ORDINANCE NO. 5075
ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE BUDGET
FOR FISCAL YEAR 2010 TO PROVIDE AN ADDITIONAL APPROPRIATION OF $25,981
TO CAPITAL IMPROVEMENT PROGRAM (CIP) PE-11011, HIGHWAY 101
PEDESTRIAN/BICYCLE OVERPASS/UNDERPASS PROJECT
The Council of the City of Palo Alto does ordain as follows:
SECTION 1. The Council of the City of Palo Alto finds and
determines as follows:
A. Pursuant to the provisions of Section 12 of Article III of the
Charter of the City of Palo Alto, the Council on June 15, 2009 did
adopt a budget for fiscal year 2010; and
B. In fiscal years 2010, the Council appropriated an initial
amount of $100,000 to CIP Project PE-11011, Highway 101
Pedestrian/Bicycle Overpass/Underpass Project (Project); and
C. The appropriation is to cover the cost of a feasibility study
for a year-round pedestrian/bicycle grade separated crossing of Highway
101 in Palo Alto; and
D. Request for proposal was sent out and the City received
proposals from four consultants. The City staff evaluated the proposals
and selected Alta Planning +Design as top proposer with the a contract
amount of $110,981; and
E. Additional funds are needed for this Project to cover the cost
of public outreach, noticing, printing and mailing estimated at
$15,000; and
F. The existing appropriation balance of the Proj ect is not
sufficient to cover the cost of the contract with Alta Planning +
Design and the added costs identified in Section E of this ordinance.
An additional appropriation of $25,981 is needed to complete the
Project; and
G. The total additional appropriation of $25,981 for the Project
will be funded by the Infrastructure Reserve; and
H. Council authorization is needed to amend the 2010 budget to
make available the funds required for CIP Project PE-11011, Highway 101
Pedestrian/Bicycle Overpass/Underpass Project.
SECTION 2. The sum of Twenty Five Thousand Nine Hundred Eighty One
Dollars ($25,981) is hereby appropriated to CIP Proj ect PE-11011,
Highway 101 Pedestrian/Bicycle Overpass/Underpass Project.
SECTION 3. The Infrastructure Reserve is hereby decreased by Twenty
Five Thousand Nine Hundred Eighty One Dollars ($25,981) with a
remaining balance of Eight Million Nine Hundred Sixty ,Seven Thousand
One Hundred Ninety Eight Dollars ($8,967,198).
SECTION 4. As specified in Section 2.28.080(a) of the Palo Alto
Municipal Code, a two-thirds vote of the Council is required to adopt
this ordinance.
SECTION 5. As provided in Section 2.04.330 of the Palo Alto
Municipal Code, this ordinance shall become effective upon adoption.
SECTION 6. The Council of the City of Palo Alto hereby finds that
this is a planning and feasibility study and therefore nota project
subject to environmental review under Section 15262 of the California
Environmental Quality Act (CEQA) Guidelines. Environmental review will
be conducted in connection with the council's final approval of this
study and next phase .
