HomeMy WebLinkAbout1996-01-16 Ordinance 4327• • ORDINANCE NO . 4327 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE B';tJGET FOR THE FISCAL YEAR 1995-96 TO PROVIDE AN AVDITIONAL APPROPRIATION FOR PLANNING AND ATTORNEY SUPPC'RT TO CONTINUE PREPARATION OF THE TRANSFER OF DEVELOPMENT RIGHTS ORDINANCE WHEREAS, pursuant to the provisions of Section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 19, 1995 did adopt a budget for fiscal year 1995-96; and WHEREAS, the City Council has reviewed the Planning Department's 1995-96 workplan, and has requested the department place a high priority on the preparation of the Transfer of Development Rights {TDR) Ordinance; and WHERE..~S I the Planning Department and the City At t.orney ~ s Office require contract assistance to complete this assignrnent; and WHEREAS, the scope of work for the contract planner for this assignment includes implementing seismic and/or historic upgrade incentive programs for the rehabilitation of buildings in the Downtown area: and WHEREAS I the costs of this contract :9la"lller support for the Planning Department are $22,800; and WHEREAS, the City Attorney's Office will be impacted by the additional work in the Planning Department~ and does not have the resources to provide the additional support; and WHEREAS, the costs of this contract attorney support for the City Attorney's Office are $J.2,000; and WHEREAS, there will be no developer reimbursement fr:>r the preparation of the Transfer of Development Rights Ordinance; thus the project will be funded from the General Fund Budget Stabiliza.tion Reserve; and WHEREAS, City Council authorization is needed to amend the 1995-96 budget as hereinafter set forth. • • NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. The sum of Twenty Two Thousand Eight Hundred Dollars ($22,800) is hereby appropriated to non-salary expenses in the Advance Planning Functional Area in the Planning Department, and the Budget Stabilization Reserve is correspondingly reduced. SBCTION 2. The sum of Twelve Thousand Dollars ($12,000) is hereby appropriated to non-salary expenses in the Project-Based City Staff Support Functional Area in the City Attorney's Office 5 and the Budget Stabilization Reserve is correspondingly reduced~ SECT*Q.N _l. This transaction will reduce the Budget Stabilization Reserve from $13,596,266 to $13,562,266 . .sECTION 4. As specified in Section 2.28.080(a} o.f the Palo Alto Municipal Code, a two-thirds vote of the City Council is required to adopt this ordinance. SECTIQN 5. The Council of the City of Palo Alto hereby finds that the enactment of this ordinance is not a project under the California Environmental Quality Act and~ therefore,. no enviro~~ental impact assessment is necessary. ,SEJ;TION 6 . Municipal Code, adoption.
