' • 'ORIGINAL ORDINANCE NO. 2484 ·ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING CHAPTER 22.04 OF THE PALO ALTO MUNICIPAL CODE TO BE DESIGNATED ''PARK AND RECREATION BUILDIN<1 USE AND REC.ULATIONS 0 WHEREAS, the council finds that-the use .of city parks arid recreation buildings must be requlated .in order thc:ft all persons may enjoy ~nd make use of such parks ~nd recreation lmildings, and WHEREAS, in order·to protect the rights of persons occupyinq the areas surrounding such parks and recreation buildings, the use and enjoyment of such parks and recreation buildings must be regulated, and WHEREAS, the streets and other public.places surrounding and adjacent to parks must be kept free and open f6r the use of the public, and WHEllliAS, the United States Supreme Court decided in the case of Kovacs v. Coc.i~, 336 u.s. 77 (69 Sup. ct. 488, 93 Lawyers Ed. 513) that municipalities have the right and the duty to regulate the use of their public property so that traffic hazards. may be minimized and the quiet and tranquility so desira.ble for city dwellers may be protected, _and WHEREAS, the Council finds that permit procedures and.requla­ tions for the Use of -~!ty parks and_ recreation buildings are necessary to protect the. 'public !'tealth, safety, welfare and morals of_ the· residents of th~ Cit~rof Palo Alto,-and WHERE;AS, the Council has reviewed in depth each of the·.park and recreatiop building facilities and has made specific findings . ,_ regarding factors of park: and building use, and :1 WHEREAS, a chart has beeh prepared by the council based upon the factors enumerated therein and said chart outlines.the -,i - 1 - --~· ~ . .. • standardi and guidelines tb be used in the gr~ntinq of exclusive use of the parks, which chart has been incorporated into this ordinance as EXHIBIT A, and WHEREAS, the Council has found that -reasonable fees-should be paid by exclusive use permittees for the use of city parks, personnel, equipment and-facilities ot_her than recreation build­ ings, sa.id fees being set out in the fee schedule attached hereto and incorporated into this ordinance as EXHIBIT B, and WHEREAS, the Council has found that reasonable fees and . ' deposits should be paid by exclusive use permittees for the use of City-owned recreation buildinqs made available to exclusive ' use perrnittees, said fees and deposits being set out in the Building Fee Schedule.attached hereto and incorporated into this ordinance-as EXHIBIT c, and WHEREAS, Foot.hills Park has been established as a nature preserve in order to conserve for the residents of the City the natural features and scenic values within the City boundaries to p1~otect and maintain the ecology of the area; to provide for the use and endoyment of the resources f~und here consistent with their preservation; to emphasize beauty, simplicity and serenity; and'to provideopportunities for interpreta,tion of natural history a~d local heritaqe, and I ' WHEREAS, t:.he Council has found that the fire hazard in Foothills J>ark is extreme arid the population.load in Foothills Pa:tk must be restricted, and·said park n\U:st be subject to reason­ able closing-hours and open only to residents of the City of . . . -' ! /.r . Palo Alto, NOW, THEREFORE, the Council of the city of Palo Alto does ORDAIN as follows: SECTION 1 • Chapter 2 2 • o 4· of the Pa lo Al to ~unic i pa 1 Code is hereby designated as 11 Park and P.ecreation :BuilcUng Use and - 2 \ -\ '· • Regulations" and is ~mended to read as set forth in EXHIBIT 1 attached hereto and made a part, hereof by reference. SEC~ION 2; Any person who violates any of the provisions of said Chapter 22.04 shall be quilty of a mi.sdem.eanor. ;·, SECTION 3. If any section, subsection, sentence, clause or phrase of said Chaµter 22.04 is for any reason held to be invalid ·or unconstitutional, such holdinq shall not affect the validity of the remaining portions of said chapter. The council hereby declares that it would have passed.said chapter, and each section, sub- section, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases had been declared invalid or unconstitutional, and if for any reason said chapter should be declared invalid or unconstitutional then the original ordinance or 6rdinances shall be in full force and effect. The purpose of this chapter is to regulate the use of the parks ·and' recreation buildinqs of the · · • City of Palo Alto in order that all persons may enjoy and make use of such parks and buildings and to protect the rights of those in the surrounding a,reas. 22.04.020 Definitions. The following words and phrases, whenever used in this chapter, shall be construed as defined in this section: (a) Parks,. The term "parks" shall include all gJ'.'OUnds, roadways, avenues, parks, and areas dedicated· under Article VIII of ·the Charter of the ci''Cy ·of Palo Al to, or any part, portion or area thereof. (b) Director of ComntUnity Services. The term "Ditector of Community Services" shall refer to the Managing Director of the Department of co:rtununity Services • . (c) Person.a. The