The Council oj~ the City of Palo Alto does ordain as follolis:
Sectiou 1. Al~ticles 23 and, 24 or Ordinance No. 1324 1 the "Zon~ng ordinance 1 " h!I•eby ar-e amend'ed to read as follows:
ARTICLE 23. VARIANCES & USB PERMITS
Sec. 23.01. ZCininf Administrator May Grant Variances and Use
Ye!riii s.
. Subject to the provisions of this article and in
harmony ~r1 th the general purpose and intent or this ord1-
nance1 th:e Zoning AC.m1nistrator may grant a variance from
the area,, height 1 yard and spac~ requirements or tt:...1&.·:
ordinance or to Ordinance No. 1330, the Setback Ordinance1 o·r a use permit tor any or the uses or purposes tor which
such permits are required or permitted by the terms of this
ordinance.
Sec. 23.02. Application for Use Permit or Variance
Application for a variance or us~ permit shall be
.-nade in w·riting to the Zoning Administrator on a form
prescribed by him and shall state:
(a) 'rhe name and address of the applicant.
(b) Evidence that the applicant:
(1) Is the owner or purchaser under contract
of .. the premises involved; or
(2) Has the written permission of such owner

Sec. 23. 04. _!!ling Fee_!.
Applications shall be accompanied by the following
fili:ng i"ees 1 no part of which shall be returnable to the
applic:ant:
(a) For a use permit: $15.00
(b) ~or a variance: 25. 00
Sec. 23.0!5· Public Hearing -Time of HearinS,.·

istrator shall set the matter tor public ht~aring and such
hea4:"~Lng shall be w1 thin thirty (30.) days Oj~· the filing of
such application. ·
Sec. 23.06 .. Public Hearing -Posting and ~ilir.\i of Notice.
(a) Notice or such hearing shall be given by po.et:Lng
notic~e ~;hereof on the property 1nvol ved and on both sid~)S
of aJLl fltreets w1th1n a I~adius or ~~50 feet from the ex
teric)r J.:!:.mi ts of the property involved 1n such manner a::1
will rea.sonably giv~ notice to pasa.ersby of the matters
cont~Lined in SI.JCh notice. Such notices shall be placed
not ntc,re than 100 feet a.part and shall be placed 1n a
stagge:red manner so that notices on one aide of the
streElt sball be approximately m1dwa::r between notices on
the c>the:.~ side of the street. Such notice shall contain
e1th~tr tl:1e s tr~et address as shown by the records of the
City Eng!'.neer of Palo Alto or a legal descr:tpt:ion of the
propet~ty for which a variance or use~ perm1 t i~:; sought;
notic~e of' the time 1 place and purpof!~e of the b.ear1ng;
refet•ence t;o the application. on file with the .Zoning
J~dm1n1strator !'"or particulars; and a statemenc that ;;my
interested person may appear either 1n parson 1 or by
agent~, and be heard. Notices to be posted shall be hnaded
by the words "Notice of .ii~ar1ng 1 a printed in lf.~tters not
less than one. {1) inch in height.
('b) A notice of su.ch hearing shall also be mailed to
th& nppl1cant; and to the persons to whom is assessed the
proporty within 250 feet or the exterior limits or the
propnrty involved, provided .. however, that the :railure
to g~L ve such notice by ma1lil'lg, or or the person addreased
to r(~Ci!ive the same, shall not affect the jurisdiction of
the :~cming A::lm1n1strator to proceed w1 th the hearing
noti<~ed.
(c) Poating and mailing of notice of hear1.ng shall
be C<)Dti?leted. not less than ten ( 10) days prior to the

Sec. 23.07. Public~ Hearing:: Decision.

