ORDINlL?llCE NO. ,.. -~US" 30 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO ~.MEMOING CHAPTER 22~04 OF THE PALO ALTO MUNICIPAL CODE TO ESTABLISH RESTRICTIONS ON HOURS OF USE OF CITY PARKS, AND DECLARING AN EMERGENCY The Council of the City of Palo Alto· does ORDAIN as fol- lows: SECTION l. The Council hereby finds with respect to assemblages of la~ge numbers of people in and about the city's parks at and after. nightfall pursuant to exclusive us~ permits: (a) (b) (c) (d) The incidence_ of criminal acts such as sexual assault, drunkenness iii p~blic a~d use of illegal drugs· is substantially greater than at other times. Darkness and large crowds seriously hamper publi~ officials and police ~fficers in discharging their duties to p~9t~c::t. the_ users of such pa~ks, to enforce park regulation·s, and to pr~vent the occur_rence of crime. . . . Substantial numbers.of minors attend such gatherings. ~ .. SEC~ION .2. section 22~04.040 (Exclusive use of parks) of the Palo Alto· Municipal Code is hereby amended by adding the following· sentence theretp: --··· -. . . '!No ex.clusi ve use permit shall be granted for a park for any· assembly or assembly acti::vi ty involving more tha~ one hundred fifty participants during any of the time between one·hour before sunset .and one hour after sunrise, wtless .the park has the appropriate program'lig:titing ·as spec.i:ffed in Exhibit A." SECTION 3. Because of the findings set forth in Section 1 hereof and in order to protect the public safety, health and wel­ fare, the Council does declare that this is an emergency ordinance that shall take effect immediately upon its passage. This ordinance was introduced at a regular meeting of the Council of the City of Palo Alto on Monday, the 8th day of September, 1969, and was passed by a four-fifths vote of all the councilmen present at the meeting as follows: AYES: Arnold, Berwald, Clark, Comstock, Dias, Gallagher, Norton, Pear son, Wheatley NOES: None ABSENT: Beahrs, Spaeth l{pPROVED AS TO CONTENT: '"lr;JW) .
