SECTION 1. Section lB.08.0CO of the Palo Alto Ku~icipal
Co~e. the •zo~inq Map•, is hereby a~ended to change the zoning of
certain properties kno•-n, respecti.ve1y, as 529 Bryant street and
251 University Avenue (individually and collectively, tte "subject
property") from the "CD-C (GF) (P) Coir111ercial Downto•·n-Cor..r.iunity/
~round Floor/Pedestrian Combining Districttt zone classification to
the MFC Planned Co=unity District" z.one classification. Said
properties are sho·.•n on a map attached hereto as Exhibit "A" and
incorporated herein by reference.

entitled "Bank of Alllerica Building", prepared by flank Planning
Associates", dated Dece~er :21, l~i6, a cop~· of e;;ch cf '-'hich is on
file in the Planning Department, and to whi~h copies =eference is
hereby ~ade concerning the full particulars thereof, are hereby
collectively approved as thE< D.;:velopT!'ent ?.l.an fer t:ie subject

(1) ~51 University Avenue. The site develcpmsnt.
regi.ilations governing the subje~t property
shall be in accorc1ance with the Development
Plan, and -.:ith the site re~lations estab-
lished fol'.: the co-c (GF) (Pl z:o:-:.e: provided,
that in the case of a conflict between the CD-
C (CF) (P) regulations and the Develop~e.-it
Pl~n, the Develc~nen~ Pla~ shall control.
Notwithstanding section lB.49.050 (b), no
furthi?r expansion of square footage shall be
allowed at this site, excepting only sq-..!are
footage which, in the j i..:dglllent of the Chief
Building Official, does not increase the
usable floor area, but is necessary to comply
with state handicap access require~ents.
(2) 529 Ervant Street. The site develop~ent
regu~ations governing the subject property
shall be in accordar,ce '-'ith the Develocrnent
Plan, and with the site regulations ,_,;.ta::.-
lished !or the CF-C (PJ zone; provided, that
in the case of a conflict between the CD-c (Pl
regulations and the r~velopment Plan, the
Develop~ent Plan shall control; provided,
howev er, any landscaping i:r:>prove::cer.ts proposed

final ARB approval. Not...,ithstanding Secti on

(l) The developer, at its ovn cost, shall design
and ccT.stti.Jct · cert11in improvements to the
Civic Center ?laz:a in t1H~ tc~"'!l'l of the con-
structi~n of steps, planters and seating areas
on both sides of the plaz:d fronting Bryant and
Ramona streets. Pr~ject design shall be
coordinated with City staff, the Urban Design
C~l:l.mittee and the .ARB prior to City Council
approval. Lngineering desi;n and co~•truction
shall he coordinated ..,.ith the PU:!:;: .:.c Works
Dep~rt~ent. The cost for these Civic Center
imprcve~ents need not excee~ $~50,000. c~ns
truction of the improve.~ents shall be co~plet
ed or developer shall have entered into an
agree:ment "1ith the City and posted security in
a form acceptable to the City Attorney ensur-
ing co~p!etion of such ~ork in a timely :man-
ner, prior to occupancy of 529 Eryant Street.

The developer, at its own cost, shall contrib-
ute $~0, 000 t.o tl':e ?enir.si.:la Conservation
Center for use by the Downtown Envircn~ental
Action Project to prcvide funds fer recepta-
cles, di.:"'psters and o~her items necessary to
impla=cnt the recycling program organized for
the Downtown. The developer shall make this
contribution prior to occupancy of 529 Bryant
Street.
The ~evelooer, at its oJn cost, shall replace
