. AN ORD!NANCE AMENDING SECT ION 12 ~ 16_. 020 OF CfiAPTER
12.16 OF TITLE 12 OF 11IE PALO ALTO MUNICIPAL CODE
BY ESTABLISHING UNDERGROUND UTILITY DISTRICT N0.5
The Council of the City of Palo Alto, California, does ordain as
follows:
.WHEREAS, this Council did, on February 5, 1968, adopt its Resolu
tion of Intention tlo~ 4070 to establish Underground Utility Di~strict
No. 5 in said City and appointed Mondayj the 11th day of March, 1968,
at the hour of ?:30 o'clock P.M., in the Council Cham'bers, City Ha.:11,

Palo Alto, California, as the time e.nd place of hearing protests and
rec~iving evidence for and against said proposed action and directing
;;notice;
WHEREAS, notice was givert --of the time and place therein stated
in the manner provided by law, as appears from the affidavits on file
in the office-of the City Clerk;
WHEREAS, said matter came on regularly for hearing at the time
· therein fixed; and
WHEREAS, all written protests and other wri.tten communic,ations
were publicly read at. said meeting and evidence duly tafen and all
persons desiring to be heard were fully heard;

NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows:
lo That the publi~ necessity, health and safety require the
removal (1f poles arid overhead lines and associated overhead 1structur~s
from that certain area described in sai'd Resoiution of Intention
No. 40700
2. That this Council .. fut~ther finds and det.~rmines that suc::h
undergrounding is LYl the generil·1 public interest for all of the fol-
lowing reasons:
Such uridergrouriding will eliminate an unusually heavy
concentration of overhead distri butlon facilities;
· Said portion of_ El Camino. Real is extel"tsively used by
.the general public and carries a heavy volume of
·pedestrian-and vehicular traffic;
Said portion of El Camino Rea~. adjoins ·and passes
through a civic area.

3. '11hat Ser. ti on 12 .16. 020 of Chapter 12 .16 of Tl tle 12 of the
Palo Alto Municipal Code is amendea by adding Subsection (5) thereto,
.said Suboect.ion (5) to read as .follows:

"(5) District No. 5. All lands with1.n the limits of the
City of Palo Alto fronting on the south:westerly side of El
Camino Real between Maybell AvenLe and Vista -Avenue 5 removal
.by May 15, 1968. 11
4. That the "Underground Uti.lity District Maps" referred to in
said Section 12.16.020, shall be amended to add the areas shown on the
map referred to in sa.1-d Resolutlon No." 4070.
5. That this Ordinance in necessary as an emergency measure
for preserving the public peace, health and safety. The reasons for
its urgency are:
An urgent public health and safety proclem has been
created by traffic conditions on El Camino Real. The State of
California, the .county of se.rlfa Clara and. the Cities of Palo
.Alto, Mountain View and Los Altos have undertaken a joint pro
gram to improve El Camino Real and alleviate such conditions.
