Appointments to the following positions shall be made by the city manager with the approval of the counc"il: (1) Chief of police (2) Fire chief (3) City engineer (4) Chief engineer for gas, water, sewers _(5} Chief engineer for light ~nd power (6) City treasurer (7) Director of planning and community development (8) Managing director of community services." SECTION 2. Se:0tion 2.08.150 of the Palo Alto Municipal Code is hereby amended to read as follows: 11 2.08.150 off ice of of a city council. (9) He shall perform such duties as may be re­ quired by the charter or as the council m_ay require of him. SECTION 3. Sectlon 2.08.170 of the Palo Alto Municipal Code is hereby amended to read as follows: "2.08~1?0. Division of central,anal5sis a9d ser~ices. The division of central analysis an services shall be under the supervision of the director of adminis­ trative services. His duties shall be as follows: (1) He shall provide operational ·and man~gemerit analytical capabilities for all city departments and the city manager. . (2) He shall coordinate data processing activities ,for all departments under the control of the city manager. (3) He shall recommend to and implement manage­ ment reporting systems approved by the city monager. {4) ·He shall coordinate the city's record re­ tention and destruction program. (5) He shall provide mail and messenger service for all city departments. (6) He shall administer the pneumatic tube system at the ·civic center. ·(7) He shall pr6vide offset printing and other duplicating~facilities for all city departments. (8) He shall provide centralized office machine operation for all city departrnents.11 SECTION 4. 'l'he first paragraph of s'e_ction 2 •. 08.180 of the Palo Alto Municipal Code is hereby amended to read as follows: "?.08.180 Division of purchases and stores. The . division of 'purchases and stores shall be under the supervision of a . director of purchasing services who shall be accountable to the director·. of admfnis­ trative services. The first paragraph of Section 2.08.200 of the Palo Alto Municipal Code is hereby amended. to read as follows: "2.08.200 Division-of personnel. His duties shall be as follows:" SECTION 7. The first paragraph of Section 2.08.205 of the l?alo Alto Municipal Code is hereby amended to read as follows: "2.08.205 nivision of communications. Subsection (7) of Section 2.08.210 of the Palo Alto .Municipal Code is hereby amended to read as follows: "(7) He shall consult with the city engineer and the director of planning and community development on matters doncerning traffic control." SECTION 9. Section 2.08.230 of the Palo Alto Municipal Code is hereby amended to read as follows: "2.08~230 Animal shelter department. The·animal shelter department shall be under. the direction of a poundmaster who shall be accountable to the Chief of Police. His duties shall be as follows: (l) He shall formulate and recommend. to the Chief of Police policies and procedures-relating to the care ana control of animals, and shall administer such policies and procedures when approved by the Chfef of Police, and shall conduct such activities for. the city. (2) He shall enforce all ordinances and ~tate laws relating to the ·care, control, impounding, 'and registration of all animals. (3) He shall ~ond~ct the sale of animals as directed by law. . ·(4) He shall deposit with the Gity treaSUJ;~r withl'n thre.e days ·such funds as may be collected in the·operation of his department and at no· time retain more than one hundred dollars in his possession. · {5) . He shall recommel:id to the Chief of Poiice a schedule of ·f~es·or rates to be.~harged for the care and maintenance of privately.owned animal,s. (6) He shall be responsibie for 1;.he destruction of animals in accordance with the o.Cd1nances of · ... , the city. His duties shall be as follows:" SECTION 12. Section 2.08.300 of the Palo Alto Municipal Code is hereby amended. to read as follows: "2.08.300 Department of ,elanning and community development. The aepartment of planil"Ing and conunun­ i ty development shall be under the di~ection of a director 'of planning and community development who shall be accountable to the city manager. His duties shall be as follows: (1) He shall make such studies and reports as may be required by the city manager. (2) He shall recommend proposals and pro­ cedures to the city manager pertaining to land use and development, use and development of public properties and special z6niiig matt~r~~· and shall cooperate with the building~official and fire chief in coordinating fire zones and land use zones. (3) He shall advise the public on matters re­ lating to planning procedures as outlined by law and.he shall receive and transmit to the proper authority requests of the public which are within the province of the department·. _ ·· _ · · .· _ (4) He shall cooperate and coordinate the work of his· ci'epartment with, and give technical assistance to, the planning commission. .