HomeMy WebLinkAbout1996-09-16 Ordinance 4368• • ORDINANCE NO.. 4368 ORDINANCE OF THB COUNCIL OF THE CITY OF PALO ALTO AMENDING CHAPTERS 22.04 AND 22.08 OF TITLE 22 OF THE PALO ALTO MUNICIPAL COOB REGULATING PARKS The Council of the City of Palo Alto does ORDAIN as follows: SECIIQN 1. The Council finds as follows: {a) Chapter 22.04 of the Palo Alto MUnicipal Code relating to Parks and Recreation Building Use and Regulations requires revision to reflect modifications to access, use, and hours of operation in several of th( ·:i.ty's parks and open space reserves necessary or desirable fort ·~and efficient public use; and, {b) Certain regulatory controls over parks and open space reserve usage are better addressed by deletion of legislative provisions and substitution of administrative regulat.ions affording greater detail and flexibility of control, and to facjiitate that process .lhile assuring public access to adopted regulations the City Clerk as well as the Director of Comnrun.ity Services should be designated to maintain the records of all parks regulations; and, (c) The names of certain of those parks dedicated for public park use in Chapter 22.08 of the Palo Alto Municipal Code should be amended to reflect current usage as follows: Cameron Park {formerly Berkeley Park)i Edith Eugenie Jolli~Son Park (formerly Downtown Park North) ; William C. Werry Park {formerly Rton Park} ; Frederick W. Weisshaar Park (formerly Hampton Park); Mayfield Park (formerly Hollywood Park.) i Don Segundino Robles Park ( fonnerly Mayfield Park); Juana Briones Park (formerly Arastradero Road Park); and John Boulware Park (formerly South Palo Alto Neighborhood Park) . SECTION 2. Chapter 22.04 of Title 22 of the Palo Alto MUnicipal Code is hereby amended to read as follows: CHAPTER 22.04 P~ AND RECREATION BUILDING USE AND REGULATIONS 22.04.010 Purpose. The purpose of this chapter is to regulate the use of the parks, open space lands, and recreation buildings O\<w"'led or controlled by the city in order that all persons may enjoy and make use of such parks, open space lands, and buildings and to protect the rights of those in the surrounding areas. 22~04.020 Definitions. The following words and phrases, whenever used in this chapter, shall be construed as defined in this section: 1 -----------------~-------------------------------- • • (a) •amplified sound• means speech. sounds, or music projected or transmitted by electronic equipment including amplifiers, loudspeakers, microphones, bull horns or s~ilar devices or combinations of devices which are intended to increase the volume, range, distance or intensity of speech, sounds$ or music and are powered by electricity, battery or combustible fuel; (b) "buildingstt means and includes those buildings, or any portion thereof, within any city park or open space lands made available to exclusive use permit holders; (c} "director• means the managing director of the department of community services or that director1 s designee(s); (d) "open space land" means any parcel or area of land owned or controlled by the city, which is essentially unimproved or in its natural state and devoted to an open space use as defined in Section 18.71~020 of the Palo Alto Municipal Code. {e) "park" means any park, playground, recreation and conservation lands and uses dedicated under Article VIII of the charter of the city, or any part~ portion or area thereof; (f) "permit" means a written authorization issued pursuant to this chapter for exclusive use of parks or park buildings or for other purposes as provided for and defined in this chapter; (g) "permit holder1'1 means a recipient of a permit issued pursuant to this chapter. (h} "person" means and includes association, partnership, firm or corporation. 22.04.030 Compliance required. an individual, No person shall enter, be or remain in any city park or open space lands except in compliance with this code and the regulations promulgated by the city manager. Any regulation promulgated by the city manager shall be filed with the city clerk and with the director and shall become effective on the fifteenth day following notice sent to the council, provided, however, that any regulation may be terminated or modified at any time by council resolution or ordinance. It is m1lawful for any person to disobey or fail to observe any park or open space lands regulation of which such person has actual notice, however given, or constructive not:i.ce through appropriate signs or notice in the park or open space lands. 