HomeMy WebLinkAboutORD 2489• • ORDINANCE NO. 2489 ORDINANCE OF THE COUNCIL OF ~HE CITY OF PA~O ALTO AMENDING CHAPI'ER 16. 20 OF THE PALO ALTO MUNICIPAL CODE (SIGNS) PROHIBITING FLASHING AND_ MOVING SIGNS WHEREAS, the Council finds that flashing and moving signs as defined in this ordinance constitute a danger to the public health and safety be-~use of the distraction to passing motorists and possible confusion with traffic signals; and WHEREAS, the Council has found that unless restrictive and adequate flashing-and moving sign legislation is adopte~, the safety and welfare of passing motorists will be seriously affected to the detriment of the entire community. NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. Section 16.20.010 of the Palo Alto Municipal Code is hereby amended to add subsections (14) and (15), to read as follows: __ . "(14) FLASHING SIGN. The term "flashing sign" sha11 mean any sign or aavertising structure which has any flashing device, intermittent illumination, re- volving or rotating lighting device in which the brilliance thereof is caused to vary by mechanical or other mearts.u 11 (15) MOVING SIGN. The term "nioving sign 11 shall mean any sign or advertising structure which has any visible moving parts ' visible revo 1 ving or ro.tat1ng. parts or visible mechanical movement of any descriptic~; excepting clocks." - SECTION 2. Chapter 16.20 of the Palo Alto Municipal Code is hereby amended to'adda Section 16~20.105, to read as follows: 11 16.20.105 Pt;-Phibited Signs. Section 16.20,230 of the Palq Alto Municipal Code is hereby amended to read as follows: 11 16.20,230, Amortization of nonconforming sians, Th~re are hereby declarea to be the following time periods within which all signs within the City shall be altered, removed or o~herwise made to comply with the provisions of this chapter: (a) General rule: Signs painted on buildings, walls or ·fences - 2 years. ·. All other signs - 5 years. (b) Signs iegally erected pursuant to a valid sign permit issued within the two years· immediately preceding· the effective date of' this section: 1) Signs painted on buildings, walls or fences -3 years from permit date. 2) All other signs - 7 year.s from permit date. (c) Flashing or moving signs legally erected pur­ suant to a valid sign permit: 7 years from the date of effectiveness of Section 16.20.105." SECTION 4.