term "persons" shall include persons, associations, partnerships, fJrms and corporations. . (d) Amplified Music. The term ·11 amplified-· music" means. music projected and transmitted by electronic equipment including amp11fiers, the tot."al ·output of which amplifiei;s, including the sumof the wattage output of' each channel, exceeds t~enty-five watts. ,' EXHIBIT 1 Page 1. ol 7 .' .r • (e) Amplified Speech. The tern "amplified speechri means speech projected and transmitted by electronic equipment including amplifiers, the total output of which amplifiers, including the sum of the wattaqe output of each chann_el, exceeds twenty-five watts. '(f} Permit. The term "permit" means a permit for exclusive use of parks or buildinqs as provided for and defined in this chapter. (g) Buildings. The term "buildings" includes those buildings, or any portion thereof, under the supervision of the Department of Community Services made available to exclusive use permittees. 22.04.030 Compliance~equired. No pe~son shall enter, be or remain in any park or tuildinq of the City of Palo Alto unless he complies with all of the regulations set forth in this chapter applicable tc· such park or building. 22. 04. 040 Exclusive Use of Parks. The cit·y' s parks shall be made available for the exclusive use of persons and groups subject to the issuance of a permit by the Dir~ctor and subject to the payment of fees therefor .. No exclusive use of any park for pre~advertised assemblies or groups consisting of twenty- f ive or more persons may be mad~ without the issuance-of a permit therefor. All applications for exclusive use of any park must be signed or co-siqned by an adult, which adult shall agree to be responsible for said exclusive use. No e~clusive use permit will be granted, if, prior to the time the application was filed, the City has scheduled a city-sponsored event at the same time and place as the activity proposed in the application. 22.04~050 ·Park Apelication. Any person applying for a park permit hereunder shall file an application for such permit with the Diractor not less than twenty days nor more than ninety days prior to the proposed use of said park. The Director may waive the twehty··day period if applicant waives all appeal ric.rhts. 22.04.060 Contents of Park Application. Said application shall contain the following: (a) Name of the applicant, the sponsoring organization, ~nd the name of the person in charge of the proposed activity. (b) The addresses and telephone numbers of those named in (a) above. (c) The park being applied·f6r. (d) The starting time of the proposed ·activity. Ce> The finishing time of the proposed activity., ( f) The number of persons expE:i:cted. (g) Additional city facilities requested such as personnel, tables, chairs, etc. (h) The nature of the proposed activity or activities .including :~quipment and vehicles·to be-brought into the park, "nature and· duration of th.e u~e of such equipment, nature .. and duration of the use of any amplified sound, whether speech or music. (i) Estimated number of parking spaces required. EXHIBIT 1. Paqe ~ of 7 • 22.04.0JO Action on Park Application. (a) The Directoi shall grant or deny such application on pr before four days after the filing of the application unless the time for such granting or denial of the permit has been - waived by the applicant in writinq. The decision granting or denyinq said application shall be mailed to the applicant by registered mail. · · (b) The Dire~tor shall grant the application when _it complies with the standards and guidelines which arc a.ttached . hereto and incorporated herein by reference, and desiqnated as EXHIBIT A, and upon grantinq any permit may impose reasonable requirements and conditions concerning the use of the park by applicant based upon EXHIBIT A. (c) Any ordinance passed pursuant to Article VIII of the Charter of the City of Palo Alto revising, changing, o~ initiatinq any plan for development of any park shall be deemed to ha,1e amended EXHIBIT A and said changed or newly initiated develop­ ments shall be made a part of EXHIBIT A. Such chanqe shall be reflected in EXHIBIT A and shall be made available to the public. The Director may grant the application for a park other than that applied for with the consent of the applicant in the event . that·. a 'perrni t;. In the event that more than one application is received for one park for use on the same day, the Director shall first act upon the application first received. (d) The Director shall deny the application,if he finds that any of the following conditions exist: 1. That the application reveals that the City has no park which will accommodate the activity of applicant pursuant to the standards and guidelines contained in EXHIBIT A. 2. That the proposed activity is of a size or nature that requires· the diversion of so great a number of police officers of the City to.properly police the areas,. as to ·hinder police protection to the City. 3. That the applicant has failed to agree to provide a reasonable means of informing all of the pers();ns·partici­ pating fn the proposed activity of the terms and conditions of such parmit. 