22.04.040 Permits for use of parks and open s.pace lands. Buildings, facilities, and areas of city parks and open space lands shall be made available for the exclusive use of 2 • • persons and groups consistent with city code and regulation requirements subject to the issuance of a permit by the director and subject to the payment of fees therefor as provided in the Palo Alto municipal fee scht-'<iule. A park or open space land may not be used for pre-advertised assemblies consisting of twenty-five or more persons on either an exclusive use or non-exclusive use basis without a permit . applications for a permit must be signed or co-signed by an adult, who shall agree to be responsible for the activity. No permit will be granted, if, prior to the time the application was filed, the city has scheduled a city-sponsored event at the same time and place as the activity proposed in the application. No pe~it shall be granted for use of a park or open space lands by any assembly or assembly activity involving more than one hundred fifty participants from one hour before sunset until one hour after sunrise, unless the park has the appropriate program lighting as specified in park regulations~ 22.04e05 Permit application~ Applicants for a park permit shall file an application with the director not less than twa days nor more than one year prior to the proposed park use. 22.04.060 Reserved. 22.04.070 Action on permit application. (a) The director shall grant or deny a permit no later than four days after receipt of the application, unless applicant has waived the time for acting on the application in writing·. The decision to grant or deny the permit shall be mailed or delivered to the applicant promptly. (b) The director shall grant the permit when it complies with the requirements of this code and park regulations and may impose reasonable requirements ancl condition~ concerning the use of the park by applic~~t based upon those requirements. The director, upon the written advice of the chief of police that the size and activity of the expected crowd would require police personnel for crowd control in numbers that will leave other areas of the city unprotected, may impose a requirement for the applicant to provide crowd control monitors. The director may require a training progra~ for the crowd control monltors at a reasonable time and place set by the director prior to the proposed activity. The applicant shall, at the election of the chief of police, provide and pay for police personnel instead of crowd control monitors in the numbers approved by the director and chief of police in which case no training session will be required. (c) The director may accept a substitute application and issue a permit for a park other than that applied for if a permit has already been issued for the park originally requested or if that park does not meet the applicant's needs or is otherwise 3 96090.S l)'ll 0042639 • • unsuitable for the proposed activity. Applications for use of the same park on the same day shall be acted upon in the order received. {d) The director shall deny the application if any of the following conditions exist: (1) The activity applied for does not comply with the requirements of this code and park regulations; (2) The size or nature of the proposed activity requires the diversion of so many city police officers to properly police the event as to hinder police protection in other parts of the city; (3) The applicant has failed to agree to provide a reasonable means of informing all of the activity's participants of the terms and conditions of the permit; (4} The a.pplicant refuses to agree in writing to c~~ly with the conditions of the permit; (5) The applicant fails to file a timely application, unless waived by the director and unless applicant waives all rights of appeal. writing. Grounds for denial of an application shall be specified in 22~04e080 22 .. 04.090 22.04.100 22.04 .. 110 Reserved. Reserved. Reserved. Reserved .. 22.04.120 Right of permit appeal. An applicant may appeal the director's decision regarding a permit. to the city manager within five days of the date the decision was mailed or delivered to applicant. The city manager or designee shall hold a hearing within three days of the filing of an appeal, at which time applicant may present any and all evidence, testimony, and infonnation relevant to the director's decision . The city manager or designee, within twenty-four hours following the appeal hearing, shall issue a decision affirming the denial of the application or directing the director to issue a per.mit. The decision of the city manager or designee shall be mailed or delivered to the applicant when issued and shall be final and binding. 