HomeMy WebLinkAbout2007-09-10 Ordinance 4968I I I ORDIl'-rANCE NO 4968 ORDWANCE OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVWG AND ADOPTWG A PARK IMPROVEMENT ORDWANCE AND AN IMPROVEMENT PLAN FOR JOHN BOULWARE PARK The Council ofthe City of Palo Alto does ORDAW as follows: SECTION 1. Findings. The City Council finds and declares that: (a) Article VIII of the Charter of the City of Palo Alto and Section 22.08.005 of the Palo Alto Municipal Code require that, before any substantial building, construction, reconstruction or development is commenced or approved, upon or with respect to any land held by the City for park purposes, the Council shall first approve and adopt a park improvement ordinance and a plan describing the proposed project. _______ -------"h) __ lohnRoulware-E.arlcis-dedicated.tO-park_purposes. _____________ _ (c) The park's amenities, including the asphalt pathways around the park perimeter, picnic tables, benches and barbecues, basketball court, two children's play areas and a small shade arbor have not been upgraded since 1966 and need replacement. (d) The City intends to authorize certain replacement and improvement projects within John Boulware Park as shown on the John Boulware Park Improvement Plan and John Boulware Park Layout and Paving Plan (collectively "Plans") attached as Exhibits "A-I" and "A-2" including, without limitation, the following: (1) Removal and replacement of all asphalt park pathways. (2) Removal and replacement of the fencing around the children's play area . . (3) ·Removal and replacement of all benches, picnic tablesjubarbecues and trash receptacles. (4) Replacement of the irrigation system. (5) Minor repairs to the shade arbor. (e) The project improvements will avoid protected trees and other sensitive resources and all existing park uses will be restored following project construction. In addition, inconvenience to the public caused by aging equipment and paved surfaces will be eliminated. Accordingly, the improvements described above and as more specifically described on the Plans attached hereto as Exhibits "A-I" and "A-2" are consistent with park and conservation purposes. (t) The Council desires to approve the projects described above and as more specifically described on the Plans attached hereto as Exhibits "A-I" and "A-2". 1 070918 syn 6050189 SECTION 2. The Council hereby approves the Plan for replacement and construction of improvements in John Boulware Park and hereby adopts the Plans attached hereto as Exhibits "A-I" and "A-2" as part of the official plan for the construction of improvements in John Boulware Park. SECTION 3. The Council finds that the project to replace and improve certain facilities at John Boulware Park is categorically exempt from review under the California Environmental Quality Act (CEQA) pursuant to the provisions of Section 15301 of Title 14 of the California Code of Regulations. It was originally constructed in1966, and occupies 1.5 acres adjacent to the Matadero Creek Channel between EI Camino Real and Park Avenue. Park amenities include a small centrally located turf area with several trees; asphalt pathways around the perimeter of the park; picnic tables, b~nches and barbecues; a basketball court; two children~s play areas, and a small shade arbor. The project improvements will avoid protected trees and other sensitive resources. Construction Schedule Construction activity to . implement the proposed improvement project is expected to last approximately 90aays, rrom August 20071lUougli October 2007. Construction would likely occur during weekdays from 8:00 a.m. to 5:00 p.m. Anticipated Results The anticipated benefits to be realized from the project include safer pathways and playa,eas, more comfortable and accessible picnic tables and benches, and a more efficient irrigation system.
