The Council of the City of ~alo ~to does ORDAIN as
follows:
SSCIION 1. The City Council finds as follows:
{a) The activity of soliciting employment, business or
contributions f:t.·om pedestrians in public parking lots or from
occupants of vehicles traveling or parked within public parking
lots distracts those pedestrians or vehicle drivers and passengers
from their primary duty to watch traffic and be alert for potential
hazards in the roadway and to observe all traffic control signals,
signs or warnings; and,
(b) The practice of soliciting employment, business or
contributions from pedestrians or from occupants of vehicles
impedes the flow of traffic on the public parking lots within the
city, results in the delay and obstruction of the public's free flow
of travel, and results in congestion and blockage of the parking
lots when solicitors approach the pedestrian or vehicle; and,
(c) Distracted pedestrians and drivers are more prone to
be involved in traffic accidents, which impedes and prevents the
orderly flow of traffic and is unsafe not only for the solicitor
but also for pedestrian traffic and automotive traffic generally;
and~
{d) 't'he cumulative impact of this type of activity on the
parking lots on a daily basis has created a potential safety hazard
which poses a significant and substantial risk to the interest of
the public.
SECTION 2. Chapter 9.44 of the Palo Alto Municipal Code
entitled •Handbills, Advertising~ and Samples" is hereby repealed
in its entirety and a new Chapter 9.44 of the Palo Alto Municipal
Code entitled ·solicitation of Employment, Business, or
Contributions within Public Parking Lots", to read as follows:
~9~44.010 Solicitation prohibited.
It shall be unlawful for any person to solicit or
attempt to solicit employment, business or contributions of
money or other property from any pedestrian or occupant of
a vehicle located within any public parking lot.

9.44.020 Solicitation defined.
The te~ solicitation as used in this chapter shall
mean and include the activity of requesting, offering,
advertising, or otherwise announcing the availability of a
person for employment or availability to provide services
for compensation, the sale of goods, or a request for money
or other property; or requesting, offering, advertising, or
otherwise announcing the intent to purchase or secure
employment, to sell services or goods, or to solicit a
contribution of money or other property. A solicitation
shall be deemed c~lete when made or attempted, whether or
not an act~al employment relationship is created, a
business transaction is completed, or a contribution of
money or other property takes place.~
SECTIQN 3. The Council hereby finds and dete~Eines that
this ordinance is exempt from environmental review pursuant to
section 1506l(b) (3) of the State CEQA Guidelines implementing the
California Environmental Quality Act of 1970; as amended.