4 • • 22.04.130 Per.adt fees and depo8it8. Pees and charges required for all permits issued in connection with the use of city parks and open space lands shall be as stated in the Palo Alto municipal fee schedule. A deposit may be required by the director to be paid within ten (10) days after isscance of a permit, and if the deposit is not made within that time limit then the permit shall be null and void. Full payment of all fees for any city special equipment or personnel anticipated to be required when the permit was issued shall be made prior to the time permitted for the activity, and ~he permit shall be null and void if that payment is not made ~""-JL. to the time permitted for the activit.y. The director may require immediate and full payment for specified facilities and activities as listed in park regulations. Payment of entry fees to facilities, where posted, is required. A permit holder will be charged after the activity for any city special equipment or personnel the use of which was not anticipated at the time the permit was issued, and those additional charges shall be collectible as a debt owed to the city. 22.04.140 Liability of permit holders5 Permit holders shall agree in writing as a condition of the permit to indemnify and hold harmless the city, its agents and employees, from and against claims, damages~ losses and expenses, including but not limited to attorney's fees, arising out of or resulting from the activity for which the permit was granted. Pennit holders shall be liable to th.e city for any and all damage to parks, facilities or buildings owned by the city, caused by any participant or resulting from the activity for which the pennit wa.s granted. 22.04.150 Foothills Park. Foothills Park shall not be made available for the exclusive use by any persons except for Towle Camp and the Oak Grove Group Area, Pine Gulch Group Area, Wood Fern Group Area, and the Foothills Park Interpretive Center classroom. (a} Only residents of the city and regular or part-time city employees , members of their households related by blood, marriage, or adoption, and their acc~!ied guests are entitled to enter and retrain in Foothills Park. An "accompanied guest", as used in this section, is one who enters Foothills Park in the presence of a person entitled to enter and remain in Foothills Park. Each person entitled to enter and remain in Foothills Park may be accompanied by no more than 15 guests, or two vehicles containing no more than 15 guests, at any one time. Upon the request of an authorized city employee or a member of the Palo Alto police department, a person seeking to enter Foothills Park at the main gate or a person within the boundaries of Foothills Park shall provide identification or info~ation to satisfy the requirements of this suhse~tion. The good faith judgment of the authorized city employee or police department member requesting identification or information shall be conclusive as to whether 5 - • • such the identification or infonnation provided satisfies the requirements of this subsection. (b) Unless otherwise specifically authorized by the director, entrance to and exit from Foothills Park shall be made only through the main gate on Page ~11 Road. {c) Foothill Park shall he closed from sunset (the actual closure time to be prescribed in park regulations and posted accordingly) until 8:00 a.m. the following morning. No person shall remain in Foothills Park, other than duly authorized city employees and permit holders or participants in city-sponsored activities, during the hours of park closure. (d} No person shall exceed the maximum speed limit for all vehicles in Foothills Park of twenty miles per hour. (e) Unauthorized vehicles must be remov . .;:d from Foothills Park prior to the closing time designated and posted for closing of the park. {f) Bicycles and motorcycles are restricted to the paved roads of Foothills Park. Skateboards and roller skates and other coasting devices may not be ridden in Foothills Park. (g) No person shall smoke on any trail in Foothills Park~ (h) Wood fires are not allowed in Foothills Park without a permit. Permits for wood fires within Foothills Park may be issued only for the Towle campfire ring.. No person shall start or maintain any charcoal cooking fire within Foothills Park except in City-provided braziers and barbecues in areas so designated and posted. Ci) No person shall shortcut across trail switchbacks. (j) The city ~1ager shall promulgate regulations for the use of Boronda Lake to protect the users, plants, animals, and structur~s of the lake~ (k) No more than one thousand people shall be permitted in Foothills Park at any one time. {1) No person owning or harboring any dog shall allow or permit such dog to enter or be in Foothills Park on any holiday, as defined in Section 2.08.100(a} of this code, or any Saturday or Sunday. At all other times, no person owning or harboring any dog shall allow or permit such dog, whether licensed or not, to enter or be in Foothills Park except when held under leash by an able- bodied person. 