HomeMy WebLinkAbout1997-08-04 Ordinance 4440• • ORDINANCE NO. 4440 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING SECTIONS 2.04.370 AND 2.04.380 OF CHAPTER 2.04 [COUNCIL ORGANIZATION AND PROCEDURE] OF THE PALO ALTO MUNICIPAL CODE TO ESTABLISH COUNCIL SALARIES AND EXPENSE ALLOWANCES TO BE EFFECTIVE JANUARY 1, 1998 follows: follows: The Council of the City of Palo Alto does ORDAIN as SECTION 1. The City Council finds and determines as A. The City Council has not received a salary increase since 1980. B. Article III, section 17 of the Charter of the City of Palo Alto permits to adopt Council compensation provided the amount does not exceed the amount provided by general law. Government Code section 36516 provides that: Council salaries for cities the size of Palo Alto may be either up to $500.00 per month, or an amount equaling an increase of not more than five (5) percent for each calendar year from the operative date of the last adjustment of the salary. C. The Council's salary was last adjusted in 1980 (Ordinance No. 3335) and 1982 (Ordinance No. 3221), with the 1982 action solely to bring the salary of all Council Members to $400.00 per month. Pursuant to Government Code section 36516, the maximum Council salary could therefore be in excess of $831.00 per month. D. The Council desires to delay the effective date of this salary increase until after one or more Council Members have commenced a new term of office, which will be January 1, 1998. E. The Council further desires to increase the Mayor's expense allowance, and to decrease the Vice -Mayor's expense allowance. SECTION 2. Palo Alto Municipal Code section 2.04.370 is hereby amended to read as follows: 2.04.370 Expense allowance for council members. The council by resolution, may adopt a travel and expense policy providing a schedule for expense allowances for its members and an amount shall be included in the council budget to reimburse members of the council for expenses incurred in their service as members of the council. Notwithstanding the above, the mayor shall receive $200.00 per month for expenses and the vice mayor shall receive $50.00 per month for expenses incurred in filling these offices. 1 970818 bdc 005!807 • SECTION 3. Palo Alto Municipal Code section 2.04.380 is hereby amended to read as follows: 2.04.380 Salary of council members. The salary of the council members shall be $600.00 per month. ,ET ON 4. The salary and expense allowance changes adopted by this ordinance shall commence on January 1, 1998. SECTION 5. The City Council hereby finds that adoption of this ordinance does not constitute a project under the California Environmental Quality Act because it can be seen with certainty that there is no possibility that any environmental effect will result from this ordinance. SECTION 5. This ordinance shall be effective on the thirty-first day after the date of its adoption.