4. That the applicant refuses to agree in;writint:J to comply with all conditions in.the permit. 5,.. That .the applicant fails ,to file a timely application, unless waived by Director and .. applicant waives all right of appeal~ Such denial shall specify the grounds ther§for •. _22.04.080 Exclusive Qse of a,uiidings. The· City's recreation buildings shall be r:nade:available for the exclusive use of in­ dividuals or groups subject to the issuance of a permit by the Director and subject to the payment of fees therefor' aS:· pro-. vided in EXHIBIT c. Closing times of each buildinq shall be set by the Director and shall be uniformly applied·. (b) The addresses and telephone numbers of those named in (a) above. (c) The room or building applied for. (d) The starting time of the proposed activity. (e) The f inishiriq time of the proposed activity. (f) The number of persons expected to attend the activity. (a} Additional city facilities requested such as personnel, tables, chairs, etc. (h) Nature of the proposed activity or activities, including equipment to be brouqht into the buildinq, and the nature and duration of the use of such equipment. 22.04.110 Action on Build~ng Application~ (a) The Director shall gr~nt or deny such application on or before four days after the' filirig of the application unless the time for such granting or det\ial of .the. permit has been waived by the applicant in writinq. The decision granting or d~nyi'rtg such application shall be mailed to applicant by reqis- tered mail. · , (b) The Director shall grant the application when the application contains information 'showing that the number 'of persons expected·at the activity complies with the occupancy load of the building as determined by Tit.le 16, Chapter 16.04 of the Palo Alto Municipal Code, and upon granting such permit may impose reasonab'i.a· req1~irement's and conditions concerning the use of said builtlihg with· respect to time and duration of use and nutnber·of ·persons allowed in the building~ . (c) The Director may gr(lnt the application fo~ a building other than that applied.for with,the consent of the applicant .in the event that·a permit has already been issued for·said building or that the building does not meet the occupancy load requirements. In the event that more than one application is · received for one building for use at the same tlme, the Director shall first act upan the-application first .. received. . {cl) The Director shall deny the application if he ~finds that any of the following conditions exist: 1 -· .. ·,. That the applicant refuses to aqree in writin~ to comply with the conditions in the permit. 3. That the applicant fails to file a timely appli­ cation, unless waived by Oirector and applicant waives all rights of appea~. Such denial shall specify the qrounds therefor. 22.04.120 · Right of Appeal. With respect to park and buildinq permits, an applicant may appeal the decision of the.Director to the City Manager. Applic.;imt must file said ·_appeal with the , City Manager within fj_ve days of the Director's mailing of such decision. The City Manager shall hold a hearinq within three days of the filing of said appeal at the off ice of the City Manager ~t which time applicant may present any and all e~idence, testi­ mony, and information relevant to the application. The City Manager shall within twenty-four hours,of said appeal hearing issue his decision either affirming the denial of the application or directing the Director of Community Services to issue a permit as applied for subject to the reasonable terms and conditions as outlined in Section 22.04.070 or Section 22.04.110 above. The decision of the City Manaqer shall be final and bindinq, and no further appeal shall be taken. The City Manager shall specify his grounds for denial. 22~04.130 Fees and Deposits. Upon the grantinq of a permit under this chapter, any fees ordeposits required for the use of city personnel, bui'ldings, equipment and facilities shall be contained in said permit and said fees or deposits shall be paid ·,by applicant within ten days of the receipt of said permit. If said. fees or depo:tits are not paid within said ten days, then in that event the permit theretofore issued shall be null and void.· ..: j 22.04.140 Liability, All persons to whon an exclusive use permit has been granted must agree in writing to hold the City harmless and indemnify cityerom any and all liability for injury to persons or property occuT,ring as'a-result of the activity sponsored by permittee and said person'-shall be liable to the City for any and all damaqe to-parks, facilities and buildinqs owned by city, which resuits from the activity of permittee or is caused by any participant in said activity. 