6 960905 I)'D 0042639 • • 22.04.155 Dog• in city parka and open apace landa. (a) No dogs shall be allowed in a park or open space lands, or portion thereof, where prohibited by park regulations and where eigne prohibiting dogs are posted. (b) It is unlawful to permit c.r allow a dog to pursue any undomesticated mammal or bird in any city park or open space lands. Palo Alto police officers, animal control officers and park rangers may capture or destroy a dog inflicting injury or threatening to inflict injury upon any undomesticated mammal or bird within city parka or open apace lands. Owners of dogs with ide."'ltification that have been captured or destroyed pursuant to this section shall be notified within seventy-two hours after capture or destruction. No crimdnal or civil liability shall accrue to any city employee as a result of enforcement of this section. 22.04.160 Commercial activities and solicitat~.on .. (a) All commercial activities; including advertising or solicita.tion for commercial purposes, is prohibited in parks and open space lands except for co~.ercial activities associated with and supportive of city programs or city-sponsored activities for which a permit has been issued by the director. (b) Commercial activities, commercial solicitation, and solicitation for donations shall comply with all applicable laws, including those requirerdents for permits issued under Chapte:r 4 of the Palo Alto Municipal Code. 22~04.170 Violation of per.mit. Violation of any of the terms or conditions of a permit issued pursuant to this chapter by a permit holder, or any agent, servant or employee of the permit holder, is a misdemeanor. 22.04.180 .Amplif~.ed sound .. No person shall operate any device or sound amplification equipment in city parks or open space lands emitting sound in excess of the limits allowed under section 9.10.050 of this code. The director may restrict the use of sound amplification devices in connection with a..'ly activity for which a permit is required, and such restrictions ~ay include constraints on capacity, volume, emission spectrum, location and arrang~ent, when such restrictions are designed to reduce the noise impact on adjacent land uses. 22.04.190 Golf and other games. No person shall play or praccice golf or use golf clubs or lawn darts, horse shoes, or baseball games in any area of a park or open space lands not designated in park regulations for such use. 7 960905 ayn 0042639 • • 22.04.200 MOdels, kites. (a) No person shall operate any motor-driven or radio controlled model airplane, helicopter, boat, car, truck, or s~ilar object in a park and open space lands, except in areas designated by the director in park regulations. (b) ~ite flying is prohibited in city-owned baylands and Byxbee Park .. 22.04.210 Vehicle operation and parking. No person shall operate or park any vehicle, including motorized vehicles, bicycles, and other vehicles as defined in the California Vehicle Code, within a park or open space lands, except in areas designated for such use without written permission of the director. City crews performing park ~aintenance work are excluded.. No person shall operate any vehicle in excess of twenty miles per hour in any city park or open space lands. No person shall access or use City utilities (electrical and water), within a park or open space lands, to power motor vehicles or equipment without the written permission of the director. 22e04.220 Bicycles and animals. (a} No person shall operate, drive or ride a bicycle, unicycle, skateboard or other coasting device, horse or any other ani~.l in a park or open space lands except on established paths or walkways, unles~ expressly penni t ted to do so pursuant to park regulations. (b) Persons riding horses shall properly dispose of horse manure dropped from the animal they are riding by removing it to the side of the levee, trail or road. (c) Skateboards, roller skates, or other coasting devices shall not be operated in open space lands. 22.04.230 Litter. No person within any city park or open space lands shall leave any garbage, trash, cans, bottles, papers or other refuse elsewhere than in the receptacles provided therefor. 22.04.240 Interference with per.mitted activities. No person shall use, or attempt to use, or interfere with the use of any table, space, building or facility within a park or open space lands which at the t~e is reserved for a permit holder. The per.mit shall become void and the director may cancel the permit holder's rights thereunder if the table, space, building or 8 96090:5 1)'11 0042639 • • facility referred to in the pennit is not used within one hour after the time provided in the per,mit for the activity to begin. 22.04.250 Standards and guidelines. No person shall engage in any activity in any park or open space lands contrary to the regulations promulgated by the city manager or contrary to a plan for such park approved by ordinance pursuant to Article VIII of the charter . 