ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE BUDGET FOR THE FISCAL YEAR 1997-98 TO PROVIDE AN ADDITIONAL APPROPRIATION FOR LITIGATION ASSOCIATED WITH THE CITY OF MENLO PARK'S CHALLENGE TO THE STANFORD SAND HILL ROAD CORRIDOR PROJECTS, TO BE REIMBURSED BY STANFORD WHEREAS, pursuant to the provisions of Section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 23, 1997 did adopt a budget for fiscal year 1997--98; and WHEREAS, in August 1997 the City of Menlo Park filed an action challenging the Palo Alto City Council's approval of the Stanford Sand :_ii Road Corridor Projects; and WHEREAS, the City will incur costs in its defense of the tigatic:n, which are estimated to be up to $150,000; and WHEREAS, the City's development agreement with Stanford requires Stanford to fund the City's defense in this litigation through reimbursement; and WHEREAS, City Council authorization is needed to amend the 1997-98 budget as hereinafter set forth. NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. Budgeted reimbursements to the General Fund from Stanford are increased by the sum of One Hundred and Fifty Thousand Dollars ($150,000). SECTION 2. The sum of One Hundred and Fifty Thousand Dollars ($150,000) is hereby appropriated to non -salary expense;- in the Litigation and Dispute Resolution Functional Area in the City Attorney's Office Department. SECTION 3. This transaction will have no impact on the Budget Stabilization Reserve. SECTION 4. As specified in Section 2.28.080(a) of the Palo Alto Municipal Code, a two-thirds vote of the City Council is required to adopt this ordinance. SECTIQN 5. The Council of the City of Palo Alto hereby finds that this is not a project order the California Environmental Quality Act and, therefore, no environmental impact assessment is necessary. SECTZQN 6. As provided in Section 2.04.350 of the Palo Alto Municipal Code, this ordinance shah become effective upon adoption.