22.04.'iso Foothills Park. Foothills Park shall not be made available. for exclusive use by any person save and except for Towle Camp and the Oak Gri::>ve Group Area. {a) Only residents of the-City of Palo Alto and their accompanied guests may be permitted in Foothills Park. . ' (b) Unless otherwise _specifically. authorized, en.trance to and exit from Foothills Park shall be made onl'v throuqh the main gatE! of Page Mill Road. -. . (c) The Director shall set opening and closinq times of Foothills Park, and no person shall remain in Foothills Park during any period when such park is closed. Said times· shall be posted at said park. -·.1 EXHIBIT 1 Page 5 of 7 ,, • (d) The maximum speed limit for all vehicles in Foothills Park is 15 m.p.h. ~ (e) All vehicles must be removed from Foothills Park prior to the time designated and posted for closinq of the park. ( f) Motorcycles, . motorbikes and similar vehic.les are. not pe.rmi tted in Foothills Park. ·{g} No person shail smoke on any· trail except in those areas so designated and posted. (h) No person shall start or maintain any fire within Foothills'Park except for ch•rc6~1 cookin1 fires confined to braziers and barbecues so desiqnated and posted. (i) No person shall shortcut across trail switchbacks. (j) The Director shall set and post rules and requlations for use of Boronda Lake, which rules and regulations shall be uniformly applied. (k) No more than two thousand people. are permitted in Foothills Park at any one time. ~2.04.160 Sales for Profit. No permit shall be issued authorizing the U.~e of any park or building hereof where the activity proposed is to be held for the sole purpose of advertis­ ing or sale of any product, goods, wares, merchandise, services or event and is desiqned to be held purely for private profit. 22.04.170 Violation of Permit. Violation of any of the terms and conditions of the permit by the permittee, or any· agent, servant or employee of the permittee, is a misdemeanor. 2:l~u4.180 Amplified sound. The use of any system for amplifying ·sounds, as defined. in s .. ~ctions 22 ~ 04. 020 (d) and (e), whether for speech or music or otherwise, is prohibited in any park unless .an exclusive USE\ permit is first secured. 22.04.190 Golf. No person shall play or practice golf or , use golf clubs. inany area of a park not designated for such use. 22.04.200 Model Airpfanes. No person shall operate any motor-driven model airplane in a park, except in areas desiq- nated fbr such u~~. · 22.04.210 Parking,, No person shall operate.or park any vehicle as defined in the California Vehicle Code within a park, except upon ~reas designated for such use. 22·. 04. 220 Bicycles and Animals. No person shalf 'operate, drive or ride ~pon any bicycle, unicycle, horse or any other. animal in any·· park except in areas desiqnated and posted speci- fically for such use~ , · ~22.04.230 Litte:r. No person within any park or build~ inq shall use or attempt-to use or interfere with the USE! of . any table, space or facility within said park or building:which at the time is reserved for any other person or group which has · received a per:mi t from the Director therefor. Unless the actual us~ of table~ space, area, buildinq,·or facillty ref~ried to in any such permit is comrnericed within o,ne hqur after the period covered by such permit beqins, such permit shall ·thereupon be void and all rights under such permit m(!y be cancelled by the ·Director. 22.04.250 Standards and Gui<lelines. No person shall engage in any activity 1n any park contrary to th~ ~tandards and guide­ lines s~t forth in EXHIBIT A or contrary to a plan for such park approved by ordinance pursuant to Article VIII of the Charter of the City of Palo Alto. 22.04.260 Weatons. No person shall discharge or shoot any firearm, air gun, s inqshot or bow and arrow in any park except at places designated and posted specifically for such purpose. 22.04.270-Flora. No person other than a duly authofized city employee in the performance of his duty or persons par­ ticipating in city-sponsored activities shall dig, remove, destroy, injure, mutilate or cut any tree, plant, shru~, bloom or flower, or any port.ion thereof, growing in any park. 22.04.280 Removal of Turi or Soil. No person other than a duly authorized city employee ln the performance of his duty shall remove any wood, turf, grass, soil, rock, sand o~ gravel from any park. 22.04.290 Mal",'kinq, Injuring or Disturbing An_y Structure. No person other than a duly authorized city employee in the.,, performance of his duty shall: ,, _,,.. ·· (a) Cut, break, injure~ deface, or disturb any rqck, building, cage, pen, monument,·. s iqn, fence, bench, structure, apparatus, equipment or property in a park • .. · (b) Mark or place thereon any mark, writing or printing. (c) Attach thereto any sign, card, distllay or other similar device, except as authorized by permit. 22.04.300 Fires. No person shall light or maint~in any . fire in any park unless such fire is lightEd and maintained only in a stove or fire circle or place prov.~ded for such purpose. 22.04.310. Solicitation. No person shall solicit in any manner or for an}r'-. purpose OJ: sell Or Offer for sale any 'goods 1 wares or merchandise in a1'1.y park, except as authorized 'by permit.
