ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
CALLING A SPECIAL ELECTiON .TO SUBMIT TO TUE ELECTORS
THE QUESTION OF DISCONTINUANCE OF THE USE OF CERTAIN
LANDS AS A PUBLIC PARK, AND REQUESTING CONSOLIDATION
OF SAID ELECTION WITH. THE 1968 GENERAL ELECTION
WHEREAS, pl.\rsuant to the requirements of Article VIII of the
Charter of the Cit~· of Palo Alto, the Council did by Ordinanct!
No. 2252 dedicate lands known as Byxbee Park and the City-owned
Baylands for pa1:k purposes, and
WHEREAff; the Council desires. to util i2e a po~t.ion Of said
lands, as delineated on the map· marked ExHIBIT A· attached hereto-,
and as more particularly described in EXHIBI'l' B .. attached hereto,
as a part of the site for the Joint sewage Treatment Plant, said
additional land being necesE.ary for the aesthetic development ·of
the total site in harmony with surrounding lands remaining
dedicated for park use, and ,.
WHEREAS, the Council by Resolution No. 4145 did determine
that the public interest or convenience requires the discontinuance
of the use as a public park of ··land· described in said exhibits
for the purpose hereinabove stated,· and
WHEREAS, the council by said Resolution.No. 4145 did announce
its intention to call_. an e.~E!ctj.Qn fer ·the purpose of submitting
th.~ question of such dis~onti~uance tu the city ·electors, and
WHEREAs·, the counc'il b.y ~aid Resolution No. 4145 .did £.ix
August 26, 1968 at 7:30-p.m. in the Council Chambers of the City

SECTION 1. A special election is hereby called to be held
in the City of Palo Alto on Tuesday, November s, 1968, at which
election the following proposition shall be submitted to the
electorate of said city:
Proposition._
Sha~l the area, presently a part of Byxbee P~rk
and the City-o~med B"y!ands, as described in Ordinance No~2454 of the counci.l of th.e City of Palo Alto1 on----
-f:i.l~ -in tha office of the-·city Clerk,. and comprising .
approximately 4.5 acres in total area, be abandoned
and discontinued for park purposes under authority of
Article VIII, Section 3, of the Charter of·_ the Ci t.y of
Palo Alto, so that said area can be utilized as a part
of the site for the Joint Sewage Treatment Plant?

SECTION 2. If a majority of the voters voting at said
special election shall vote in favor of said proposition, the
use of said land proposed to be discontinued for park purposes
as described in EXHIBITS A and B attached hereto shall be deemed
discontinued and abandoned for park purposes and the Council
shall thereupon adopt an ordinance so declaring and thereafter
said lanu shall be deemed owned by the City in fee.
SECTION ~-'the City Clerk is hereby or~ered to publish a
synopsis of said proposition in the PA.LO ALTO TIMES, a newspaper
of general circulation published and circulated in the City, in
substantial c9nformity with the requirements,of section 22835 of
the Electio{'.\><'COde, a1id to give any other notice of said election ,,
required by law.
SECTION 4. The board of Supervisors of the County; of.
Santa Clara is hereby requ$sted to order the consolidation of
said spacial park abandonment election with the generalt el_ection
