(68-ZC-3) l. Background: ·'."-. On February 8, 1967 the City Manager reported to the City Council that the former fire stat ion had no known municipal ~se at that time and recommended that the Council request the Planning Com­ mission to study the matter and submit recommendations as to its potential use and zoning. Upon direction from the City Council, the Commission stu~ied the matter and recorranended "that inasmuch as the Commission has not made a recent study of the California Avenue Area and since such a study is in the offing, the old Fire Station ~o. 2 property be retained by the City as far as title is concerned and that consideration b"' given to leasing. it for compatible purposes on an -interim, short-t.:erm basis. Th,e City Council accepted the Commission reconnnendation and referred the matter back to the Commission for a public hearing to consider re~oning the property to M-l:S and/or such other district as the Commission may recounnend and directed the City Manager to Nolicit lease pro­ posals in agreement with the zoning and usage of the property to be established. \'. The Planning Conmission held a public hearin'g to consider re­ zoning the property on July 26, '1967 and heard an appeal tQ use the fire station for a teen center. The Commission adopted a motion that the zoning remain P-F and that special consideration -be given to use the premiSes as a 'teen center. On August 7, 1967 the City Council adppted a motion that no change be made in the zoning pe'tlding receipt of a report from a teenage advisor~ committee. After thorough si:udy, the Teenage Advisory Committee rejected the site a[, :'a te:enage drop-in center because of poor location, lirnited access, high cost and small size. Consequently, _on February 5, 1968 the City Council· referred the matter back to the Planning Commission 'for review. pf zoning. . · ., ' 68-ZC-3 -p, 'IF2 • / ~: 2. Qiscussion~ As. 'l:"eported in February, 1967 by-di~:_ t!ity Manager, there is no known municipal use for the '?rop·.irty. A study of the California Avenue Area, as indi.!at<!d-'by the Planning Com­ mission when thev recommended an-1.nterim ohort-term lease, may or may not t~rn up an appropriate municipal use. The property does not belong to the California Avenue Parking Assessment District and if used for private connnercial or business uses would be obliged to provide for its own parking demand. _, 3. Recomr:lendation: It is recommended that the property be rezoned from P-F to M-l:S, in harmony with the M-l:S zoning of the properties on either side, to allow an interim revenue~prod•;cing use pending a study of the California Avenue Area. (68-ZC-3) The Planning Offi~er requ~sted the record to show that the Notice of Public Hearjng had been published and mailed as required by the Zoning Ordinance, that the e\•idence of publication and Certificate of Mailing were on file, and th~t the report of the Planning Officer had been mailed to the Com­ missioners, was available at the 'entrance, and was made part of the record by reference. He reviewed his March 22nd report which recoannended rezoning to M-l:S to harmonize with zoning of properties ·on either side to allow an interim revenue-producing use. · In reply to CoDBDissioner, ".;rench 1 s question as to wheth'er a logical alternate choice in looking at the zoning map Yould be C-2! Commissioner G_ri!nch asked about the effectiveness of applying a "D" suffix. over a lease to obtain unusual control',iof development because of its being City-owned property; and the Planning Officer replied that the City would have control via the lease and that assigning a "D" suffic would, in essence, result in a situation where the. City would be exercising control over it- s elf having to go ~l'l:ro_ugh the Planning Commission, etc. Chairman Stromquist declared the Public Hearing open. Mrs. Barbara Kline, Coordinator of Public Affairs of the Mental Research Institut~, 5?5 Middlefield Road, said their non-profit facilities would be interested in exploring sponsorship of a teen-adult interaction cent'er utilizing the location under discussion. She asked whether rezonini'S to M-l:S would allow such use by their organization on a lea~e basis •. The Planning Officer said that, if anythlngt rez()ning wou'ld facilitate ··\rather than prohibH such, use sines it would not ;.be allowed at all under 'the present P-F zoning. He noted that the Commission, however, did not have the assignment of selecting partiCular uses. The Assistant City Attorrtey said that it seemed tfiat the M-l:S zoning would allow such a cr:nter, but that he woul<l have to k11ow more about the func:t ions. · No one else wishing to speak, Chairman Stromquist declared the Public Hearing closed. (68-ZC-4) The Assistant Zoning Administrator requested the r~cord to show that the Notice of Public Hearing had been published and mailed as required by the Zoning Ordinance, that the-evidence of publication anrl Certificate of Mailing were on file, that the report of the Planning Officer had been mailed to the applicants and the Commissioners, was available at the entrance and was made part of tho record by reference. He reviewed the -March :22nd report of the Planning Officer and referred to the displayed plan, which he noted they were not obligated> to use if rezoned as requested. He explained the problem qf the two double driveways entering on Mi4,cHefield Road and the staff r~pcrt recomm~ndati.on that then: should ncit be more than one two-way or two one-way driveways on Middlefield Road, which asp~ct . could b_e contr.<;>lled by an 0-A zone (requfring a Use Permit). He referred ·to the resolution draft recollllllending reclassification to M-l:S and o-A (Open Area District 'Regulations) as a good solution to the problem of uses of the subject p~op~rty. · Conmis1ion.er Gren".h was concerned that putting in the 0-A strip might negate the landscaping requirement to protect the R-DUP zone from the ·M-l:S zoning because of their 1~separation by ilnother zoning. The Assistant Zoning Administrator said that the 0-A>:~one wquld require a Use Permit to al low ~ driveway or off-=street parking ":.ind t:hal the Use Permit co:.ild better controt the planting by d~quiring a de'ta,H~d landscape plan. In reply to a question, the Planning Officer said that a. Use Permit would_ require at least te)n "feet of· plo\'lnting in this· 24-foot 0-A ·z-on~ since it would not seem equitable to reql:iire more than required ~n an M~l ~OJ.Je .. and at the same time the Use Permit would be able fo ·control the ddveway situation.