as in his opinion is 1nd.icated by such evidence. Each hear
ing eball be open to the· public. He may continue from t1me
to time any hearing held b7 him. A decision shall be ren-

after conclusion or thte hear:Lng1 and notice there<>f shall be

posed use at the prc)posed. location will not oe detrimental
to adjae~nt propert~r nor a menac·e to 1:>r endanger the public
aealth., aa.rety or ge1neral welfare, he may authorize a use
permit u:~o:n such C01'l:d1t1ons as het deeum necessary tc secure
the purp(::>s1es ot this ordinance.
Se'~. 23. 09. .Q:;t"Ound.e for G:r;:!ntinf: Variance~: Condi t1ons.
{a) The Zoning Administrator may grant a variance rro1m
t.he area., height 1 yard and space requirements of this ordi
nance if, from the application or the tacts presented at the
public hi:tar1ng, he f'inds:
(1) ~hat there-are exceptional or extraordinary
circumstances or conditions applicable to the
property-involved that do not apply generally to
property in the san1e district; and
(2:) That the granting or the application is
tl.ecessary ror the preservation and enjo:vment of
a. substantial prop-erty right of the applicant and
toprevent unreasonable property loss or unnecessary
hardship and.w1ll not be detrimental or injurious
t.o the property or improvements of othe:t• owners or
property; and
(3) That the granting of the application will
not be detrimental to the public welfare or con
venience.
In granting such variance the Zoning Administrator may
· 1mpoae such reasonable conditions or r~estr1ct1ons as he
deems appropriate or necesaa.ry to prot,~ct the public health1 safety or welfare.
(b) The Zoning Actministrator may ~~ant a variance
from the requirements of Ordinance No. 1330., the Setback
0::-dinanee~ i:f' facts presented in the application or at
the public hearing support both paragraphs (2) and (3) or
subsection (a) of this section.
Sec. :23. 10. Variance, Temporary an.d Condi t1q,n!-.l·
The :Zoning Ad::ninis tra tor~ ~r1 th the approval c1! the
City Mana,:;er, may, without a hearir1g and without a fee,
grant a tt!mporary and conditional variance from an.y of the
provis1om'3 of this ordinance for a period of not to exceed
thirty (30) daye 1 provided the granting of such variance
w~Lll not be detrimental to the public interest 1 health or
wE~lfare.
Sec. 23~11. Effe.ctive Date of Variance and Use Permit.
A ~al:-1ance or use perm. t granted l:>y the Zoning Admin-
1e:trator nhall not take ef'fect until arter an. elapsed period
of ter1 (10) days af'ter the mailing of the notice o·r the
de·c1aion, a.uring which time an appea.l may be filed with the
Planning c;ommssion as provided in Article 24 of this ordi
nance.

(a) In any ease where the eon~:litions to th:e g:L .. ant1:og
ot a ,variance or use permit hav~ n~:>t been or are rr.ot coun
p11e·i with$ the Zoning Admi:nistrator shall give notice ·to
the perm1tee or intention to revok1~ sueh permit at least
ten (10) days prior. to a hearing ti:1ereon. Following auch
heartng.and if good cause exists therefor; the Zoning Ad
mimstrator may re.voke aueh permit or variance.
· (b) A use perm1 t or a. variance which has not been
used vi thin one (1) yea::-atter the date or g:~:-anting there
or b~acomes null and void and of no effect except that the
Zoni:::1g Administrator may, without a hea.r·ing, extend such
time for an addi t1o:tnal year only upon application filed
with him be;t'ol:'e the expiration or the r-=.ret year.
Sec. 23.13. Variances an~i Use Permits Transferable.
Any valid variance or use permit granted ~ursuant to
the provisions or this ordinance ~·-a hereby declared to be
trannferable unless otherwise provided at the time ·Of grant
ing.
Sec. 23. 1~~. Re2ort co Council ang_ Planni!l.i Commissio't!.
The Zoning Administrator shall make a monthly report
to the City Manager of action taken on all applications tor
varitmces and use perm! ts. A copy of sueh report shall also
be forwarded to the City Council and the Planning Commission.

An appeal may be ta.ken to the Planning Commission by
