HomeMy WebLinkAbout2007-05-07 Ordinance 4947ORDTI'l"ANCE NO 4947 ORDmANCE OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVmG AND ADOPTmG A PLAN FOR IMPROVEMENT TO HERITAGE PARK The Council of the City of Palo Alto does ORDAm as follows: SECTION 1. Findings. The City Council finds and declares that: (a) Article VIII of the Charter of the City of Palo Alto and Section 22.08.005 of the Palo Alto Municipal Code require that, before any substantial building, construction, reconstruction or development is commenced or approved, upon or with respect to any land held by the City for park purposes, the Council shall first cause to be prepared and by ordinance approve and adopt a plan therefore. (b) Heritage Park is dedicated to park purposes. (c) The City intends to authorize the construction of a certain playground equipment improvement project within Heritage Park as shown on the Heritage Park Plan (the "Plan") attached as Exhibit "A": (1) Excavation of soil necessary to install drainage systems, remove irrigation pipes and prepare the site for the construction and installation of curbs, pathways and structure equipment. (2) Clearing of vegetation and trimming of existing shrubs and trees in ' accordance with City policies and as necessary to provide equipment access for construction. (3) Adjustment and restoration of existing planting and irrigation to accommodate the proposed improvement. (4) Construction of curbs, pathways and retaining structures In accordance with the Plan. (5) Installation of site amenities, including the pathways, fencing, benches, shade arbors, and playground equipment and tables in accordance with the Plan. (d) The improvements at Heritage Park will be limited to playground equipment facilities located within the westerly quadrant or area of the park. (e) The project improvements will avoid protected trees and other sensitive resources. In addition, existing park uses will be restored following the completion of project construction. 1 070522jlb 0072846 (f) The project described above and as more specifically described in the Plan, attached hereto as Exhibit "A" is consistent with park and conservation purposes. (g) The Council desires to approve the project described above and as more specifically described in the Plan, attached hereto as Exhibit "A." SECTION 2. The Council hereby approves the Plan for the construction of the playground equipment improvement in Heritage Park, and it hereby adopts the Plan, attached hereto as Exhibit "A" as part of the official plan for the construction of the playground equipment improvement in Heritage Park. SECTION 3. The Council finds that the project to construct the new playground equipment facilities at Heritage Park is subject to review under the California Environmental Quality Act (CEQA). An environmental impact report for the Summerhill development project, which lies to the south of the proposed project site, and which included the conceptual design for a full-amenity public park, now Heritage Park, was adopted by the Council by resolution number 7950, dated March 27, 2000.
