ORDINANCE NO. 4860
ORDINANCE OF' THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING THE BUDGET FOR THE FISCAL YEAR 2004-05 TO
PROVIDE AN ADDITIONAL APPROPRIATION OF $335,000 FROM THE
INFRASTRUCTURE RESERVE INTO CAPITAL IMPROVEMENT PROGRAM
(CIP) PROJECT NUMBER PF-01005, LUCIE STERN COMMUNITY
CENTER IMPROVEMENTS
The Council of the City of Palo Alto does ordain as
follows:
SECTION 1. The City Council of the City of Palo Alto finds
and determines as follows:
A. Pursuant to the provisions of Section 12 of Article III of
the Charter of the City of Palo Alto, the Council on June 28, 2004
did adopt a budget for fiscal year 2004-05; and
B. CIP Project Number PF-01005, Lucie Stern Community Center
Improvements had a remaining unspent appropriation of Two Hundred
Sixty Six Thousand Eight Hundred Ninety One Dollars ($266,891) in
fiscal year 2003-04; and
c. This appropriation was returned to the Infrastructure
Reserve at the end of 2003-04 fiscal year because the project was
not ready for construction at that time; and
D. Design is. complete and the project bid for construction;
and
E. In order to award the construction contract an additional
appropriation of Three Hundred Thirty Five Thousand Dollars
($335,000) is needed to provide funds for the construction of the
project; and
F. .The additional appropriation of funds is for one-time
expenditures and future year General Fund ongoing costs will be
included in the operating budget; and
G. City Council authorization is needed to amend the 2004-05
budget as hereinafter set forth.
SECTION 2. The sum of Three Hundred Thirty Five Thousand
Dollars ($335,000) is hereby appropriated to CIP Project Number
PF-01005, Lucie Stern Community Center Improvements.
SECTION 3. The Infrastructure Reserve is hereby decreased by
Three Hundred Thirty Five Thousand Dollars ($335,000) with a
remaining balance of Thirty Five Million Four Hundred Eighty Five
Thousand Dollars .($35,485,000) as shown in Exhibit B.
SECTION 4. As specified in Section 2.28.080(a) of the Palo
Alto Municipal Code, a two-thirds vote of the City Council is
required to adopt this ordinance.
SECTION 5. As provided in Section 2.04.330 of the Palo Alto
Municipal Code, this ordinance will take effect upon its adoption.
SECTION 6. The Council finds that the project to be funded by
this appropriation is a minor alteration and repair to an existing
facility and is categorically exempt from review under the
California Environmental Quality Act pursuant to Title 14
California Code of Regulations Section 15301.
