HomeMy WebLinkAbout2005-06-06 Ordinance 4872.r l ./,/ ORDINANCE NO. 4872 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE BUDGET FOR THE FISCAL YEAR 2004-05 TO PROVIDE AN ADDITIONAL APPROPRIATION OF $651,393 FROM THE INFRASTRUCTURE RESERVE INTO CAPITAL IMPROVEMENT PROGRAM (CIP) PROJECT NUMBER PE-00107, BRIONES PARK IMPROVEMENTS The Council of the City of Palo Alto does ordain as follows: SECTION 1. The City Council of the City of Palo Alto finds and determines as follows: A.. Pursuant to the provisions of Section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 28, 2004 did adopt a budget for fiscal year 2004-05; and B. CIP Project Number PG-00010, Park Facilities Improvements had a remaining unspent appropriation of One Million Eighty Two Thousand Dollars ($1,082,000)of which, Six Hundred Fifty Thousand Dollars ($650,000) pertained to Briones Park Improvements in fiscal year 2003-04; and C. This unspent appropriation was returned to the Infrastructure Reserve pursuant to Budget Amendment Ordinance 4834 approved on May 18,2004 (CMR: 273:04); and D. There is a present need to replace and upgrade the Briones Park existing irrigation system, play areas, pathways, amenities and landscaping because of its deteriorating condition; and E. An additional appropriation of Six Hundred Fifty One Thousand Three Hundred Ninety Three Dollars ($651,393) is needed to provide funds to replace the existing infrastructure; and F. The additional appropriation of funds is for one-time expenditures and future year General Fund ongoing costs will be included in the operating budget; and G. City Council authorization is needed to amend the 2004-05 budget as hereinafter set forth. SECTION 2. The sum of Six Hundred Fifty One Thousand Three Hundred Ninety Three Dollars ($651,393) is hereby appropriated to CIP PE-00107, Briones Park Improvements. SECTION 3. The Infrastructure Reserve is hereby decreased by Six Hundred Fifty One Thousand Three Hundred Ninety Three Dollars ($651,393) with a remaining balance of Twenty Nine Million Three Hundr'ed Ninety Thousand rrhree Hundred Eighty Five Dollars ($29,390,385) as shown in Exhibit A. , ' SECTION 4. As specified in Section 2.2S.0S0(a) of the Palo Alto Municipal Code, a two-thirds vote of the City Council is required to adopt this .ordinance. SECTION 5. As provided in Section 2.04.330 of the Palo Alto Municipal Code, this ordinance will take effect upon its adoption. SECTION 6. The Council finds that the Briones Park Improvements project will replace existing infrastructure facilities in the same location as the facilities replaced and is exempt from review under the California Environmental Quality Act pursuant to Title 14 California Code of Regulations Section 15302.