22.04.260 Weapons. (a) No person shall discharge, fire or shoot any device listed in Section 9.08.010 in any park or open space lands. 22.04.270 Plora, fauna~ (a) No person other than a duly authorized city employee or persons participating in city-sponsored activities shall dig, remove, destroy, injure, mutilate or cut any tree, plant, shrub, bloom or flower, or any portion thereof, growing in any park or open space lands~ without ·w-ritten co:.1sent of the director. (b) No person shall take, seize, molest, injure, or hunt a bird, reptile, or animal in any city park or opens space lands, except as authorized by park regulations or by written consent of the director. 22.04.280 Removal of turf or soil. No person other than a duly authorized ctty employee shall remove any wood, turf, grass, soil, rock, sand or ~ravel from any park or opens space lands, except as authorized by park regulations or by written consent of the director. 22.04.290 Bntering, marking, injuring or disturbing park or open space lands. No person other than a duly authorized city employee shall: (a) Cut, break, injure~ deface, or disturb any rock, building, cage, pen, monument, sign, fence, bench, structure, apparatus, equipment or other property in a park or open space lands; (b) Mark or place any nark, writing or printing on a rock, building, cage, pen, monument, sign, fence, bench, structure, apparatus, equipment or other property in any park or open space lands; (c) Attach any sign, card, display or other similar device to s.i. rock, building, cage, pen, monument, sign, fence, bench, structure, apparatus, equipment or other property in any park or open space lands, except as authorized by permit. 9 • • {d) Bnter or remain in a building or structure which has been closed, or after the operating hours designated in park regulations and posted in the buildi.ng or structure. (e) Bring into or use in any park or open space lands portable tables or other fixtures designed to increase the capacity of picnic facilities without a permit authorizing those additional tables or fixtures. 22.04.300 Pire• in city parka and open space lands. {a) Lighting or maintaining a fire within any park or open space lands is prohibited, except that a charcoal fire may be lighted or maintained in those barbecues, fire rings, or similar fixtures placed in the parks by the city specifically for such purpose. Portable barbecues, gas stoves or lanterns, other fixtures for lighting or maintaining fires may not be brought into or used in any park or open space lands without a per..1nit. 22 .. 04.310 Ar&stradero Preserve, Esther Clark Park closed from sunset until 8:00 a.m. Arastradero Preserve, and Esther Clark Park shall be closed from sunset (the actual time of closure to be designated by the city manager in park regulations and posted accordingly) until 8:00 am the following morning. No person shall remain in these park and open space landsi other than duly authorized city employees and permit holders or participants in city-sponsored activities, during the hours of closure. 22.04.315 8yxbee Park and City·owned baylands closed from SWl.Set to 8: 00 aa. Byxbee Park and the City-owned baylands shall be closed from sunset (the actual time of closure to be designated by the city manager in park regulations and posted accordingly) to 8:00 am. No person shall remain in these park and open spacs lands, other than duly authorized city employees and permit holders or participants in city-sponsored activities~ during the hours (,i closure. 22.0,5320 Parks closed, ten-thirty p.m. -Sunrisee Except as provided under this code, no person shall use, remain in or enter any park or building between ten-thirty p~m .. and sunrise, other than a duly authorized city employee or persons participating in city-sponsored activities or other activities for which the city has provided written permission to utilize a park beyond the closing time, provided however that the closure of specific facilities during portions of th~ day or the year may be specified by park regulation. 10 • • 22.04.321 JobD Luca• Gr .. r Park -U•• of or trespa•• at skateboard facility prohibited wbeD cloaed. (b) Por purposes of this section~ the term •skateboard facility• shall mean the fence and the entire fenced area surround· ing and including the skateboard bowl and the land adjacent to the skateboard bowl, located in John Lucas Greer Park. The boundaries of Greer Park are set forth under Section 22.08.010 of this code. (c) This section does not apply to any duly authorized city employee. (d) Any person who violates this se:-tion is guilty of an infraction and upon convict ion thereof suall be punished as provided in Section 1. 08.010 of this code. Each violation constitutes a separate offense and rray be separately punished~· 22.04. 