ORDINANCE NO. 4372
ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING THE BUDGET FOR THE FISCAL YEAR 1996-97 TO
PROVIDE AN ADDITIONAL APPROPRIATION FOR THE FUEL STORAGE
TANK UPGRADE CAPITAL IMPROVEMENT PROJECT, 19205
WHEREAS, pursuant to the provisions of Section 12 of Article
III of the Charter of the City of Palo Alto, the Council on June
24, 1996 did adopt a budget for fiscal year 1996-97; and
WHEREAS, the Capital Improvement Project 1.9205; Fuel Storage
Tank Upgrade was created to bring City fueling sites into compliance
with local,, state, ~"1.d federal regulations; and
WHEREA..S, the appropriation to this CIP was previously increased
based on contractor·s estirn.ates to conduct the final phase of fuel
tank upgrading; and
t~REAS, at the corr~enc~~ent of the final phase of upgrade work
it was discovered that the fuel tanks included leak containment
systems which had not been documented in original tank work and
which are insufficient for leak containment; and
WHEREAS~ through further research it has been determined that
the safest and most appropriate course of action is to remove the.
current tanks and replace them with new tanks which contain leak
containment systems; and
WHEREAS, the budget needs to be amended to provide a.I?-
additional appropriation to Capital Improvem~~t Project 19205, Fuel
Tank Storage Upgrades, of $75,000 and funding is available in the
Vehicle Maintenance Fund Retained Earnings; and
WHEREAS, City Council authorization is needed to amend thf?
1996-97 budgr:~t as hereinafter set forth.
NOW/ THEREFORE~ the Council of the City of Palo A.lto does
ORDAIN as follows:
SECTION 1. The sum of Seventy Five Thousand Dollars {$75,000)
is hereby appropriated to Capital Improvement Project Noc 19205,

Fuel Tank Storage Upgrades and the Vehicle Maintenance Fund Retained
Earnings are correspondingly reduced.
SECTION 2. This transaction will reduce the Vehicle
Maintenance Fund Retained Earnings from $504~400 to $429,400.
SECTION 3. As specified in Section 2.28.080(a) of the Palo
Alto Municipal Code, a two-thirds vote of the City Council is
required to adopt this ordinance.
SECTION 4. This project has been
categorically exempt under Section 15302

determined to be

SE~IQN .5. As provided in Section 2.04.350 of the Palo Alto
Municipal Code~ this ordinance shall become effective upon adoption.
