ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING SECTION 2.08.050 OF CHAPTER 2.08
(OFFICERS AND DEPARTMENTS) OF THE PALO ALTO
MUNICIPAL CODE TO AUTHORIZE THE CITY MANAGER TO
PRESCRIBE AND ENFORCE REGULATIONS FOR PUBLIC USE
OF CITY BUILDINGS AND OTHER FACILITIES
The Council of the City of Palo Alto does ORDAIN as follows:
SECI'IGN 1. The Council finds and determines as follows:
A. Section 2.08.050 of Chapter 2.08 of the Palo Alto
Municipal Code authorizes the city manager to prescribe and enforce
rules and regulations for the operation and management of all
offices and departments and to recommend to Council rules and
regulations for the management of all offices and departments of
the City; and,
B. Council desires to authorize. the City Manager to
further prescribe and enforce regulations governing the entry into
or use by members of the public of City real property, buildings,
structures, or other facilities which may be necessary or desirable
to assure that such access and use is consistent with the use of
those facilities by other members of the public or by City staff
and protects and preserves the health, safety, comfort, and
convenience of other public users of those facilities
SECTION 2. Palo Alto Municipal Code Section 2.08.050 is
hereby amended to read as follows:
2.08.050 Rules and regulations.
(a) The city manager may prescribe and enforce such
rules and regulations as may be deemed necessary for the operation
and management of all offices and departments coming under his or
her control, and may recommend to the council for approval rules
and regulations for the management of all offices and departments
of the city.
The city manager shall communicate to all parties concerned
the content of such rules and regulations, and in addition shall
file with the city clerk a true copy, which is to be kept in a
suitable record. This record shall be available for inspection in
accordance with state law.
(b) The city manager may prescribe and enforce
regulations for entry into or use by members of the public of any
city real property, building, structure, or other facility. Such
regulations may restrict or prohibit the times and duration of
entry into or use by members of the public of specified city
facilities. Such regulations may restrict or prohibit the entry
into or use by members of the public of motor vehicles, bicycles,
skateboards, roller skates, or other conveyances on specified city

facilities. Such regulations may restrict or prohibit the personal
conduct of any member of the public within specified city
facilities. Any such regulations shall be prescribed and enforced
for the purpose of providing maximum access to and use of city
facilities by members of the public consistent with the public
health, safety, comfort, and convenience of all other public users
of the city facilities.
Any regulation prescribed by the city manager for public
entry into or use of any city real property, building, structure or
other facility shall become effective on the fifteenth day
following notice sent to the city council, provided, however, that
any regulation may be terminated or modified at any time by
resolution or ordinance. It shall be unlawful for any person to
disobey or fail to observe any such regulation of which such person
has actual notice, however given, or constructive notice through
appropriate signs or notices posted on affected city real property,
building, structure, or other facility.
Any regulation prescribed by the city manager for public
entry into or use of any city real property, building. structure or
other facility shall be filed with the city clerk and shall be
available for inspection in accordance with state law.
SECTION 3. The City Council hereby finds that adoption of
this ordinance does not constitute a project under the California
Environmental Quality Act because it can be seen with certainty
that there is no possibility that any environmental effect will
result from this ordinance.
SECTION 4. This ordinance shall be effective on the
thirty-first day after the date of its adoption.