322 Rincona.da Park -Use of or trespass at pool facility prohibited when closed. (a) No person shall use, remain in or enter the pool facility located within Rinconada Park during all closed hours specified in park re~ulations. A notice indicating any times or period when the pool facility is closed shall be posted at the pool facility. (b) For purposes of this section, the term •pool facility" shall mean the entire pool complex known as "Rinconada Pool," within Rinconada Park. . (c) This section does not apply to any duly authorized city employee or to any person participating in city-sponsored activities or other activities for which the city has provided written permission to utilize the pool facility beyond the closing time. (d) Any person who violates this section is guilty of an infraction and upon conviction thereof shall be punished as provided in Section 1. 08.010 of this code. Each violation constitutes a separate offense and may be separately punished. 22. 04.33 0 Cog.well Plaza -Consumption of alcoholic beverages prohibited. (a) It shall be unlawful f,,>r any person to consume any alcoholic beverage (1) in Cogswell Plaza, bounded by Bryant and 11 96090!5 syn 0042639 • • Ramona Streets and Lytton Avenue; or (2) in the public parking lot located along Ramona Street adjacent to Cogswell Plaza. (b) Any person who violates this section is guilty of an infraction and upon conviction thereof shall be punished as provided in Section 1 .. 08.010 of this code. Each violation constitutes a separate offense and may be separa.tely punished. 22.04.331 Lytton Plaza Consumption of alcoholic beverages prohibited. (a) It shall be unlawful for any person to consume any alcoholic beverage in Lytton Plaza, bounded by University Avenue, Emerson Street and Parking Lot P. (b) Any person who violates this section is guilty of an infraction and upon conviction thereof shall be punished as provided in Section 1.08.010 of this code. Each violation constitutes a separate offense and may be separately punished . .2 2 • 04 .. 3 3 2 Edith Bugenie Johnson Park ... Consuapt!on of alcoholic beverages prohibited. (a) It shall be unlawful for any person to consume any alcoholic beverage in Edith Eugenie Johnson Park. (b) Any person who violates this section is guilty of an infraction and upon conviction thereof shall be punished as provided in Section 1. 08.010 of this code. Each violation constitutes a separate offense and may be separately punished. 22.04 .. 333 Boulware Park--Conauaption of alcoholic beverages prohibited • (a) It shall be unlawful for any person to consume any alcoholic beverage in that park known as Boulware Park. (b) Any person who violates this section is guilty of an infraction and upon conviction thereof shall be punished as provided in section 1. 08.010 of this code.. Each violation constitutes a separate offense and may be separately punished. 22.04.335 John Lucas Gz·ear Park .. Consullption of alcoholic beverages prohibited in skateboard facility. (a) It shall be unlawful for any person to consume any alcoholic beverage in or upon the skateboard facility, located within John Lucas Greer Park. (b) For purposes of this section, the term •skateboard facilityn shall mean the fence and the entire fenced area surround- ing and including the skateboard bowl and the land adjacent to the skateboard bowl, located in John Lucas Greer Park. 12 96090!! syn 0042639 • • (c) Any person who violates this section is guilty of an infraction and upon conviction thereof shall be punished as provided in Section 1. OS. 010 of this code. Each violation constitutes a separate offense and may be separately punished. 22.04. 336 l.inconada Park Consumption of alcoholic beverages prohtbited without a permit. (a) Except as provided in subsection (b) of this section, it shall be unlawful for any person to consume any alcoholic beverage in that park known as Rinconada Park. {b) Notwithstanding subsection (a) of this section, alcoholic beverages may be consumed in Rinconada Park only in accordance with, and subject to the conditions set fortn in, a per.mit granted by the director that allows such consumption in all or part of the park. No such permit shall be granted if the director determines that issuance of the permit would interfere with normal operations or usage of 'i.:he park or would otherwise threaten the public health, safety, convenience, or welfare. The director shall require an applicant for such a permit to furnish any information necessary to review and consider the application. The director shall further require the applicant to provide insurance naming the City of Palo Alto as an additional insured party to the policy, with minimum coverage as required by the city risk manager, as a condition to issuance of the permit. (c) Any person who violates this section is guilty of an infraction and upon conviction thereof shall be punished as provided in Section 1. 