HomeMy WebLinkAbout2008-04-14 Ordinance 5001ORDINANCE NO. 5001 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE BUDGET FOR THE FISCAL YEAR 2007-08 TO PROVIDE AN ADDITIONAL APPROPRIATION OF $40,137 TO CAPITAL IMPROVEMENT PROGRAM (CIP) PROJECT OS-07003, OPEN SPACE MAINTENANCE SHOP REHABILITATION The Council of the City of Palo Alto does ordain as follows: and 1. The Council of the City of Palo Alto finds ==-=....,== s as follows: A. Pursuant to the provisions of Section 12 of Article III of the Charter of t1:l§!mGtt.Y of Palo Al to, the Council on June m=l=l-,--, --=2 ____ 0 ____ 0--'-7 _____ _ did adopt a budget for fiscal year 2007 08; and B. In fiscal year 2006-07, the City Council appropriated $250,000 for CIP Project OS-07003, Open Space Maintenance Shop Rehabilitation (Project) to cover the costs of the design and construction; and C. Design was completed leaving a balance of $192,762 from the appropriation to cover for the construction cost of the Project. $40,137 additional funding is needed to award the construction contract; and D. This project was put out to bid; the low bid higher than the amount available, and an additional funding of $40,137 is required to construct the Project; and E. The total additional appropriation of $40,137 will be funded by the infrastructure reservej and F. Them appropriation of fund for CIP pr6jeCtm CIP Project OS- 07003, Open Space Maintenance Shop Rehabilitation{Project) is a one time event, and in future years maintenance and replacement costs will be included in the City's budget; and G. City Council authorization is needed to amend ,the 2007 08 budget to make available the funds required for construction of CIP Project OS-07003, Open Space Maintenance Shop Rehabilitation. SECTION 2. The sum of Forty Thousand One Hundred Thirty Seven 40,137) is hereby appropriated to CIP Project OS-07003, Open Space Maintenance Shop Rehabilitation. SECTION 3. The Capital Project Fund Infrastructure Reserve is hereby reduced by Forty Thousand One Hundred Thirty Seven Dollars ($40,137) to Sixteen Million Four Hundred Fifty Three Thousand Twenty Nine Dollars ($16,453,029) as shown in Exhibit A. SECTION 4. The transactions above will have no impact on the General Fund Budget Stabilization Reserve. SECTION 5. As specified in Section 2.28.080(a) of the Palo Alto Code, a two-thirds vote of the City Council is required to adopt this ordinance. SECTION 6. As provided in Section 2.04.330 of the Palo Alto Municipal Code, this ordinance shall become effective upon adoption. SECTION 7. The Council of the City of Palo Alto hereby finds that this project is exempt from the provisions of the California ----~EIl-~men.ta.l-Q.ua.l..Lt.y-....Ac-t._(-CEQA)~uJ:;suant-to-S-ecti.onS---~53-~andu.-~ ____ _ 15302 of the CEQA Guidelines, and therefore, no environmental impact assessment is necessary.
