be funded by this appropriation is a minor alteration and repair to an existing facility and is categorically exempt from review under the California Environmental Quality Act pursuant to Title 14 California Code of Regulations Section 15301.