08.010 of this code. Each violation constitutes a separate offense and may be separately punished. 22.04.337 Mitchell Park Consumption of alcoholic beverages prohibited without a per.mit. (a) Except as provided in subsection (b) of this section, it shall be unlawful for any person to consume any alcoholic be"'~<"'erage in that pc..rk known as Mitchell Park. (b) Notwithstanding subsection {a) of this section, alcoholic beverages may be consumed in Mitchell Park only in accordance with, and subject to the conditions set forth in, a permit granted by the director that allows such consumption in all or part of the park. No such permit shall be granted if the director determines that issuance of the per.mit would interfere with normal operations or usage of the park or would otherwise threaten the public health, safety, convenience, or welfare. The director shall require an applicant for such a permit to furnish any information necessary to review and consider the application. No person, except City staff, their agents or where authorized by permit, shall drive a motorized vehicle or moped upon park or open space lands owned and/or controlled by the city unless he or she holds a valid drivers license issued under the provisions of the california Vehicle Code. No person shall perform any maintenance or repairs to any motorized vehicles (other than in emergencies) upon park or open space lands owned and/or controlled by the city. No person, except city staff, their agents or where authorized by permit, shall operate any electric power generators {other than those integral to motorized vehicles} upon park or open space lands owned and/or controlled by the c:i.ty. 22.04.350 Consumption of alcoholic beverages prohibite~ in JDOtor vehicles. (a) It shall be unlawful fo:t· any person to consume an alcoholic beverage while in a motorized vehicle or upon a moped, in any park or open space lands. (b) Any person who violates this section is guilty of an infraction and upon conviction thereof shall be punished as provided in Section 1. 08.010 of this code. Each violation constitutes a separate offense and may be separately punished. 22.04.360 Storage of opened container. It. is unlawful for the r,:gistered owner of any motor vehicle or moped, or the driver if the registered owner is not present in the vehicle, to keep any bottle, can, or other receptacle containing any alcoholic beverage which has been opened, or the seal broken, or the contents of which have been partially removed, inside a motor vehicle or moped within a park or open space lands, unless such the container is kept in the trunk of the vehicle or in some other area of the vehicle not normally occupied by the driver or passengers if the vehicle is not equipped with a trunk. A utility compartment or glove compartment shall be deemed to be wi.thin the area occupied by the driver and passengers. This section shall not apply to the living quarters of a motor home or camper. 22.04.370 Reckless driving prohibited. No person shall drive any vehicle, bicycle or moped upon park or open space lands owned or controlled by the city in willful or wanton disregard for the safety of persons or property. such conduct shall constitute reckless driving. 14 • • No person shall: (a) While driving a motor vehicle, knowingly per.mit any person to ride on such vehicle or upon any portion thereof not designed or intended for the use of passengers; or (b) At any time, ride on any moving vehicle or upon any portion thereof£ not designed or intended for the use of passen· gers. 22.04.390 Duck pood. Entry to the fenced nesting area north of the duck pond located in the Yacht Harbor is prohibited, except for city employees or contractors in connection with city business. ~Ec:riON_J. The purpose of this chapter is to implement Article VIII of the charter providing for the preservation of city lands which are used or intended to be used for park, playground, recreation or conservation purposes, and providing the electorate an opportunity to pass upon proposals to discontinue or change such actual or intended uses or to improve such lands. This chapter shall be liberally construed to effectuate its purposes. 22.08.002 Definition. The word •park• as used in this chapter and in the general laws hereinafter referred to, in every case means and includes park, playground, recreation and conservation lands and uses. 22.08.003 Lease, abandonment, disposition of parks--State law to govern. Lands owned or controlled by the city which are used or intended to be used for park purposes shall be sold, leased or otherwise disposed of, o:r· their use abandoned or discontinued only in accordance with the provisions of this chapter. Except as otherwise provided in the charter, the general laws of the state of California as they existed January 1, 1965, authorizing municipal corporations to abandon or discontinue the use of lands dedicated or placed in use for park purposes, authorizing-the sale or other disposition of such lands, and providing procedures therefor and for matters relating thereto (designated as Government Code 15 • Article 2, Chapter 9, Part 2, Division 3, Title 4, commencing at Section 38440) shall be applicable to the city of Palo Alto and to all lands owned, used or held by it for park purposes, and said laws shall govern and control exclusively in respect thereto. 