Ordinance Of The Council Of The City Of Palo Alto
Amending The Budget For Fiscal Year 2010 To Provide An
Additional Appropriation Of $279,583 Within The Electric
Fund To Expand Commercial Energy Efficiency Programs
The Council of the City of Palo Alto does ordain as follows:
SECTION 1. The Council of the City of Palo Alto finds
and determines as follows:
A. Pursuant to the provisions bf Section 12 of Article III of
the Charter of the City of Palo Alto, the Council on June 15, 2009
did adopt a budget for Fiscal Year 2010; and
B. In September 2006, California Assembly Bill 2021 was
signed and required publicly-owned utili ties to set goals for
energy efficiency programs and to implement and fund third-party
measurement and verification of these programs; and
C. In April 2007, the Council approved the City's Ten-Year
Energy Efficiency Portfolio plan which identifies and sets goals
for energy conservation and efficiency programs; and
D. In June 2008, the Council approved a contract with Ecology
Action to expand the Ci ty of Palo Alto Utili ties' commercial
energy efficiency programs to provide installation of energy
efficient equipment to small and medium businesses; and
E. Funding for the contract wi th Ecology Action resides
within the Public Benefit Functional Area of the Electric Fund;
and
F. An amendment to the contract wi th Ecology Action will
increase both the types of energy efficient equipment available to
businesses and the number of customers who can be served; and
G. This contract amendment requires an additional $279,583 in
Fiscal Year 2010 to expand commercial energy efficiency programs;
and
H. To provide additional funding for commercial energy
efficiency programs in Fiscal Year 2010, it is necessary to
transfer $279,583 from the Public Benefit Program Reserve to the
Public Benefit Functional Area; and
I. City Council authorization is needed to amend the Fiscal
Year 2010 budget to make an additional appropriation of $279,583
for demand-side management incentives expense to provide
addi onal funding to expand commercial energy efficiency
programs.
=======-=. The sum of Two Hundred Seventy-Nine Thousand Five
Hundred Eighty-Three Dol ($279,583) is hereby appropriated to
demand-side management incentives expense in the Public Benefit
Functional Area in the c Fund.
The Public Benefit Program Reserve is hereby
reduced by Two Hundred Seventy-Nine Thousand Hundred Eighty-
Three Dollars ($279,583) to Three Million Sixty-Nine Thousand Nine
Hundred Fifty-Five Dollars ($3,069,955).
SECTION 4. As specified in Section 2.28.080(a) of the Palo
Al to Municipal Code, a two thirds vote of the City Council is
required to adopt this ordinance.
SECTION 5. As provided in Section 2.04.330 of the Palo Alto
Municipal Code, this ordinance shall become effective upon
adoption.
