ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING THE BUDGET FOR THE FISCAL YEAR 2005-06 TO
PROVIDE ADDITIONAL APPROPRIATION FROM THE WATER FUND
RATE STABILIZATION RESERVE OF $350,000 INTO PHASE I AND
PHASE II WATER DISTRIBUTION SYSTEM IMPROVEMENTS PROJECTS
The Council of the City of Palo Alto does ordain as
follows:
SECTION 1. The City Council of the City of Palo Alto finds
and determines as follows:
A. Pursuant to the provisions of Section 12 of Article III of
the Charter of the City of Palo Alto, the Council on June 20, 2005
did adopt a budget for fiscal year 2005-06; and
B. The City Council of the City of Palo Alto did adopt in
fiscal year 2002-03 and 2003-04 the Phase I and Phase II Water
Distribution System Improvements Projects which include CIP Project
Numbers WS-02004 (Existing Well Rehabilitation), CIP Project Number
WS-02005 (El Camino Park Reservoir and Pump Station), CIP Project
Number WS-02006 (El Camino Park Well), CIP Project Number WS-02007
(Middlefield Road Well Site), CIP Project Number 02008 (Eleanor
Pardee Park Well) and CIP Project Number WS-04004 (Mayfield Pump
Station). Portions of these CIP projects have been combined into a
project known as the 8-hour Emergency Water Supply Project; and
C. A consultant was engaged to provide design, engineering
and environmental review services in connection with the 8-Hour
Emergency Water Supply Project ; and
D. To support the
Environmental Constraints
addressing eight potential
well sites; and
environmental review process, an
Analysis (ECA) was prepared for
reservoir sites and eight potential
E. Two public involvement meetings were held and attended by
various stakeholders with respect to the Project, and as a result
of the meeting it was concluded that three additional reservoir
sites should be included in the environmental review process for
the Project; and
F. The addition of three potential sites in the environmental
review process requires amendment to the consultant contract to
expand the scope of work and increase the maximum total
compensation by $350,000; and
G. Additional appropriations from the Water Fund rate
stabilization reserve of Fourteen Thousand Eight Hundred Forty
Seven Dollars ($14,847) into CIP Project Number WS-02004, Existing
Well Rehabilitation; Three Hundred Twelve Thousand One Hundred
Sixty Five Dollars ($3l2,165) into CIP Project Number WS-02005, El
Camino Park Reservoir and Pump Station; Six Thousand One Hundred
Sixty Dollars ($6,~~0) into CIP Project NumbeI WS-02006, El Camino
Park Well; Four Thousand Three Hundred Eighty Two Dollars($4,382)
into CIP Project Number WS-02007, Middlefield Road Well Site; Four
Thousand Three Hundred Eighty Two Dollars ($4,382)into CIP Project
Number WS-02008, Eleanor Pardee Park Well; and Eight Thousand
Sixty Four Dollars ($8,064) into CIP Proj ect Number WS-04004,
Mayfield Pump Station are needed to provide funds to compensate
the engineering firm for the additional services; and
H. The additional appropriation of funds is for one-time
expenditures and if future year ongoing costs will be incurred
they will included in the operating budget; and
I. City Council authorization is needed to amend the 2005-06
budget as hereinafter set forth.
SECTION 2. The sum of Fourteen Thousand Eight Hundred Forty
Seven Dollars ($14,847) is hereby appropriated to CIP Project
Number WS-02004, Existing Well Rehabilitation; the sum of Three
Hundred Twelve Thousand One Hundred Sixty Five Dollars
($312,165)is hereby appropriated to CIP Project Number WS-02005,
El Camino Park Reservoir and Pump Station; the sum of Six Thousand
One Hundred Sixty Dollars ($6,160)is hereby appropriated to CIP
Project Number WS-02006, El Camino Park Well; the sum of Four
Thousand Three Hundred Eighty Two Dollars($4,382)is hereby
appropriated to CIP Project Number WS-02007, Middlefield Road Well
Site; the sum of Four Thousand Three Hundred Eighty Two Dollars
($4,382)is hereby appropriated to CIP Project Number WS-02008,
Eleanor Pardee Park Well; and the sum of Eight Thousand Sixty Four
($8,064) is hereby appropriated to CIP Project Number WS-04004,
Mayfield Pump Station.
SECTION 3. rrhe Water Fund Rate Stabilization Reserve is
hereby decreased by Three Hundred Fifty Thousand Dollars
($350,000) with a remaining balance of Seven Million Sixty
Thousand Two Hundred Seventy Nine Dollars ($7,060,279) as shown in
Exhibit A.
SECTION 4. As specified in Section 2.28.080(a) of the Palo
Alto Municipal Code, a two-thirds vote of the City Council is
required to adopt this ordinance.
SECTION 5. As provided in Section 2.04.330 of the Palo Alto
Municipal Code, this ordinance will take effect upon its adoption.

SECTION 6. The Council finds that the 8-hour emergency water
supply project is a project with a potential for adverse effects
on the environment for the purposes of the California
Environmental Quality Act (CEQA) and that the project requires
preparation of an environmental impact report.