22.08.004 Ordin&Dce required. The council shall by ordinance prepare a list setting forth in separately numbered sections the common name or other designation and the legal description of each site~ parcel or area of land owned or controlled by the city which is used or intended to be used for park purposes.. Bach section shall be accompanied by a map or plat of the land des::ribed. and said ordinance shall contain a statement that the lands listed thereon are reserved for park, playground, recreation or conservation purposes pursuant to this chapter. As additional lands are acquired or held by the city for park purposes, they shall likewise, by ordinance and without d~lay~ be added to said list and subject to the provisions of this chapter. Any such ordinance may be proposed pursuant to the initiative provisions of Article VI, Section 2, of the charter. 22.08 .. 005 Ordinance required for substantial building, construction, etc~ Before any substantial building, construction, reconstruction or development is commenced or approved, upon or with respect to any land held by the city for p-ark purposes~ either by the city or by a lessee, licensee or permittee thereof, the council shall first cause to be prepared and by ordinance approve and adopt a plan therefor. All leases, licenses and permits with respect to land held for park purposes shall contain provisions requiring compliance with this section~ ~rhe plan shall be prepared in such a manner and with sufficient detail and particularity to show, as applicable, the nature, function/ size~ extent and general appearance of the proposed project. Any change in the plan shall be prepared in the same manner and adopted by ordinance~ 22.08.006 Ordinance subject to referendua. Whenever in this chapter action is re~4ired to be taken by ordinance, such action shall be subject to the referendum provisions of Article VI, Section 3, of the charter 1 irrespective of whether such action would be characterized aa legislative, administrative or otherwise. The Council find~s and declares: A. The protection, er~ancement, perpetuation, and use of structures, districts~ and neighborhoods of historical and architectural significance within the City of Palo Alto are of great cultural, aesthetic, and economic benefit to the City and all of its residents. B. The City Council and the City's Historic Resources Board have recognized that the current Historic Preservation Ordinance does not adequately protect certain historic resources within the City. Accordingly, the City Council in June 1996 approved a work program for updating of the City's Historic Preservation Ordinance {to occur in 1996-1997) and the City's historic resources inventory (to occur in 1997-1998). The work program will include consideration of new regulations affecting residential structures of historical and/or architectural merit. C. It is necessary for the preservation of the public health and. safety to enact as an urgency measure an ordinance imposing restrictions on the demolition or substantial reconstruction of pre-1940 residential structures during the interim period before revisions to the Historic Preservation Ordinance and historic inventory are effective. The reasons for the urgency are as follows: 1. The pendency of the ordinance revisions, which may limit the ability of property owners to demolish older residential structures in the City, will encourage some persons to cause such demolition in advance of the effective cl--:.e of the ordinance revisions, thereby undermining the City's protection efforts; and 2. In any civil action brought pursuant to this Ordinance in which the City prevails, the court shall award to the City all costs of investigation and preparation for trial, the costs of trial, reasonable expenses including overhead and administrative costs incurred in prosecuting the action, and reasonable attorney fees. {b) The following designated employees may enforce the provisions of this Chapter: Chief Building Official, Assistant Building Official, Code Enforcement Officer. SECTION 6. Effective Date~ This ordinance shall be effective immediately upon adoption and shall cease to have force and effect on November 15, 1996, or the effective date of an ordinance readopting or repealing the provisions hereof, whichever date earlier occurs. SECTIOJL2.