· {5) He shall maintain suc.h maps artd ·recoi;ds as .may be necessary for the fulfillment of his functions • .. Section 6.28.040 of the Palo Alto Municipal Code is hereby.amended to read as followsr ilG.28.040 Permit for keeeing wild animals. No person shall have, keepf or maintain, or have in his possession or control, any elephant, bear, hippopotamus,rhinoceros, ·lion, tiger, leopard, wolf, monkey, or any poisonous.reptile of any kind, or any dangerous or carniverous wild animal' or reptile withoui first applyirig to and receiving from the chief of police· a permit to do so.11 SECTION 15. Section 6.28.050 of the Palo Alto Municipal Code is hereby amend.ed to read as follows: "6.28.050 Authori~y of chief of police •. The chief of police is invested with the authority to issue permits for the keeping or maintain1ng of any of the anitnals enumerated and described in Section 6.28.040 to any person when, in his opinion,. any such animal may_ be kept or maintained without menacing the safety of any person or property; provided, however, that he may require any such animal to be properly caged or tethered, and may make additional rules and regulations regulating the keeping or maintaining qf any such anirnals, and may revoke any such permit for the violation of any of the provisions of this chapter or of any of said rules and regulations, or when in his opinion, the safety of any person or property is menaced by the keeping of any such animals." SECTION 16. Subsection (lj and iternf: (3) and (4) cf sub- section (m} ·of Section 13 .16 .• 150 o.f the Palo Al to Municipal Code are hereby amended to read as follows: (1) Determination of Credi ts: . Immediately upon receipt' of the sq~are footage figures, the director of planning and conununity.development shall determine, 'for each parcel of -land within the parking assessment district, the number of off-street automobile parking--spaces which would be required to be provided under city ordinances generally then in effect, and the 1~umber being ·provided.by said parcel and whic;h would be credited in satisfaction of said requirement if said ordinances applied to ·said parcel. An applic_ation for a change of district may be made by a record owner of the parcel of property for which a change is sought or by a purchaser thereof under a contract in writing duly executed and acknowledged by both the buyer and the seller, by a lessee in possession thereof, with the written consent of the owner_ of record of the legal title to make 8uch application, or by the agent of any of the foregoing, duly authorized in writing. The applicatidn m~st be. in writing on a form supplied by the division 6f planning. The appli­ cation must.contain a complete description of the property involved and must be accorripanied by a staterrient -setting forth fully the grounds of such petition a~d all of the facts relied upon by the applicant. The division of planning may require such other information or maps.as it may deem necessary. The applica.tion must be certified by an applicant as to the truth and accuracy of all.the facts and maps presented with such application or any supplement thereto." "·18. 98. 04 O Time for filing applications--fees. An application for a change in district may be filed with the division of planning only in April, August and December and shall be heard within a period of ninety days from the date of filing. Such application shall be filed with the div~sion of pl~nning together with a fee of .fifty dollars if the area for which the zone change is sought is ten thousand square feet or less; a fee of seventy-five dollars if such area is. over ten thousand square feet and not over one acre; or a fee rif one hundred dollars if said area is over one acre. Applications may be ~eceived ·and heard at other times upon the. payment of,· a fee in an amount .twice that of the fee which otherwise would be herei:nabove required for such area, to cover expenses incident to such special hearing. Upon receipt of t e reconuncn at~on of the planning commission as provided herein, the city council shall consider the same and may change or refuse to change the classification of any property as requested or recommended and it;s decision thereon shall be final and conclusive. If the cit'y council so desires it may hold a public hearing on the matter in the same manner as provided in Section 18.98.070 hereof where applicable. If the classification of any property is to be changed an ordinance shall · a~cordingly be passed and thereupon the zoning administrator shall change the official zoning map in conformity therewith." SECTION 18. Section 21.08.060 of the Palo Alto Municipal Code is hereby amended to read as follows: "21.08.060 Violation~-Notice filed. If and when the director of planning becomes aware of a division of land in.vi6lation of the pro­ visions of this title, he may record in the office of the county recorder of Santa Clara County a notice to the ef feet describing the land.. ·If $Uch division is subsequently approved hereunder, the director of planning may record a notice thatthe violation has ceased. Nothing in this section shall be deemed to require compliance with the recording provisions contained herein as a condition precedent to the enforceability of Section 21.08.070 or any other provisi6n of this title." SECTION 19. Wherever in Chapter 21.32 (Miscellaneous Divisions of Land) the words "pla.nning officer" appear, there . . shall.be substituted therefor the words. 11 director of planning.a SECTION 20. ThiR ordinance shall become effective upon the expiration of thirty days from its passage.
